Meanwhile, a retired Swedish prosecutor explains why the Julian Assange situation should never have occurred, and says “the prosecutor-general should…rescind the decision to reopen the investigation, rescind the arraignment ruling, and rescind the arrest warrant.

Aggressive Ignorance

While bogus “trafficking” studies by hired researchers are misleading and dangerous, those performed by “trafficking” fetishists themselves are just plain hilarious.  This one from the Imagine Foundation studied online sex work ads for three months in order to reach the exciting and important conclusion that hotels tend to be clustered along busy highways.In Bed with Susie Bright   I’ll bet you’d never have guessed.

The Enlightenment Police

A French court…convicted a young woman for wearing a full-face Islamic veil in public and threw out her bid to have the…ban  declared unconstitutional.  Cassandra Belin, 20, was also convicted of insulting and threatening three police officers at the time of her arrest, which sparked two days of rioting…in July, 2013.  She was given a one-month suspended prison sentence for the clash with the police and a 150-euro ($200) fine for wearing the veil…

A…deputy has been terminated after handcuffing a woman and forcing her to perform oral sex on him…Willie Marshay Greer…was…charged with aggravated rape and official misconduct.  Greer reportedly stopped [the] woman for speeding…[and used the threat of] arrest [to extort sex]…

And another from California:

A woman who was shown on camera tumbling out of a moving LAPD squad car last year said she fell out…to avoid being sexually assaulted by her arresting officer…Kim Nguyen, a 27-year-old pharmacist, says she was handcuffed…when [he]…began opening her legs.  [After the fall] Nguyen…spent two weeks in the hospital [with] her jaw…wired shut [and] lost all of her teeth…

Thanks to “gang” rhetoric, “sex trafficking” is becoming a new excuse for locking up young black men:

Twenty-four street-gang members…have been indicted on charges of conspiring to run an interstate prostitution ring…in San Diego, Arizona and New Jersey…At a national “Players Ball,” one of the defendants received an award as pimp of the year.  Pimps…have a liking for chalices and scepters, known as Pimp Cups and Pimp Sticks…[and] “often” have removable dental “grills” made of gold and costing thousands of dollars…the U.S. attorney is seeking forfeiture of such trophies…Of the 60 sex-trafficking victims [arrested], 11 were minors…Some…were “branded” with tattoos of gang monikers, bar codes or the name of their pimp…[they were recruited with] rap videos on YouTube…

Worse Than I Thought

Kudos to Reason TV for doing a short documentary on how horrible California’s “anti-trafficking” CASE Act is, and for interviewing sex workers about how criminalization increases exploitation.  Unfortunately, they also interviewed the superlatively awful Dennis Hof, who as usual used the opportunity to spread lies about independent sex workers (in this case, that we’re diseased) in order to argue for imposition of the Nevada system which enriches and empowers people like him.  I’ve spoken to video producer Zach Weissmueller, though, and asked for his help in getting Reason more on board with (libertarian) decriminalization rather than (crony-capitalist) Nevada-style legalization. Proposition 35 ad

It’s always deeply satisfying to catch a “trafficking” lie in the process of expanding; in September we were told that Tampa ranked third in Florida for “sex trafficking”, but now they’re claiming it’s third in the whole country.  I suggest they discuss this with Miami and Toledo.

These self-appointed “trafficking experts” claim they can identify “sex traffickers” (in South Dakota.  Seriously.)  But after all the “abduction” and “Stockholm syndrome” mythology, it still comes down to harassing women: “it may be easier to determine whether someone is a trafficking victim, than it is to figure out a trafficker.”  The “signs” include staying out late and having a generous boyfriend.

Profound Ignorance (TW3 #310)

A scathing demolition of the horrendous “study” which claimed legalized prostitution increases “sex trafficking”, and also of the “sheer implausibility of the claims that 30% of all prostitutes are trafficked…”:

Another Small Victory (TW3 #317)

Where are the Victims? (TW3 #322)

A novel attempt to use New York State’s sex trafficking law…ended with mixed results…as the men were convicted…of promoting prostitution and of money laundering, but…acquitted of…sex trafficking…The law defines trafficking based on the methods the pimps use to control the prostitutes, rather than whether the prostitutes view themselves as victims…prosecutors…presented an expert to testify that women working as prostitutes are often not aware that they are victims.  But three of the women themselves  testified for the defense…and…were upset…at the…[suggestion] they were not to be believed…

Consider for a moment the incredibly dangerous precedent a prosecution victory would have set; state “experts” would be allowed to define any person as a victim in any crime regardless of that person’s viewpoint.

The owner of a Lawrence [Massachusetts] massage parlor coerced employees to perform sex acts on…customers, some of whom were videotaped without the clients’ knowledge…Authorities said Barron used the videotapes to blackmail employees to keep working for her…”  Dear ethically-challenged sex business owners:  Stop videotaping clients, you moron.  See, there’s this thing called “evidence”…

Pimping the Pimp

More egregious use of “pimp” mythology to justify Nevada’s draconian “sex trafficking” law:

Because of their age, they will have difficulty working inside most [hotels].  For most, that means hitting the streets under the eye of a pimp and more experienced prostitutes.  And the more they must rely on the pimp, the more difficult it is to pry them from his clutches…So when Assembly Bill 67 surfaced…earlier this year, the police welcomed it as a way to send a message to pimps that there would be a higher price to pay for running young girls…

Once again:  teens don’t turn to sex work because a “pimp” abducts them from their loving families, and 84% of them have never as much as met one.

Good News, Bad News

Sometimes, reading stories about prostitution law is like the classic joke format.  GOOD NEWS:  77% of Canadians support decriminalization of prostitution and UNAIDS has condemned criminalization of sex work (including the “Swedish Model”, “end demand” schemes and the rescue industry) as a danger both to sex workers and to public health:

…Forced rescue and rehabilitation practices lower sex workers’ control over where and under what conditions they sell sexual services and to whom, exposing them to greater violence and exploitation…this leads to social disintegration and a loss of solidarity and cohesion (social capital) among sex workers, including reducing their ability to access health care, legal and social services.  Low social capital is known to increase vulnerability to sexually transmitted infections among sex workers and therefore has a detrimental impact on HIV prevention efforts…undermining sex worker organisations is one of the most important negative effects of law enforcement practices…anti-trafficking efforts typically ignore the possibility of engaging sex workers as partners…[even though they] are often best placed to know who is being trafficked into commercial sex and by whom, and are particularly motivated to work to stop such odious practices…Organised groups of sex workers are also best placed to establish safe working norms within the sex industry, and influence other[s]…to ensure that trafficked adults and children are not retained in sex work…

BAD  NEWS:  Western Australia is starting to buy into the “trafficking” narrative:

Federal police have launched an operation to rescue people trafficked into WA for forced labour, prostitution and servile marriages.  There are fears that an increasing number of women are being brought to Perth and forced into the city’s sex industry.  Supt Glyn Lewis…said human trafficking was insidious and abhorrent and many victims were never found…There have been only 14 convictions for human trafficking since legislation came into force in 2003.  People working in the area in Perth fear trafficking is a real and emerging issue “under the radar” of authorities and the public.  Australian Catholic Religious Against Trafficking in Humans said the problem had to be addressed…

None of these people stop to consider that maybe the reason that there are so few convictions and “many victims were never found” is that there was no crime in the first place.  But hey, we can’t let facts get in the way of hysteria and fear-mongering by cops and religious groups.

Scientific Detachment

The ability to look at sensitive subjects dispassionately and to present evidence without emotion is an admirable one, but as Professor G.S. Brindley (the doctor who developed the first medical treatment for erectile dysfunction) discovered in 1983, it’s probably best not to assume that the majority of one’s audience possesses that capacity to any great degree.  This January 27th article on the Discover magazine blog explains, and since synopsizing it in any way would do it a disservice, I’ll just leave you with the link.

Nothing in the Dark (August 8th, 2010)

This story demonstrates not only the reason for considering condoms a “safety net” against disease rather than a first line of defense, but also the reason I’m hesitant to entrust my health to a government bureaucracy:

…South Africa’s leading anti-AIDS group said…that…faulty condoms are among more than 1.35 million handed out at the African National Congress’ 100th birthday party…[they were] recalled but the Treatment Action Campaign said no warning has been issued to people that they may have carried away defective condoms…The third recall in less than five years raises questions about the quality of some of the 425 million-plus condoms that the government gives away each year, and the competence of the South African Bureau of Standards [SABS] that is supposed to ensure their quality…In 2007, the government recalled more than 20 million defective condoms…but recovered only 12 million…a [previous] recall…[resulted after] a testing manager at [SABS took] a bribe to certify the faulty contraceptives…

[AIDS activist Sello Mokhalipi] said people started coming with complaints about the condoms…three days after the celebrations ended…”We poured water into the condoms and they were leaking, not just in one place, they were leaking like a sieve,” he said.  Looking at them, “you can see there are small pores” like pinpricks…the Sex Workers Education and Advocacy Taskforce, said many of the 10,000 to 15,000 prostitutes they work with often complain about the free government condoms…[so] they instead use a brand provided by an international charity…South Africa’s government sources its condoms from several companies and rebrands them with its colorful CHOICE packaging, in bright blue, red, yellow and green…

Any time there’s a lucrative government contract, there’s going to be graft.  And anything sourced out to the lowest bidder…

Who Did Your Tits? (October 1st, 2010)

Most women who have boob jobs feel they confer psychological and/or financial benefits, but I never considered this possibility:

A 41-year-old Florida woman says the breast augmentation surgery she had three months ago saved her life…her ex-fiancé’s new girlfriend…attacked her…stabbing her repeatedly in the left side of her chest…the knife had punctured the implant and she was soaked with saline.  Doctors say the salt water and walls of the implant prevented a deadly blow.

The Camel’s Nose (October 2nd, 2010)

Yet another spooge sneaker; this one is so reprehensible he constitutes a one-man argument in favor of sex offender registries:

…Mark Berndt, a third-grade teacher [at Miramonte Elementary School in California]…is charged with committing lewd acts on 23 boys and girls, ages 6 to 10, between 2005 and 2010…[he] was removed from classwork in January 2011 and fired within the month, but only parents of children identified as victims were told…some angry parents…complained that they only learned of the investigation through the media after Berndt’s arrest this week.  School officials and investigators said proper procedures were followed…but…two former students…said school officials were informed about [Berndt’s] odd behavior two decades ago

…Berndt is suspected of snapping nearly 400 photographs of…students, some with a giant Madagascar cockroach from a classroom terrarium on their faces.  Others were blindfolded or had clear tape over their mouths, and some were shown with a spoonful of milky liquid placed near their lips…The photo sessions were treated as a game and some children were given sperm-laced cookies to eat as treats…The investigation began in the fall of 2010 when a film processor became suspicious about the photographs and turned them over to…police…an investigator…found a blue spoon…in a trash can [in Berndt’s classroom] that appeared to be the one seen in the photographs, but it took months before analysis determined there was semen on the spoon and more time before DNA testing matched it to Berndt…Meanwhile, investigators kept trying to identify children in the photographs…

I would hope that prosecutors build their cases on photographic and DNA evidence, and that they, cops and parents have the sense not to question the children or (even worse) subject them to the ordeal of trial participation; adult eyewitness testimony is unreliable at best, and that of children is often worse than useless.  Alas, I fear that’s a vain hope; adults just can’t resist traumatizing young children by subjecting them to frightening and confusing interrogations and filling their heads full of horrible images, thus exploiting them just as monstrously as the criminal did.

Welcome To Our World (January 20th, 2011)

I think my readers can answer David Reber’s questions, which he seems to consider rhetorical:

…What could a teacher possibly know about education?  Countless arguments used to denigrate public school teachers begin with the phrase “in what other profession…” and conclude with practically anything the anti-teacher pundits find offensive about public education…In what other profession, indeed.  In what other profession are the licensed professionals considered the LEAST knowledgeable about the job?  You seldom if ever hear “that guy couldn’t possibly know a thing about law enforcement – he’s a police officer”, or “she can’t be trusted talking about fire safety – she’s a firefighter.”  In what other profession is experience viewed as a liability rather than an asset?  You won’t find a contractor advertising “choose me – I’ve never done this before”, and your doctor won’t recommend a surgeon on the basis of her “having very little experience with the procedure”.  In what other profession is the desire for competitive salary viewed as proof of callous indifference towards the job?  You won’t hear many say “that lawyer charges a lot of money, she obviously doesn’t care about her clients”, or “that coach earns millions – clearly he doesn’t care about the team”…For no other profession do so many outsiders refuse to accept the realities of an imperfect world.  Crime happens.  Fire happens.  Illness happens…People accept all these realities, until they apply to public education…

Well, Mr. Reber, there is at least one other…

The Enlightenment Police (October 1st, 2011)

One would think the usually-sensible Dutch would have waited to see what the European High Court will do with the French version of this first:

The Dutch…government plans to ban Muslim face veils…”People should be able to look at each other’s faces and recognize each other when they meet,” the interior affairs ministry said…The ban will also apply to balaclavas and motorcycle helmets when worn in inappropriate places, such as inside a store, Deputy Prime Minister Maxime Verhagen told reporters, denying that this was a ban on religious clothing…The face-veil law, which still needs to win approval in both houses of parliament, excludes clothing worn for security reasons such as that worn by firemen and hockey players, as well as party clothing such as Santa Claus or Halloween costumes.  The ban does not apply to religious places, such as churches and mosques, nor to passengers on airplanes or en route via a Dutch airport…

Hark, Hark, the Dogs Do Bark (January 11th, 2012)

Since neofeminists insist that all gendered behavior is “socially constructed”, I’m sure they’ll deny these findings just as creationists deny fossils and carbon dating:

Testosterone makes us overvalue our own opinions at the expense of cooperation, research from…University College London has found…Problem solving in groups can provide benefits over individual decisions as we are able to share our information and expertise.  However…collaborating too closely can lead to an uncritical groupthink, ending in decisions that are bad for all…research has shown that people given a boost of the hormone oxytocin tend to be cooperative.  Now…researchers have shown that…testosterone has the opposite effect — it makes people act less cooperatively and more egocentrically.

Dr Nick Wright and colleagues…[tested] 17 pairs of female volunteers who had previously never met…On one…day…[they] were given a testosterone supplement; on the other day, they were given a placebo.  [Men were not used because supplements can trigger a drop in their own testosterone production, invalidating the results]…as expected, cooperation [in a task] enabled the group to perform much better than the individuals alone…but, when given a testosterone supplement, the benefit of cooperation was markedly reduced.  In fact, higher levels of testosterone were associated with individuals behaving egocentrically…”Most of the time, this allows us to seek the best solution to a problem, but sometimes, too much testosterone can help blind us to other people’s views,” [said Dr. Wright.]  “This can be very significant when we are talking about a dominant individual trying to assert his or her opinion in, say, a jury”…

As I said last month, it’s amazing how many of these stories seem to crop up around the holidays!  So without further ado, here’s the first batch of the year.

Real People (February 6th, 2011)

It’s a classic Catch-22; because of criminalization prostitutes need to be discreet, but anonymity allows the prohibitionists to invent lies about us that further support for criminalization.  So it’s always good to see articles that show sex workers are people like anyone else; this one is from the December 12th Daily Sundial, the student newspaper of California State University, Northridge:

 “I started stripping when I was 19 because I had huge debt…” said Jane Doe, 32, a doctoral student at USC…“I loved it…Of all the shit jobs I had ever had, it was the only shit job that was not a shit job.”    Doe’s story is not atypical; according to a recent study on…sex work by Widener University’s Sarah Elspeth Patterson…“10 percent of students know of students who engage in sex work in order to promote themselves financially, with 16.5 percent indicating that they might be willing to engage in sex work to pay for their education”…

For Jessie Nicole, 25, sex work was the only employment option that allowed her to make ends meet and remain a full-time student.  “I was broke,” Nicole said.  “I had a scholarship that paid my tuition and 70 percent of my books, but that doesn’t pay your rent, that doesn’t give you food, and you still have 30 percent of your books.”  Nicole, now the director of SWOP’s Los Angeles chapter, began dating “sugar daddies” when she was a 19-year-old undergraduate at Florida State University, but turned to escorting when she moved to Chicago for graduate school.  “One of the easiest things about escorting in grad school was that I could pay to live and work a couple of hours a week,” Nicole said.  “That was so crucial to me.  I had a thesis to write…[My] time [was] really precious.”

Though sex work helped pay for both Doe and Nicole’s schooling, the cost of education left each of them in an incredible amount of debt.  According to the Widener University study, 2010 college graduates are carrying an average of $25,250 worth of debt…“I did sex work to live and be a student and then I graduated and couldn’t find a job because I have a master’s in humanities,” Nicole said.  “…So I kept doing sex work.  And I’m still using sex work to pay off my student loans”…According to Nicole…many who critique and condemn sex work see the industry as coercive and degrading.  “(Sex work) is a job like any other job,” Nicole said…according to [her], there are more student sex workers than one might think.  “I didn’t (out myself) when I was in school,” Nicole said.  “When I did come out, I found at least three other friends that were doing sex work in Tallahassee at the same time that I was.  I was like, ‘are you fucking kidding?  Is this just my group of friends or is everyone carrying this around?  Why didn’t we work together?’”…

The story also interviews a professional submissive and has a short section on neofeminist anti-whore rhetoric.  Nicole’s last point is very true; in my experience university students are the second largest group among escorts, after young divorcees with kids.

Heroines (May 16th, 2011)

OK, so breast self-examination is a little off-topic, but I’ve mentioned superheroines before so I just had to tell you about this PSA from Mozambique in which Wonder Woman gives herself an exam.  Other ads in the series feature She-Hulk, Catwoman and Storm of the X-Men.  The only thing I want to say is that I find it easier to do my exams topless, but I guess then we wouldn’t know who they were (except for She-Hulk, who’s pretty recognizable in any state of dress).

A Procrustean Bed (May 19th, 2011)

Though this essay was about a Massachusetts law, the principle applies to any part of the US:

…trafficking  mythology…requires that the state produce victims other than the amorphous “public decency” or the faceless “state”.  A “human trafficker” requires a human to “traffick”, so the law amputates prostitutes’ legal “legs” (i.e. the presumption of adult self-determination), reducing us to victims unable to walk into or out of prostitution on our own.  And if all whores are victims, all those who assist us in our work must therefore be victimizers…[such laws define] anyone who “manages” a prostitute (of course, “manage” is not specifically defined) as a “pimp” and all pimps as “human traffickers”, thus stretching escort service owners, drivers, boyfriends and husbands into international gangsters.

Here’s the Big Apple’s version, courtesy of the December 14th New York Times:

…As prostitution has shifted off the streets and into hotels and apartments, the drivers who transport prostitutes have emerged as some of the industry’s most powerful players.  Sofia, who uses a pseudonym because she fears retribution from traffickers, said that when she was enslaved as a prostitute, her drivers organized her schedule, drove her to appointments and took half of her earnings before she turned over the remainder to her pimp…On Wednesday, Sofia will testify, from behind a screen, before a joint hearing of the City Council’s Transportation and Women’s Issues Committees, on two pieces of proposed legislation that would penalize drivers who knowingly transport prostitutes.  The first proposal…would raise the fines on drivers who knowingly transport trafficking victims, and would direct the Taxi and Limousine Commission to add training for all its drivers on the subject of sex trafficking…Sofia estimates that she worked with 70 drivers, who brought her to 5,000 clients…Sofia said that the drivers rarely spoke to her, except when they tried to recruit her away from her pimp.  “They promised us a better life,” Sofia said.  “I know a lot of girls who said they left the pimp they were working with.  In the end they just worked for the driver.”

Is there any truth at all to this story?  Who knows?  It’s hard to take seriously an article whose very first sentence is based in a fallacy (that the majority of prostitution used to take place on the street, which it never has), and which characterizes low-end employees as “the industry’s most powerful players”.  It also uses the phrase “enslaved as a prostitute” but then at the end states that the so-called “slaves” can work for whoever they like (including, logically, themselves).  The huge numbers (70 different drivers?  5000 clients?) sound suspiciously like “reframed experiences” to me, and a lot of dubious assertions are trotted out to justify giving pigs and prosecutors the power to railroad (mostly immigrant) cab drivers as “human traffickers” for the “crime” of giving rides to hookers.

The Enlightenment Police (October 1st, 2011)

French prosecutors with nothing productive to do now want to send Hind Ahmas (whom we met in this column) to prison, as explained in this December 13th article from the Daily Mail:

A 32-year-old mother from France is set to become the first woman ever to be sent to prison for wearing an Islamic veil.  Hind Ahmas refuses to accept the legitimacy of a Paris court which has ordered her to spend 15 days learning her civic duties…Ahmas was not allowed into the hearing…because she refused to remove her face covering.  But prosecutors made it clear to her lawyer, Gilles Devers, that Ahmas now faces two years in prison and a £27,000 fine.  ‘There is no possibility of me removing the veil,’ Ahmas said.  ‘I’m not taking it off.  The judge needs citizenship lessons, not me.’  Ahmas, who has already refused to pay a fine of around £100 for wearing a veil on another occasion, intends to take her case to the European Court of Human Rights…If Ahmas does become the first woman in the world to go to prison for wearing a veil, then it will be seen as a huge propaganda coup for Islamic-rights campaigners.

Mr Sarkozy said the ban on head coverings was not aimed at persecuting Muslims, but merely to make France a more tolerant, inclusive society…But the sight of a young mother being led away to the cells merely because she refuses to take off her veil will cause outrage around the world.  Mr Devers said the veil ban was ‘unconstitutional’, while senior police officers have told judges that it is unenforceable without persecuting women…

Only a politician could believe that it’s possible to create a “more tolerant, inclusive society” by being intolerant and exclusive.

My friend Philippa had a gift for coming up with memorable phrases, two of which I’ve used as the titles of previous columns (“Good Fantasy, Bad Reality” and “No Fun Shall Be Had”).  “The enlightenment police” was her term for, as I stated in my August 30th column, “people who think their ideas about proper living need to apply to everyone else’s personal preferences.”  The “enlightenment police” differ from plain old garden-variety moralistic busybodies chiefly in their rhetoric, which eschews traditional terms like “sin” and “salvation” in favor of terms like “oppression” and “empowerment”.  But they are exactly like other moralists in their absolute faith in their own righteousness, their infantilization of adults who have beliefs which disagree with theirs and their willingness to “rescue” others at the point of a gun.

One of the interesting things about tyranny is the way it creates empathy between groups who might otherwise have nothing to do with one another.  It would be difficult to conceive of two kinds of women who were farther apart on the modesty scale than whores and Muslim women who observe hijab, yet we are both targeted by “enlightenment police” armed with neofeminist rhetoric who are willing to deny our rights, to rob us of agency and to oppress us in the name of “freeing” us from “male oppression” no matter what we might want for ourselves.  And because of that, the struggles and statements of the French Muslim women from this story in the Guardian of September 19th may seem eerily familiar to prostitutes and those who support our rights:

…In April, France introduced a law…[banning] Muslim women in full-face veils, or niqab…from any public activity including walking down the street, taking a bus, going to the shops or collecting their children from school.  French politicians in favour of the ban said they were acting to protect the “gender equality” and “dignity” of women.  But five months after the law was introduced, the result is a mixture of confusion and apathy.  Muslim groups report a worrying increase in discrimination and verbal and physical violence against women in veils.  There have been instances of people in the street taking the law into their hands and trying to rip off full-face veils, of bus drivers refusing to carry women in niqab or of shop-owners trying to bar entry.  A few women have taken to wearing bird-flu-style medical masks to keep their faces covered; some describe a climate of divisiveness, mistrust and fear.  One politician who backed the law said that women still going out in niqab were simply being “provocative”.

[Hind] Ahmas…was attacked in the street [by] a man and woman…[who] called her a whore and told her to go back to Afghanistan.  “My quality of life has seriously deteriorated since the ban.  In my head, I have to prepare for war every time I step outside, prepare to come up against people who want to put a bullet in my head.  The politicians claimed they were liberating us; what they’ve done is to exclude us from the social sphere.  Before this law, I never asked myself whether I’d be able to make it to a cafe or collect documents from a town hall.  One politician in favour of the ban said niqabs were ‘walking prisons’.  Well, that’s exactly where we’ve been stuck by this law.”  But despite all the fanfare surrounding the niqab ban, no woman has yet been punished under the law for wearing one.  The first real test will come on Thursday [September 22nd], when a local judge in Meaux, east of Paris, will decide whether to hand out to Ahmas and a friend the first ever fine.  [As this follow-up explains, they were fined €120 and €80 respectively and will immediately appeal to France’s supreme court]…Now, human rights lawyers are suggesting it could soon be overturned.

Only the French police can [legally] confront a woman in niqab.  They can’t remove her veil but must refer the case to a local judge, who can hand out a…fine, a citizenship course, or both.  Some police have wrongly given on-the-spot fines, which were later annulled.  Others appear to ignore women in niqab walking down the street, perhaps because they feel they have more important crimes to be stopping.  The interior ministry says that since the law came into force in April there have been 91 incidents of women in niqab being stopped by police outside Paris and nine incidents in the Paris region…The French justice ministry says “fewer than 10” cases are currently going through the courts and the lack of fines shows the state favours “dialogue” not punishment.  But Gilles Devers, a lawyer acting for Ahmas and several other women in niqab, argued punishments were not being handed out because the niqab law contravenes European human rights legislation on personal liberties and freedom of religion.  As soon as a fine is imposed, there will be an appeal right up to the European court of human rights in Strasbourg, which could rule against the law and expose the French state as a laughing stock.

If the French law is challenged in this way, the result would be crucial for Muslims across the continent.  Belgium introduced its own niqab ban this summer, punishable not just by a fine but seven days in prison.  In Italy, the far-right Northern League has resuscitated a 1975 law against face coverings to fine women in certain areas of the north.  Silvio Berlusconi’s party is now preparing an anti-niqab law.  Denmark is preparing legislation to limit the wearing of niqabs; politicians in Austria, the Netherlands and Switzerland are pushing for outright bans.  Thomas Hammarberg, the Council of Europe’s commissioner for human rights, blogged this summer:  “The way the dress of a small number of women has been portrayed as a key problem requiring urgent discussion and legislation is a sad capitulation to the prejudices of the xenophobes.”

…There are no reliable statistics on who wears the niqab in France and whether they have kept wearing it since the law.  It is estimated that only a few hundred women wear it, mostly French citizens.  Muslim associations say a minority of women have taken off the niqab or moved abroad…An Open Society Foundation report on women in niqabs in France…found that of a sample of 32 women in niqab, none had been forced to wear the full veil.  Many said they would refuse to take if off after the law came in, adding that they would avoid leaving home, or move abroad…

A few hundred women, yet they’ve managed to back the French government against the wall and may yet defeat its attempt to control them.  There are almost 450,000 of us; why can’t we do the same?  We need to expose the “enlightenment police” for what they are:  busybody control freaks who don’t give a damn about women’s dignity, but are happy to use it as an excuse for oppression.
