Yellow journalists assist cops to protect and serve crime victims:

A transgender woman was found dead [on July 19th] at an Orlando apartment complex…her body…had signs of trauma…Sasha Garden…was a sex worker…many in the community are worried after Garden’s death and the murders of three transgender woman in Jacksonville this year…[local activist] Montrese Williams says Orange County deputies came to her house around 7:30 a.m. for her help identifying Garden…”As soon as I opened the door, I get, ‘I hear a bunch of transvestites stay here.’ I had to let them know, I’m a transgender woman and I’m the only one that stays here”…Despite Montrese Williams telling deputies that Sasha Garden was a trans woman, in the official report they described her as a 27-year-old man from Jacksonville, who “was wearing a wig and was dressed as a female.”  Naturally…Orlando television stations followed suit with headlines that described her with phrases like a “man in a wig” (WESH) or a “man dressed as a woman” (WFTV)…

Profound Mental Disabilities (#512)

London [Ontario] police [claimed a 20-year-old woman called “C.S.”] was imprisoned by a human trafficker, and forced into selling sex…Amy Dykes…was charged in July 2015…But…Superior Court Justice Alissa Mitchell acquitted the accused woman on all charges.  Her ruling speaks to the [state’s desire to deny the power of]…consent…[to] disabled adults…[and the] danger…[of the] narrative about…rescuing sex workers…The Crown alleged that Dykes forced C.S. into prostitution and controlled her with threats and by taking her disability payments, cell phone and bank card…[cops discovered] C.S. [in an “Operation Northern Spotlight” sting and pretended]…that C.S…was not fully aware of her situation…But [another cop]…had taken a different view of C.S., when he’d met her a month earlier…Although C.S. seemed naive, she showed a level of independence by…using her own debit card in front of him, and spoke well of [Dykes]…Other testimony and evidence showed C.S. could look after herself, bought her children toys and clothes, maintained a bank account, paid her share of the rent, cooked, maintained a cell phone, and kept up with friends on Facebook and texts and in person.  C.S. has…[the] intelligence…of a child aged eight to 11, but is not a child in terms of life experience and accomplishments…“There is no evidence to support a finding that [C.S.] was incapable of providing her voluntary agreement to work as a prostitute…C.S. was adamant (with the [sting pigs]) that she had no interest in being rescued.  Their discussion was lengthy and…C.S. remained steadfast…[until the cops’ continuing pressure caused her to] fear…she might find herself in trouble with the law if she did not agree she was the victim,” Mitchell said…

[Propaganda] on modern slavery around the world [now claims] that the number of slaves in developed nations…is much higher than previously [pretended].  The Global Slavery Index is published annually by the Walk Free Foundation…In its new report, Walk Free Foundation is still using the 40.3 million figure, but says that [inflation of] its [fantasy] mean it [now pretends] country-level figures [are higher] than ever before:  it now [claims] that in the United States 403,000 people — or 1 in every 800 — are living in modern slavery, seven-times higher than it previously believed.  In the UK, it [claims] there are 136,000 slaves, almost 12-times higher than previous figures.  The numbers contrast with UK government’s [already-inflated] estimate that there were between 10,000 and 13,000 potential victims of modern slavery in the UK in 2013.  There is no equivalent government figure for the US…Walk Free Foundation [claims] the reason for the dramatic increases in its slavery estimates for some countries is that the latest report uses far more data sources than previously…

Under Michigan law, Stephen Nichols was supposed to get a “prompt” court hearing to challenge the forfeiture of his car, which police…[stole] in 2015 because he was driving it without valid insurance…Nichols still hasn’t had his day in court…[he] and two other plaintiffs filed a federal class-action lawsuit…[because] Wayne County police and prosecutors seize residents’ property and force them to wait months, sometimes years, for a hearing…the delays violate the 14th Amendment right to due process.  In addition, Wayne County prosecutors offer to settle cases out of court for $900, leaving owners to choose between getting their vehicle back quickly…or shelling out even more money for a lawyer and waiting months to get their means of transportation back…The two other named plaintiffs in the lawsuit, Adam and Ryan Chappell, are a father and son…the younger Chappell was borrowing his dad’s car one day in July 2016 when Wayne County sheriff’s deputies saw him pull into a medical marijuana dispensary in Detroit.  The cops pulled him over as he left and [stole] the car.  No [legal medical] marijuana was recovered from the car, and no criminal charges were filed in the case…Chappell’s car was one of hundreds [stolen] by the Wayne County Sheriff’s Office for visiting a [perfectly legal business]…

“Repatriation” is the fashionable euphemism for “deportation”:

Though the reporter clearly understands that these people are migrating of their own free will to make a better life for themselves, he still can’t resist the urge to demonize their religion and infantilize them by pretending they are passive objects to be “trafficked”.  Follow the links for previous examples of the same bigotry.

One Size Fits All

This is almost three years old, but it’s too good to pass up:

Many children in west Africa are brought up in households belonging to people other than their own parents.  There is a long tradition of fostering, yet in many cases the practice is now [claimed] to constitute “trafficking” or “modern slavery” because the children involved are put to work during their stay.  This makes little sense, yet the terminology of “human trafficking” and its consequences—namely that the “traffickers” involved should be prosecuted—has remained in vogue since at least 2000 with the support of European and American funding.  This has almost certainly caused more harm than good…ideas and methods imported from Europe and North America…have sought to prevent children from working away from home, rather than to protect children from harm regardless of where they live and whether they were at work or school.  This approach fails to adapt to the realities of childhood in west Africa and the practicalities of growing up in villages with little infrastructure…

Pyrrhic Victory

The Milwaukee Common Council voted not to renew the license of a…night club [using] sex trafficking [claims].  The vote came after…neighborhood [complaints that]…the owner of Tatou Ultra Pub…planned to renew the club’s license and then sell the business to VLive, a nationwide chain of strip clubs…aldermen were warned that the city attorney’s office could have trouble defending the city in court if aldermen failed to renew the license…residents [pretended] Tatou had contributed to loud noise and reckless driving in the area…[yet] there…were no recent police records documenting any nuisance activity at the club…

It looks like Chris Sevier, the anti-porn fanatic behind the “mandatory porn filter” bills now making the rounds of US state legislatures, is about to do a massive pratfall:

Elizabeth Smart sent a cease-and-desist letter to prevent her name from being used to push a Rhode Island bill that would require a $20 fee to view pornography online…It is one of several similar bills pushed by Chris Sevier, who says the bill would protect children…Sevier said he chose Smart’s name as a tagline for the bill…[until he was] told…Smart was potentially pursuing legal action, [after which he claimed] the…name had been given to the [bill] by lawmakers…his website…specifically refers to [it] as “the Elizabeth Smart law”…[fellow anti-porn fanatics Morality in Media] has slammed Sevier for falsely claiming the[y]…supported his work…Earlier this month, a federal judge in Utah threw out Sevier’s lawsuit trying to target same-sex marriage by saying he should be allowed to marry his laptop…

A deeper look at the sleazy lies politicians are using to destroy women’s jobs:

…The raids seem…connected to New Orleans Mayor Mitch Landrieu’s  new vision of Bourbon Street as a family-friendly tourist destination, a vain attempt to gentrify one of the country’s most legendary red light districts as it approaches its 300th anniversary.  This vision…has the mark of Christian moralizing that has recently taken on new potency.  In October, Mayor Landrieu hired conservative Christian lawyer Scott Bergthold, whose Chattanooga-based law firm has a reputation for targeting strip clubs across the country.  The mayor also appointed a few key people to put together a study on trafficking, including councilperson Kristin Palmer, a longtime opponent of strip clubs; and Jim Kelly of Covenant House, part of a chain of nonprofit, Catholic-affiliated homeless shelters…The Greater New Orleans Human Trafficking Task Force says in its official documents that it’s targeting trafficking, but…they use words like prostitution and trafficking interchangeably, and they don’t recognize a categorical difference…[though an attempt at capping the number of strip clubs failed 4-3 in the City Council] clubs…must operate under new regulations.  Dancers are no longer allowed to twerk (defined as a “simulation of sex” per the state lewd act law), fondle their own breasts, or have exposed nipples; these are now defined as “lewd and lascivious conduct.”  Club managers must…post anti-trafficking posters from…Club Operators Against Sex Trafficking (COAST).  COAST is in partnership with the Department of Homeland Security; the posters encourage workers to report abuse to a number which goes directly to ICE…if you’re an undocumented immigrant, there’s no guarantee  your rescue won’t also include deportation

Disaster

Even bootlicking Time seems to grasp that something bad has happened:

…The decision by Craigslist to stop hosting personal ads came as a preemptive move after Congress passed [FOSTA]…a sweeping piece of legislation intended to [harm sex workers]…The legislation targets websites that “promote or facilitate” prostitution, even in jurisdictions where prostitution is legal; individuals operating those sites face up to ten years in prison…The bill’s ambiguous terms threaten to impugn not only Craigslist, but any website or forum that accommodates discussion of the sex trade…these sites are crucial to [sex workers’] safety: they provide the community with a platform to share information about dangerous clientele (known as “bad date lists”) and other occupational hazards.  Advocates for these communities have also argued that eliminating the sex trade’s online presence will in fact make cases of actual human trafficking harder to identify…

The former lawyer of Deborah Jeane Palfrey…has filed a motion to allow the release of her escort services’ records, saying they “may contain information relevant to the upcoming presidential election.”  Palfrey [supposedly] committed suicide in 2008 following a racketeering conviction.  Montgomery Blair Sibley, whose legal strategies and motions often included antagonizing opposing counsel and judge…remains under several 2007 restraining orders, which prohibited him from releasing Palfrey’s records.  Sibley won’t say how the records could affect the election…

A case of stranger danger at Catalina High School has administrators taking action.  Two girls said they were approached by the same man near campus a few weeks ago, so a meeting to talk about safety…There have been no new incidents…But with no suspects and no arrests, the school doesn’t want to wait for a third…According to the girls, the man told them he was from Pima Community College and wanted to interview them…Council member Steve Kozachik is worried the man may have been up to something much more sinister.  “It might be…some guy putting the young girls in jeopardy as to being trafficked”…

Marc Randazza, the noted First Amendment lawyer, has written a paper which, I think, would be of interest to many of my readers, especially (but not limited to) those who are yourselves lawyers.  Skeptical?  Here’s the abstract in its entirety:

In the case of intellectual property rights (IPRs), some nations erect barriers to the protection of IPRs on the basis of “morality”.  This paper will examine the implications of morality-based impediments to the enforcement of IPRs and their supportability under international agreements.  There are significant freedom of expression issues to consider when we think about “morality” getting in the way of intellectual property rights.  If that description doesn’t make you run to download it, it manages to include an academic discussion of “Cumfiesta”, “Screw You”, “Nut Sack Ale”, and Japanese porn being stolen in Taiwan.  Beat that.

Buried in this huge mound of bullshit is its astonishingly stupid and imperialistic premise: the author believes the US government can and should criminalize sex work in other countries:

If this is real, it’s hilariously pathetic:

Another demonstration of how regulation of sex work hurts sex workers:

…There are…an estimated 20,000 prostitutes in Greece…of which fewer than 1,000 are…registered…There are brothels (or ‘studios’) where women can register to work legally…Each is granted a licence, issued by the state…There’s a list of…stipulations that must be met before a woman is allowed to work in one of these studios.  She must be over 18; have the right to live and work in Greece; be free from STI’s or other infectious illnesses; not suffer from mental illness or drug addiction; and not have been convicted of homicide, pimping, child porn, trafficking, robbery or blackmail.  Oh, and she must be unmarried, too…the law isn’t stopping married women from working as prostitutes.  It’s simply preventing them from operating in regulated environments and forcing them on to the streets, something which is both illegal and dangerous…

COAST isn’t mentioned here, but this is the same sort of insulting, patronizing bullshit they peddle, pretending that pigs, bureaucrats and other busybodies know more about our profession than we do:

The first few paragraphs of this story look like typical “gypsy whores” idiocy and police puffery, then it makes a sharp turn to the right:

Cracked appears to be positioning itself as solidly pro-sex worker; the latest is an article entitled “5 Things You Don’t Know About Strippers (Until You Are One)“, written with input from 7 actual strippers, which ends with this:

Since when do “scientists” treat patients?

Scientists have treated…the first patient with internet addiction disorder brought on by overuse of Google Glass.  The man had been using the technology for around 18 hours a day – removing it only to sleep and wash – and complained of feeling irritable and argumentative without [it]…he had also begun experiencing his dreams as if viewed through [its] small grey window.  The existence of internet addiction disorder…is hotly debated among psychiatrists.  It was not included as a clinical diagnosis in the 2013 update to the Diagnostic and Statistical Manual of Mental Disorders

The Missing Word

Worse Than I Thought

Kudos to Reason TV for doing a short documentary on how horrible California’s “anti-trafficking” CASE Act is, and for interviewing sex workers about how criminalization increases exploitation.  Unfortunately, they also interviewed the superlatively awful Dennis Hof, who as usual used the opportunity to spread lies about independent sex workers (in this case, that we’re diseased) in order to argue for imposition of the Nevada system which enriches and empowers people like him.  I’ve spoken to video producer Zach Weissmueller, though, and asked for his help in getting Reason more on board with (libertarian) decriminalization rather than (crony-capitalist) Nevada-style legalization. Proposition 35 ad

This academic’s massive blind spot about “sex trafficking” hysteria is fascinating; she walks all around that elephant in the room, yet can’t see it.  Furthermore, the details about how the “white slavery” panic fueled the growth of the FBI are interesting.

Imaginary Evils

Theresa May, the UK Home Secretary…[has launched] her attack on “modern day slavery”…a tiresome, over-emotive phrase which functions as political speak for human trafficking…[she] has made much of the need for increasingly harsh sentences for traffickers.  But, as highlighted by Anti-Slavery International, this focus is a red herring.  Its position is that the UK should improve its response to victims, primarily by taking a more robust approach against victim criminalization…

Furthermore, as Tim Worstall explains:

…a new report…shows…that while the problem is real it’s small.  United Kingdom Estimated number enslaved 4,200 – 4,600…But…who can forget Dennis MacShane telling the House of Commons that there are 25,000 slaves just in the sex industry [or]…Julie Bindel and…the Poppy Project insisting that there are vast tribes of women held as sex slaves…

Due Consideration (TW3 #341)

Finally, mainstream coverage of the vile mistreatment of Alicia Beltran:

…[at] 12 weeks pregnant, she [went] to a…clinic…for a…checkup…[she] admitted a past struggle with…Percocet…but [had been self-administering] Suboxone…to treat Percocet dependency…in decreasing doses…[with the] last dose a few days before her…visit…the physician’s assistant recommended she renew…use of Suboxone under a doctor’s supervision.  After Beltran declined…she was asked to take a drug test, which was negative for all…except Suboxone.  Two weeks later, a social worker visited Beltran…and told her that she needed to continue Suboxone treatment…Beltran…again declined.  Two days later, [cops dragged her to]…a…judge [who] ordered her to spend 90 days in a drug treatment center…

Yes, the state chained and caged her because she wouldn’t take drugs.

A powerful argument against draconian sentences:

Shift in the Wind (TW3 #342)

APNSW anti-sweatshop logoThe APNSW held a workshop last week, and several media outlets were on hand to interview sex workers and activists (including Melissa Ditmore and Cheryl Overs) about prohibitionist myths, the rescue industry and Equality Now’s attempt to negate the voices of thousands of sex workers. Regular readers won’t find anything surprising here, but it’s important to note the rising number of articles debunking “trafficking” mythology and publicizing both sex workers’ calls for decriminalization and the fact that several UN agencies support that policy.

Buried But Not Dead

More pearl-clutching about young pop-stars from a bunch of middle-aged ones who can’t compete with them any more, and “feminists” who never could.  It’s at least 2000 words too long and rife with inane buzzwords like “pornographic object”, “misogyny” and “sexualization”, but it’s mildly amusing in a train-wreck sort of way.

Berenger:  Yes, but for a man to turn into a rhinoceros is abnormal beyond question.

In Ionesco’s 1959 absurdist play Rhinoceros (filmed in 1973 with Zero Mostel, Gene Wilder and Karen Black), the inhabitants of the characters’ town begin turning into rhinoceroses.  Though the cause is not explained, there is a strong implication that the transformation is at least partially voluntary, because the more people change the more others join them.  At first the townspeople are outraged, but by the end of the play everyone has become a rhinoceros except for the protagonist, Berenger, who considers joining the rhinos but just can’t force himself to change.  The play is generally interpreted as a political allegory; no matter how ridiculous a mass movement is (Ionesco probably had fascism and communism in mind), nor how ugly and destructive it makes its adherents, it will often continue to grow in popularity until many who once opposed it now defend and may even join it.

The metaphor popped into my head on January 5th while reading the comments on Laura Agustín’s column of the previous day; one of the commenters stated that she knows a sex worker who accepts some of Melissa Farley’s monstrous lies, and I replied:

A lot of sex workers buy into the “trafficking” mythology as well; I’ve read many comments and emails from such women who look around for where the “anti-trafficking” fingers are pointing and fail to realize that the supposed “sex slaves” are them and their friends and associates.  It rather reminds me of Ionesco’s absurdist play Rhinoceros, in which the people who haven’t turned into rhinoceroses begin to perceive themselves as ugly outsiders.

It should be obvious that moral panics, like Ionesco’s “Rhinocerism”, are psychologically contagious; most people who are exposed to them are essentially brainwashed into accepting them, the victims of their own herd mentality.  And so insidious is their influence that even some people who should know better are drawn into them, making whatever rationalizations are necessary to resolve the cognitive dissonance caused by the conflict of their knowledge and their desire to go along with the crowd.  Thus many escorts, who intellectually know that the notion of prostitutes as coerced “sex slaves” is ridiculous, accept the “trafficking” hysteria by rationalizing that there is indeed an epidemic of “human trafficking” in other countries, or among streetwalkers, or in other places they conveniently never visit.  Some of them even accept the outrageous claims of numbers and ages, egotistically assuming that they are part of some supposed elite of “free” hookers despite the fact that every other whore they know is equally “free”.  Some even spin idiotic conspiracy theories in which there is a secret network of pimps who magically “get” girls and secretly control them without clients or other escorts being any the wiser.  Many clients, too, are caught up in the hysteria; they worry that girls they hire might be secretly “pimped”, and that patronizing them somehow contributes to that prohibitionist devil, “demand”.

There is only one way to fight this contagious fantasy, and that is by rejecting the entire “trafficking” paradigm.  In a September 2010 essay entitled “Willing Brides and Consenting Homosexuals” Cheryl Overs pointed out the danger of ceding any ground to the prohibitionists on this issue:

…I have noticed emergence of a new term “willing sex workers”.  The danger here is that this term signifies that even those who support decriminalisation of sex work are now accepting the trafficking paradigm by repositioning willing sex workers as a subset of this broader category “sex worker/victim of trafficking or sexual exploitation”…The implications of this slow but clear shift are enormous.  Health and human rights promoting programmes…can now be seen as applicable only to “willing sex workers” while  “unwilling” sex workers deemed to be trafficked or sexually exploited need raids, rehabilitation and anti-trafficking programmes.

Perhaps the most depressing thing about this is that sex workers themselves and other well-meaning folks are buying into the trafficking paradigm…I am not going to argue about how many people are forced into sex work, but even in that overstudied  “hotbed of sex trafficking” Cambodia, the only credible study [showed that] less than 2% of sex workers say they had been sold or coerced (CACHA 2008).  How might this compare to the percentage of married women who were forced into marriage – even in the “hotbeds” of forced marriage?  What percentage of gay men have been forced into sodomy?  We don’t know, but clearly both happen.  But it would be absurd to preface the words “bride” and “gay man” with “willing” or “consenting”.  Can you imagine reports that say that condoms should be distributed to “consenting homosexuals”?  Can you think of anything more absurd, more homophobic or more stigmatising?  Can you think of anything more absurd than describing Kate Middleton as a “willing bride”?  Positioning “willing” and “unwilling” doesn’t contribute to justice for people who have been raped, beaten [or] imprisoned in the course of either marriage [or] homosexuality and no one would suggest that.  Nor would anyone suggest that rejecting the terms “willing brides” and “consenting homosexuals” amounts to a denial that those things happen.  Yet this is exactly what the trafficking paradigm sets out for sex workers…

Perhaps the highest priority for the sex workers rights movement should be…to reject the entire paradigm of trafficking and sexual exploitation.  Only by doing this can we focus on convincing the public and policy makers that public health, human rights and social development outcomes for sex workers depend on justice for all…our slogan says it perfectly – “only rights can stop the wrongs.”

Those with long memories may recognize her point as essentially similar to the one I made in my New Year’s Day column for 2011:  “It isn’t necessary to have an adjective to describe every way in which a given person isn’t  unusual; we assume the usual unless something different is specified, not vice-versa.”  The vast majority of sex workers take their jobs as willingly as anyone takes any job, and it’s no more necessary to say “willing sex workers” than it is to say “willing doctors”, “willing teachers”, “willing cops”, “willing maids” or “willing cashiers”.  The trafficking paradigm is an ugly fantasy which flies in the face of both reality and human nature, and must therefore be rejected completely in order to avoid being swallowed up by it; anyone who claims that the unnaturalness of a man becoming a rhinoceros is “a matter of opinion” is well on his way to becoming one himself.
