Pyrrhic Victory (#1461) 

It’s much too late for this in the US, but it may inspire activists in less-fascist countries:

Facial recognition technology is unreliable, unjust, and a threat to basic rights and safety…which is why we [should have] act[ed] to stop it [years ago]…Like nuclear or biological weapons, facial recognition’s threat to human society and civil liberties far outweighs any potential benefits…Industry-friendly and government-friendly oversight will not fix the…inherent [dangers]…we need an all-out ban…Facial recognition is unlike any other form of surveillance…[because] it enables automated and ubiquitous monitoring of an entire population, and it is nearly impossible to avoid…

The Last Shall Be First (#1518) 

Oklahoma politicians want to foist liability for their unconstitutional laws onto local governments:

Oklahoma[‘s new bill]…H.B. 1217 d[oes] not explicitly mention drag performers.  But [its] supporters…such as…Dusty Deeversmade it clear that…”We’re basically banning drag shows in front of kids”…[censorious politician]s have taken to using the term “obscenity” colloquially to describe all sorts of sexual…content…they don’t like, particularly…homosexuality or gender bending…But the…average drag show does not rise to the level of [legal] obscenity…so…[politicians are] threatening to hold municipalities criminally [li]able for allowing “obscene” performances…[by demanding they]…make sure [any approved event] “will not be obscene.”  [But] whether a performance or art work is obscene is something to decided by juries after the material exists.  Government authorities can’t decide in advance of a performance or event that it might contain obscenity and therefore can’t happen…Technically, H.B. 1217 doesn’t require prior review or prior restraint.  It just [threatens] that a government body that allows a…[performance later deemed] obscene…can be prosecuted for it…

Sexcrime (#1519)

It’s been less than seven years since the UK lost in court the last time it tried this:

The UK government has o[nce again reintroduced]…the…porn ban [struck down in court in February 2019, excusing the attempt by barfing the magic formula “]violence against women[” and defaming people who enjoy this kind of porn as “]criminals[” regardless of consent.  Politician]…Alex Davies-Jones [spouted out threats against both individuals and]…firms [extending] even [to] prison sentences…[belching “]Ofcom can go after the platform]….and…[“]children[“], then…[unscientific nonsense about how what lay people “]believe[” about porn [trumps actual facts]…

Just laws are intended to correct wrongs, not to allow governments to persecute (“go after”) people who have not actually harmed anyone.

Walled Garden (#1573)

Psychopathic techlords are giving psychopathic politicians new excuses for surveillance and censorship:

The…CHAT Act of 2025 is Washington’s newest attempt to regulate speech through mandatory age checks…[in order to] normalize showing a government ID for basic online speech.  The CHAT Act [claims] to target fictional role-play bots [of the type that regularly drive fragile minds into psychosis, but]…defines a chatbot so broadly that anything that “simulates emotional interaction” could be restricted…[including] some video game characters…or…customer service bot[s.  Since nothing will stop tech companies’ insane crusade to cram their fake “AI” garbage into everything, the likely result would be the imposition]…of…ID verification…into nearly every digital product…

Pyrrhic Victory (#1586)

These things are designed to appeal to the dregs of humanity:

A number of Instagram accounts with hundreds of thousands of followers and millions of views…upload…videos filmed with [Facebook]’s Ray-Ban glasses [that] show men entering massage parlors across the country and soliciting the workers…In some cases, the women laugh at the men [or] dismiss them…but in a few cases they discuss specific se[rvices] and [prices]…the women [clearly don’t] know they are being filmed and that the videos are being shared online…This is extremely dangerous [because] the women…can be targeted by both [violent rapists who work for the state] and [those who don’t.  Facebook]…has built an entire supply chain for dangerous, privacy violating content on the internet.  It sells glasses that allow people to surreptitiously film others in public and operates a social network where inflammatory, outrageous content is rewarded and monetized, and [nothing is done about it until]…journalists reach out for comment…the company [hides behind the fact that]…“our glasses [show] an LED light [when]…recording”…[ignoring the fact that] people can pay $60 for a modification to…disable that…SWAN…[reports these] disgusting and dangerous…videos, and…use[s its] Abuser Alert system to notify workers…

Regardless of how much partisan “journalists” bray that “sex trafficking” hysteria is a “right-wing conspiracy theory”; they themselves did at least half of the work to turn it into a moral panic, from its introduction in the New York Times in January ’04 until it was finally taken over by QAnon in 2018-19. For a while there was a tug-o-war between Trumpists & Anti-Trumpists for control of the narrative, and when MAGA won the soi-disant “progressivessuddenly pivoted to debunking it.  These people absolutely do not care about sex workers or anyone else their shamelessly-puritanical rhetoric harmed for two decades; they just suffer from a pathological need to be “correct”, and when it became obvious they were losing control of their own propaganda narrative, they turned to “sour grapes”.

A Broker in Pillage (#1276)

South Carolina is one of the most flagrant abusers of this unconstitutional practice:

In Spartanburg County, South Carolina, on Interstate 85, [cop]s stop vehicles for…any infraction, no matter how minor…lead[ing] to a roadside interrogation and warrantless search…the [sophomorically-entitled “Operation Rolling Thunder” has been committed] every year since 2006, yet no one has ever done a systematic audit…It took a lawsuit to finally pry the records loose…Over 72 percent of vehicle searches during [the scheme] in 2022 produced nothing illegal.  Officers routinely treated innocent drivers like criminals…[and] currency as contraband.  The records describe no single case in which officers found a large amount of cash and did not seize it…[they] pressured property owners to sign roadside abandonment forms, giving up claims to their cash on the spot…Officers focused on vehicles with out-of-state plates, rental cars, and commercial buses.  Over 83 percent of the [victims]…lived out of state…and 75 percent…were black…[the armed-robber cops] do not create incident reports for every search.  They only document their “wins”…[so there are] no records for 102 of the 144 searches that occurred during [the scheme] in 2022…This leaves government watchdogs in the dark—by design.  They cannot inspect public records that do not exist.  Victims cannot cite them in litigation…

Don’t Call It Trafficking (#1387)

The entire “troubled teen” industry needs to be sued out of existence:

There is a highly lucrative, multibillion-dollar market of residential “behaviour modification programmes”…in the US, where an estimated 50,000 children [and teenagers] are [sent] by their parents…against their will every year.  All operate in closely guarded secrecy.  There are more than a hundred in Utah alone, but some are based offshore in remote, low-regulation, low-cost foreign locations such as Samoa, Costa Rica, Mexico and Caribbean islands…[they are condemned to these camps] for bunking off school, wearing inappropriate clothes, swearing, [or using] cigarettes or alcohol…a sizeable number [are]…adopted by parents who had then changed their minds…many [we]re had been diagnosed [by quacks] with oppositional defiant disorder, whose symptoms…[are] indistinguishable from typical adolescent behaviour…boys aged 14-18 confined in [Atlantis Leadership Academy, or ALA, raided by Jamaican officials in February]…had been starved, waterboarded and brutally beaten with broom handles, rakes, belts and metal water bottles…sleep-deprived and relentlessly insulted…bleach and salt [were] rubbed in their wounds; others…were [brutally assaulted,] threatened with knives and kept in solitary confinement for months on end…

Panopticon (#1429)

“Prostitution” is such a handy excuse for surveillance:

Moral panic about sex work leads to law enforcement practices that reach far beyond anyone engaged in or with erotic labor.  The latest example comes from San Diego…where cops are putting up a creepy surveillance tower under the auspice of stopping…prostitution…[by] record[ing] video of anyone who happens to be in the area…even if you think that punishing prostitution customers (or sex workers themselves) is a swell idea, it’s hard to see how the surveillance tower makes any sense…the tower is very visible and local media have been publicizing it.  Smart sex workers and their customers will simply move to another, less visible area…It seems clear that th[is]…is…just a way for authorities to look like they’re doing something about sex trafficking while further normalizing the idea of conducting broad, warrantless surveillance of everyone…

Phrenology for tech worshipers:

Michal Kosinski…has made…plausible[-sounding] claims that machine-learning algorithms…can discern deeply private things about us — our intelligence, our sexual preferences, our political beliefs — using little more than…photographs of our faces…Science has been trying to divine truths about personality and behavior from various tests and images for centuries…Phrenologists used calipers to measure bumps on people’s heads, hoping to diagnose mental incapacities or moral deficiencies…none of these “sciences” worked…[and] every time someone claimed they’d found a way to measure people’s inner traits based on their exterior features, it quickly turned into a tool to discriminate…Yet today…facial recognition continue[s] to be…abused…in everything from marketing and job hiring to college admissions and law enforcement…

Opting Out (#1438)

Politicians refuse to recognize that prohibition of speech, ie censorship, is as doomed to failure as other kinds of prohibition:

All-Purpose Excuse (#990)

It’s rare these days for a US court to uphold the Constitution against the government:

The Fourth Amendment still applies at the border, despite the feds’ insistence that it doesn’t.  For years, courts have ruled that the government has the right to conduct routine, warrantless searches for contraband at the border…CBP…has [wrongfully interpreted] that…to force travelers to hand over data from their phones and laptops.  But…Judge Nina Morrison…ruled that cellphone searches are…more akin to a strip search than scanning a suitcase…Therefore, the court ruled, a cellphone search at the border requires both probable cause and a warrant.  Morrison did not distinguish between scanning a phone’s contents with…software and manually flipping through it…

Thought Control (#1325)

I was destined to be threatened with state violence regardless of career path:

[A busybody pig] spent months methodically [rooting]…through [books Christian fundamentalists dislike] and highlight[ing] key passages amid reams and reams of paper.  He wore his body camera to record his interactions with [people whose lives he wanted to ruin] and…photographed…books [the lunatic fringe deemed “pornography”, including]…The Bluest Eye by Toni Morrison…an 824-page investigative file obtained by NBC News…shows how, for two years, [self-appointed censor Scott] London vigorously pursued felony charges against librarians in…Granbury [Texas]…London secured subpoenas, filed public records requests, received names of students who’d checked out certain books and, after a year, wrote draft criminal complaints…The [rooting and harassment finally] came to an end in June after Hood County District Attorney Ryan Sinclair turned down London’s request to indict the librarians, citing a [total] lack of…evidence [sufficient] to charge them with felonies…

Creepy Coppers (#1414)

Some cops don’t limit themselves to one type of creepiness:

The problem isn’t Catholicism, Christianity or even religion; it’s teaching kids to blindly submit to authority:

Omaha’s Archbishop is among the clergy members named in a lawsuit filed against the Archdiocese of St. Louis…by 27 anonymous plaintiffs.  It accuses the defendants of often transferring the perpetrators to different locations within the Archdiocese or Catholic Church or sending them away for treatment before returning them to unsupervised access to children…One of the plaintiffs, a former altar boy, alleged Omaha Archbishop George Lucas sexually assaulted [him] when [he was] a junior in high school at the Saint Louis Preparatory Seminary…[where] Lucas was…Dean of Education at the…time. “The church is not a democracy, so that gives a seminary head…extraordinary power over very vulnerable and devout teenagers,” [sexual abuse activist David] Clohessy said…

Censor Chic (#1438)

Judge rules that a spade is actually a spade:

…a prominent “disinformation expert” once hired to head a government board to [censor speech the government declared] untruths but unceremoniously dumped from the position when the board was dissolved amidst public outcry…sue[d Fox News] for defamation [because it correctly described her function as]…censorship…Nina Jankowicz[‘s]…”Disinformation Governance Board was formed precisely to examine citizens’ speech and, in coordination with the private sector, identify ‘misinformation,’ ‘disinformation,” and ‘malinformation’…That objective is…a form of censorship”…concluded [U.S. District Judge Colm F. Connolly, who]…dismissed Jankowicz’s claim “in its entirety”…

To Molest and Rape (ROTW #12)

Give sexually-aggressive thugs power over kids; what could possibly go wrong?

A [typical and representative Florida cop paid to spy on, harass, and intimidate students has been]…found…guilty of child sex abuse…Joshua Robert Herren…was arrested Nov. 28, after a victim [reported that]…Herren [had seduced and repeatedly molested her] from the time she was 15…[but] had [already been stalking her]…prior to her turning 15…Herren…want[ed] her to dress up as a young girl and…call him “Daddy”…[after she] blocked his phone number and…social media accounts…he began [send]ing [her threatening] letters…He…is set to be sentenced on Aug. 26…[and] faces up to life in prison…

A [typical and representative English cop was given a slap on the wrist] for repeatedly attacking his ex-girlfriend, including punching her and throwing her across a room…Paul Whitehurst…also [abused] two other women [in the past], but…was not charged…[and this time he was given a mere 9 weeks] in prison….[and] released the same day, because of the time he had already served…Whitehurst [also threatened to rape the woman and repeatedly]…tried to “gaslight” her…She…said she was selling her house and car as she did not feel safe there any more and did not want Whitehurst to know where she lived[, but luckily she has learned her lesson about trusting cops]…

Buried Truth

I think we have enough evidence to start calling this “McNeill’s Law”:

Believers in the…QAnon [outgrowth of the popular “sex trafficking” moral panic] are always on the hunt for the powerful pedophiles they imagine run the world…but…court records reveal that QAnon leader Phil Godlewski has a criminal past of his own involving an inappropriate relationship with a minor that [apparently] turned sexual.  Thanks to an ill-conceived defamation lawsuit against a local newspaper, Godlewski has put his conspiracy-theory career at risk by inadvertently prompting the release of more details regarding his case, including lurid text messages and a video of his erect penis.  Perhaps worse…Godlewski has [apparently] been caught both committing perjury himself and attempting to convince his own victim to do the same to ensure a “financial windfall” for them both…

Innocence Never Had

Most states are trying to distance themselves from the most wackadoodle aspects of “sex trafficking”” mythology, but Florida prefers to take the facts about one of the few situations in which young girls really are in increased danger of sexual exploitation – the foster care system – and view it through the bizarrely-distorted lens of a dying moral panic.  If you’ve got a little time, read these concise comments I made about the topic a few years ago, and then try this outlandish fantasy of “neighborhood sex traffickers” “prowling the area” to abduct unwary 12-year-olds by the thousands without anyone at all noticing.  Though I hesitate to ascribe to malice that which can be explained by incompetence, this reads like an attempt to exploit the plight of young people dramatically failed by the government into a narrative that can be used to advance a specific political agenda for that same government.

All-Purpose Excuse

Anything can be “trafficking” if you use your imagination:

…The U.K…[is] using its Modern Slavery Act to target anyone who employs a minor in the drug trade…[Glodi] Wabelua was the first drug dealer to be prosecuted under the U.K.’s Modern Slavery Act, but not the last…most of the defendants in drug-related [“modern] slavery[“] cases were Black men under 21.  Many, if not all, were only one rung removed from the streets themselves”…Laws targeting prostitution and low-level drug crimes may seem overly punitive to you and me, but for many authoritarians these punishments don’t go far enough.  By ratcheting up the charges to human trafficking or modern slavery, officials can subject sex workers and drug dealers to much longer periods of incarceration, larger fines, and more stringent restrictions on movement, employment, free association, free speech, and privacy…

To Molest and Rape

To cops, the most important factor is whether a rapist crony was wearing his magical clown costume at the time:

[A typical and representative] New York [cop named]…Kristofor O’Rourke [has finally been arrested for a sexual assault he committed]…on July 1…he…[accused] a woman [of]…driving while intoxicated and then…oral[ly raped her after]…threatening to take her to jail if she didn’t comply…[after the victim registered her] complaint…O’Rourke was immediately [rewarded with a paid vacation]…

Panopticon (#1203)

It’s only one step from “all commercial vehicles” to “all vehicles”:

The Department of Transportation is considering a disturbing new rule that could force every commercial motor vehicle to install an electronic device that would wirelessly transmit location data and other personal information to police on demand…[DoT] offers no reason to believe the warrantless collection of identifying information will make anyone safer.  It might make some inspectors’ jobs easier, but that is no reason to override the rights of truck owners and operators.  One might as well call for putting us all in ankle monitors, just because it might reduce crime if the cops know where everyone is all the time.  The Fourth Amendment requires the government to get a warrant before encroaching into private space to gather information…The Supreme Court has ruled that police must get a warrant—regardless of whether the subject of a search has a reasonable expectation of privacy—before they physically install a tracking device.  The rule is no different just because the government forces people to purchase and install the tracking device on their own property…

Opting Out (#1261) 

The UK’s decade-long campaign to censor the internet continues to be a comedy of errors:

Britain will not force tech giants to remove content that is “legal but harmful” from their platforms after campaigners [convinced a few influential politicians]…that the move could curtail free speech…Online safety laws would instead focus on the [nebulous goal of] protection of children and on ensuring companies removed content that was illegal or prohibited in their terms of service…[but spokesbureaucrats] would not specify what legal content should be censored…

“Law enforcement worker” is a new low in trying to hide the fact that a violent criminal is a cop:

A Virginia [cop drove to California]…murdered the mother and grandparents of a teenage girl he catfished online, [then tried to burn down their house] before trying to [abduct]…the teen…[neighbors] called…the…[cops when they witn]essed…the [abduction and saw the]…fire…The Riverside Fire Department …discovered [the] three [murder] victims…[while] the [violently-deranged cop,] Austin Lee Edwards…[fled] through San Bernardino County…before being fatally shot by…[sheriff’s] deput[ies.  Luckily the girl was unharmed]…The slain family members were identified as 69-year-old Mark Winek, his wife 65-year-old Sharie Winek, and their daughter, 38-year-old Brooke Winek…

A strange new bill introduced by Oklahoma [politician] Rob Standridge would make it illegal to knowingly give “obscene material” to a “vulnerable person,” explicitly including unhoused people…SB 1522 [also includes] an unconstitutional redefinition of…“obscene material” as “any description, exhibition, presentation or representation, in whatever form, of nudity, sexual conduct, sexual excitement or sadomasochistic abuse”…Such supposedly obscene materials would include “book, magazine, newspaper, pamphlet, poster, print, picture, figure, image, description, motion picture film, record, recording tape, CD-ROM disk, magnetic disk memory [sic], magnetic tape memory, videotape, computer software, video game,” and other unspecified media to be determined by the authorities.  Despite his seeming concern for the moral hygiene of the unhoused, Standridge recently opposed a new homeless shelter, making statements conflating Oklahoma’s unhoused population with “sex offenders” and calling them “a public safety risk”…

Repeatedly claiming that prohibition in Canada is “right wing” when Trudeau and his party eagerly promote it is tantamount to pissing on the readers’ legs and telling them it’s raining.

The government needs to be buried in lawsuits before this will stop:

There are two other lawsuits pending against Wilkey for similar assaults on other motorists.
