Chris Sevier, the pro-censorship crackpot who wrote this bill and has shopped it to almost half of US states, appears to be keeping a low profile since Elizabeth Smart threatened to sue him for slapping her name on previous versions without her permission.  Or maybe it’s because a federal judge in Utah threw out his lawsuit trying to target same-sex marriage by saying he should be allowed to marry his laptop.  Or perhaps it’s due to the warrant for his arrest in Tennessee?

You Were Warned (#1107)

The bipartisan war on the internet continues without even a pause:

For the past few months we’ve been seeing a ton of terrible/ ridiculous/awful/unconstitutional bills coming from mostly Republicans to try to wipe out or undermine Section 230.  Most of those were focused on trying to force websites to do less content moderation.  Now that the Democrats are back in power, it appears we’re going to be getting the opposite.  Senator Mark Warner has introduced…the SAFE TECH Act (“Safeguarding Against Fraud, Exploitation, Threats, Extremism, and Consumer Harms Act” co-sponsored by Senators Mazie Hirono and Amy Klobuchar), and it is one of the worst Section 230 bills I’ve seen.  It is difficult to explain just how bad this bill is concisely, because it has so many bad ideas crammed into one single bill.  It’s as if none of these three Senators or their staff spoke to anyone who actually understands how the internet works, or how content moderation/trust and safety works.  It’s stunning in the ignorance it displays…Basically, this bill takes nearly every single idea that people who want there to be less speech online have had, and dumped it all into one bill.  There’s a lot in there, and nearly all of it is bad…This bill…does not come from a well meaning place.  The drafters…are either malicious or ignorant…

So Close and Yet So Far

Yes, sex workers are more likely to experience violence and coercion under Swedish criminalization than under most legalization regimes, including the British model which was used in Northern Ireland until the Swedish model was imposed there.  However, these sex workers are still adults and still capable of adult decision-making; they are not “children”, “victims”, “slaves” or whatever other fashionable dysphemim one cares to apply to them without their consent.  So if you’re a reporter who thinks you’re “helping” sex workers by calling attention to this increased violence, yet insist on calling their work “modern slavery”, I suggest you find something different to write about.

Remember, this isn’t “human trafficking”, but consensual sex is:

Lawyers appointed by a federal judge to identify migrant families who were separated by the Trump administration say they have yet to track down the parents of 545 children, and that approximately two-thirds of those parents were deported to Central America without their children…Unlike the 2,800 families separated under [Trump’s] zero tolerance [policy] in 2018, most of whom remained in c[ages] when zero tolerance was ended…many of the more than 1,000 parents separated from their children under the [2017] pilot program had already been deported before a federal judge in California ordered they be found…

The Implosion Begins

The schadenfreude is so sweet, it almost hurts my teeth:

The Arizona…Republic‘s scribes outdid themselves recently in a piece comparing [“Cuckoo Clock” McCain]’s many years of peddling the moral panic of sex trafficking, to the…[fantasy] known as QAnon, which posits that a worldwide ring of Democratic elites sells minors for sex while feasting on the flesh of infants and undermining the presidency of Donald J. Trump.  Due to the rise of QAnon…anti-trafficking [profiteers] worry…there will be less [money to] support…the [rescue industry]…In other words, it’s a turf war, with all these unwashed newbies attempting to usurp the anti-trafficking throne currently inhabited by the widow of the late warmonger, Senator John McCain…the McCain Institute issued a statement condemning QAnon, while Cindy McCain took QAnon to task on Twitter for its “lies”…Talk about projection.  Aided and abetted, time and again, by mainstream news outlets, Cindy McCain has spread dangerous misinformation and myths about sex trafficking, citing debunked statistics, prevaricating about her own experiences, and falling back on racist tropes — all in a narcissistic bid to maintain her media profile…

Turning the police state’s own weapons against it:

…[because cops sent to suppress protests] are…tap[ing] over their name[s]…individuals…are…researching how to build a facial recognition product that could defeat [cop]s’ attempts to [hide] their identity…The authorities targeted so far have not been pleased.  The New York Times reported in July 2019 that Colin Cheung, a protester in Hong Kong, had developed a tool to identify [cops] using online photos of them.  After he posted a video about the project on Facebook, he was arrested…This month, the artist Paolo Cirio published photos of 4,000 faces of French [cops] online for an exhibit called “Capture,” which he described as the first step in developing a facial recognition app.  He…[was forced to take] the photos down after France’s interior minister threatened legal action but said he hoped to republish them…Last month, Andrew Maximov…uploaded a video to YouTube that demonstrated how facial recognition technology could be used to digitally strip away [cops’] masks….[but] it’s unclear if the matches are accurate…

I’m skeptical this will work if the cops wear balaclavas, as they so often do.

A leading [Irish] sex workers rights group was told it could not access government funding unless it [pretend]ed that “prostitution is inherently exploitative of vulnerable people”.  Sex Workers Alliance Ireland enquired about emergency funding from the Department of Justice after it gave similar funding to the leading “End Demand” advocate organisation in Ireland…The group says “this culturally entrenched position” from the government has “no place in decision-making within the DoJ in regards to policy-making”…A spokesman for the Department of Justice…[responded by vomiting out a lot of nonsense about] “organised crime involved in human trafficking”…

Monsters

It’s good to see the real monsters caged for a change:

A court in El Salvador has sentenced three [typical & representative cops] to 20-year prison sentences for the murder of a transgender woman, the nation’s first convictions in a homicide case involving a trans victim…About 600 LGBT+ people have been murdered in El Salvador since 1993…[Camila] Diaz, a 29-year-old sex worker, had fled El Salvador for the United States following repeated threats on her life from a gang but was deported two years ago [due to racist, anti-sex US laws and violent Trump administration policies.  Then in January 2019]…the three [murder]ers…offered to give Diaz a ride home a[s a pretext to murder her.  They]…handcuffed [her] face-down in their p[igmobile, then]…severely beat…[her] and thr[ew her] out onto a highway…she…died three days later in a hospital…

Business As Usual (#767) 

It’s good to see this getting public attention again:

…Police sexual violence is hidden in plain sight…sexual violence…is endemic to law enforcement, and…women of color..,are especially vulnerable to it.  This violence is possible in part because of the extreme power disparity that exists between targeted women and police, which at once enables such violence and shields officers from consequences.  But police sexual violence is also possible because it is a legally sanctioned tactic of everyday policing.  Women’s bodies are the strategic terrain on which police gain evidence, secure informants, and impose their authority in the name of “public safety” and “border security.”  Indeed, rape is considered a legal and legitimate tool of law enforcement…undercover police routinely entrap women into engaging in sexual acts to gain “evidence” that they are doing sex work.  Because consent is obtained under false pretenses, this practice amounts to legal sexual assault…Sexual “contact” by police officers to enforce morals laws is legal in all fifty states; when lawmakers in Alaska tried to ban police sexual contact, the Anchorage Police Department quashed the bill.  How did we get to the point where sexual assault is considered valid, necessary police work?  The answer lies in the origin story of modern police, and specifically in the history of the discretionary enforcement of public order laws…

When it comes to mass surveillance, fascism beats communism hands down:

…Anomaly Six LLC…founded by two U.S. military veterans with a background in intelligence, said in marketing material it is able to draw location data from more than 500 mobile applications, in part through its own software development kit, or SDK, that is embedded directly in some of the apps.  An SDK allows the company to obtain the phone’s location if consumers have allowed the app containing the software to access the phone’s GPS coordinates.  App publishers often allow third-party companies, for a fee, to insert SDKs into their apps.  The SDK maker then sells the consumer data harvested from the app, and the app publisher gets a chunk of revenue.  But consumers have no way to know whether SDKs are embedded in apps; most privacy policies don’t disclose that information…Anomaly Six is a federal contractor that provides global-location-data products to branches of the U.S. government and private-sector clients…

COVID-19 is almost as versatile an excuse for tyranny as “sex trafficking” is:

Even if the lawyer is telling the truth, Nygard foolishly opened himself up to it by skeevy behavior.

In November, Portugal will celebrate the 20th anniversary of…[drug] decriminali[zation]…Portugal made possession of small amounts of narcotics an administrative rather than a criminal offence, like the small fine one might receive for failing to put on a seat belt…Those caught with less than 10 doses of any drug…are seen by a psychologist, a social worker and a lawyer, and advised about treatment, harm reduction and support services…“We had freedom to do anything within the United Nations statutes on drugs, which means do anything except legalising drugs,” [Portugal’s drugs tsar Dr. João] Goulão says.  “In the end, we went as far as we could”…The results have dispelled the doubts of the doomsayers, who claimed that Portugal would turn into a “paradise for drug tourists” and give the young easy access to narcotics.  Between 1995 and 2019, the estimated number of addicts fell from 100,000 to 50,000, of whom 30,000 are receiving treatment…

Anyone who doubts that politicians are deranged megalomaniacs should be following this:

U.S. officials have been insisting to tech platforms that…encryption is a threat to public safety and that “back doors” must be provided for [pigs and spooks] to bypass security, all in the name of fighting crime.  Meanwhile, U.S. officials have also been claiming that China-based tech company Huawei can use secret security bypasses that are intended for [American pigs and spooks to] use…in order to access data…[for] Chinese [pigs and spooks]…The same U.S. government that wants tech companies and telecoms to create secret software doors that would allow it to snoop on our private communications and data is also worried that other governments will be able to use those same back doors to do the same thing…Any back door that allows [pigs and spooks] to circumvent user privacy protections will ultimately be used by [other governments] with [equally] bad intentions…U.S. officials are insistent that Huawei has maintained secret access to these taps since at least 2009…
