Barbie

While whitebread feminists wet themselves over the newest version of “Happy To Be Me”, Virginia Postrel isn’t having any of it:

Hence the widespread praise for Lammily, the latest anti-Barbie concept doll. A Narrow View

This NPR article on diversion programs is full of the usual “sex trafficking” nonsense and dishonest platitudes about the programs’ effectiveness, but one section was especially troubling:

…Judge Pratt says that initially her treatment-focused approach…improved the ability to prosecute the traffickers. But…a lot of the boys…were becoming pimps. “The foster care system and juvenile justice system is creating both sides of this market, the suppliers and the goods,” she says…

Her revolting dehumanization of girls as “goods” is bad enough, but her willful mischaracterization of young male sex workers as “pimps” in order to prop up the vile “pimps and hos” myth is utterly reprehensible.

To Protect and Serve (August Updates)

San Diego cops use “sex trafficking” as an excuse to send a SWAT team to a strip club:

A manager at Cheetahs strip club says his dancers felt violated by police who photographed them almost nude…10 officers swarmed the building with guns and bulletproof vests, interrupting business for a couple of hours…to make sure all 30 dancers had proper permits and were in compliance…

Don’t Take My Word For It

Male delusions about sex work start extra-early in Sweden: “Swedish police have received a report that three underage boys [as young as ten] speaking bad German tried to sell sex to women at a busy commuter hub in central Sweden…”

Not for Everybody

Though Meg Munoz had a very bad time as a sex worker and for a while supported prohibition, she eventually recognized the harm it creates:

…Poorly conducted, [biased]…research needs to stop being used as the foundation for fundraising…the refusal to have sex work acknowledged as real work…has all but halted any civil discourse…Allowing moral biases to dictate policy is dangerous for those who are there by choice and force…

Above the Law

No, you lying asshole, it’s exactly what police officers do, which is why this is the second most common subtitle on the blog:

…while police responded to [a] domestic violence call, one of the officers allegedly took the woman into an upstairs bedroom and sexually assaulted her…Deon Nunlee has been charged…Detroit Police Chief James Craig said…“This is an anomaly. This is not what our police officers do”…

In fact, here’s another in the same city:

A former Detroit police officer who was convicted of criminal sexual conduct involving participants in his boot camp for misbehaving teens is being sued by two of the victims…Geoffrey Townsend…began making unwelcome sexual advances [eventually culminating in rape when one]…victim was 13 years old…and…the…[other] 16…

And it’s not limited to the US, either:

[Durham, Ontario police Constable Scott Andrew Terry] sexually exploited [a 16-year-old girl] …with whom he first came into contact after she was busted for shoplifting in May of 2000. Instead of filing charges…he…[offered] her a rental room in his house…[then] began making advances which…escalated to nude photos, sexual touching and eventually rape…“in exchange for the rent”…

First They Came for the Hookers…

This dumb story about dumb strip-club restrictions in Chicago is, as you might expect, mostly just dumb. But these comments from anti-whore zealot Bob Fioretti venture into a higher realm of dumbness: “we have an underlying social problem. Between 15,000 and 25,000 women a day engage in prostitution…in this city. That underground activity undermines us a city — a world-class city…” I’ll bet you didn’t know we were so dangerous, or that roughly 4% of the adult female population of Chicago were whores.

Higher Education (TW3 #23)

Unlike the last time we saw this, these teachers are actually qualified:

An enterprising association of sex workers in Barcelona has angered some of Spain’s most prominent feminists by offering an “intro to prostitution” course…at a cost of €45…the four-hour intensive course for aspiring sex workers was held last month by the Asociación de Profesionales del Sexo…Lidia Falcón…[who] has spent years fighting to have prostitution [criminalized] in Spain…said…the problem with the course lies in its underlying suggestion that some women are working in the profession out of their own free will…

So Falcón wants the course banned because it blatantly disproves her lies.

Imagination Pinned Down

Though the social climate which led to the Satanic Panic had been building for years, it was the McMartin Preschool hysteria that really launched it. Now that it’s a generation in the past, even media outlets like the New York Times which fully embrace “sex trafficking” hysteria recognize its earlier incarnation for what it was. Here’s a good retrospective called “McMartin Preschool: Anatomy of a Panic”; watch it with the current hysteria in mind and note the many parallels.

The Widening Gyre

If “authorities” don’t want stupid myths about women being abducted spreading around, they sure have a strange way of showing it:

[A rumor] warns of attempts to abduct women and girls in broad daylight at crowded shopping centers. It warns that a new gang initiation requires members to kidnap, rape and beat women and then dump them in parking lots. For years, authorities have tried to keep such messages from spreading, debunking their claims as urban myths…

To clarify: Women being abducted by gangs for quick rape = “right up there with Bigfoot”, but women abducted by gangs for years of captivity and sexual slavery = 100% credible.

South of the Border

In Mexico, a respected advocate is arrested as a “pimp” for helping sex workers organize:

…the recent arrest of Alejandra Gil…[is due to] new legislation, which…conflates sex work with human trafficking…Gil has worked tirelessly for the human rights of sex workers for many years…Laws and policies that target “third parties” under the premise of “protecting” sex workers, increase our vulnerability to abuse and exploitation, and create real barriers for sex workers organising…

Bottleneck

Considering that more than 90% of whores prefer to work illegally than submit to licensing, how well do you think this colossally stupid Italian law will work?

…prostitution will be permitted in private houses, subject to certain conditions, including the use of condoms…the draft law, which was presented…by…Maria Spillabotte…includes the issuance of a licence, stating that the holder is free of sexually transmitted diseases and confirming that a payment has been made…of €6,000 for a full-time licence or half that amount for part-time work…Prostitutes will also be required to get a certificate of mental fitness. “This is a fundamental way of getting women away from coercion,” says Spillabotte. “During an interview, the specialist will be able to tell if the girl is being forced into prostitution or if it is her free choice”…

It Looks Good On Paper (TW3 #311)

Texas joins the states arresting people to force them into “diversion” programs: “The Corpus Christi Police…conducted a ‘Jane Sting’…in conjunction with the Red Cord Diversion Program…all six arrested persons were signed up to participate…rather than have criminal charges immediately applied.” Yes, they actually referred to sex workers as “janes”.

The Crumbling Dam (TW3 #315)

Joyce Arthur hits it out of the park with this satire:

In a bold move aimed at protecting workers from exploitation while on the job, the government today passed a new law that criminalizes most employers and customers…Law and Order Minister Punter MacCunny…pointed out that 95 per cent of people hate their jobs and want out, according to a new government-commissioned study…Police welcomed the new law, which gives them sweeping new enforcement powers to target the huge increase in organized crime. According to Det. Sgt. Billy Clubber, head of the RCMP’s new Slave Save Squad, “We’ll be cracking down on slavery rings, basically any place where workers are bribed with wages to provide services”…The law now designates employers and customers as “pimps” and “johns,” respectively…

Saith Dr. Brooke Magnanti in The Telegraph:

It’s an unusual move to go from policy and social commentary to fiction, especially as the stories cover a range of genres from romance to crime to sci-fi. And yet it works. The eye for detail that fans of Maggie’s non-fiction writing appreciate is well played here. She invents worlds with ease and populates them with thought-provoking, yet never two-dimensional, women and men. If you love plots with twists, she has them to spare. (If you’re not into twists, or women who aren’t always whiter than white, probably best to stay away.) And the cover art by acclaimed cartoonist and Louis Riel author Chester Brown is wonderful.

Sex columnist Suzi Godson presents “10 Things You Need to Know Before You Support the Swedish Model of Sex Work” in response to the new push by UK prohibitionists. It’s not anything new for readers of this blog, but it’s possible ammo for online discussions you may get involved in.

Traffic Jam (TW3 #410)

Dominique Roe-Sepowitz answers the many criticisms of Project ROSE by denying them to Christian Post after refusing interviews with mainstream reporters. And if you imagine the denials are substantive or backed by facts, think again: her entire rationale for cooperating with cops to railroad people and deny them lawyers is, “sex-work…is against the law.” Meanwhile, in last week’s other installment of “Traffic Jam”, a demonstration of the motivation behind the fakery:

A study of advertising placed during the recent Super Bowl in New Jersey suggests the volume of sex trafficking that will occur when the event comes to Arizona in 2015 will likely exceed the ability of any one law enforcement agency to address. Phoenix Police Lt. James Gallagher, who co-authored the study…said law enforcement must coordinate to combat sex trafficking during major events…

Do As I Say, Not As I Do

A cop is a cop, even when she’s a sex worker:

Down Under

Neofeminists claim decriminalization has “failed [to protect sex workers] everywhere it’s been tried”. This is what that “failure” looks like:

A prostitute has won a landmark sexual harassment case against a Wellington brothel owner…the Human Rights Review Tribunal awarded the young woman $25,000 in damages for emotional harm as a result of sexual harassment. Aaron Montgomery, who no longer owns The Kensington Inn…was described as a bully who enjoyed controlling and humiliating women and tried to pressure workers into having sex with him…

Imaginary Crises

After two decades as one of the few women who dared to challenge the hysteria, it’s nice to have so much more company lately:

…if the risk of sexual assault on campus were truly one in five…no parent in their right mind would send their daughter to coed universities…Chad Hermann…[examined] the reported sexual assault offenses over three years at…the University of Pittsburgh (UP), Carnegie Mellon University (CMU) and Duquesne University (DU). In 2009: At UP, with 14,800 female students, four sexual assaults were reported. At CMU, with about 3,900 female students, six sexual assaults were reported (a three-year high). At DU, with 5,700 females, three were reported. But wait: We “know” (we don’t really) that 90% of rapes go unreported! Okay, Hermann adjusts the numbers to reflect that, giving UP 40 assaults, CMU 60 and DU 30. Are we at one-in-four yet? Hardly. We’re at one-in-185 (average of the three)…

It Looks Good On Paper

…a BBC investigation into the policing of prostitution in Medway, Kent showed harm reduction was dangerously disrupted by their aggressive “cleaning up the streets” approach. In 2009, Kent Police began a scheme…called Safe Exit, supposedly to help women leave the sex trade by offering treatment for drug and alcohol addiction, training and education, and housing…But…instead…the women received a criminal record…Kent Police claimed to have reduced the number of women working on-street by over 90, but…two public servants associated with the scheme…say originally there were only 40-50 women working on-street. Our sources also told us…that the scheme was a “political PR stunt”…[some of the women were burdened with] ASBOs…and a few ended up in prison…

Law of the Instrument

“What at first seems like an arrest mission on a busy Orange County street is actually a rescue mission, as police go undercover to save girls who have become victims of sex trafficking…” No, actually, it’s an arrest mission. And if you can handle reading that first one, try this one about nearby Santa Barbara County, in which the agency of female university students and Chinese immigrants is totally denied using the excuse of “Stockholm Syndrome”.

Shifting the Blame (The Beat Goes On)

[James Brown]…was convicted of killing four women in his basement and stuffing their bodies in car trunks after he met them through online escort ads…just days apart, at his home in December 2011…Two were burned beyond recognition when a car was set on fire. Brown…faces life in prison with no chance for parole…The women who were killed were Renisha Landers, Demesha Hunt, Natasha Curtis and Vernithea McCrary, all in their 20s…

Above the Law

Three more brave heroes protecting and serving, in Oklahoma: “…Muskogee police officer…Mark Ridley…was arrested…after allegedly forcing…the woman’s car…off the road, then…[forcing] her to perform oral sex at gunpoint…” and in California: “Sheriff’s deputy [Damian Marquez repeatedly]…arrested a woman on felony probation ‘for the sole purpose of raping and sexually assaulting’ her at the [City of Industry] sheriff’s station…” and in Wisconsin:

[In the early stages of her pregnancy] and twice more after she had her baby, a [female prisoner] was placed in shackles…and raped over and over again, according to reports…Xavier D. Thicklen’s “abuse of his authority went wholly unchecked” by co-defendant Sheriff David A. Clarke, even though at least one of the assaults was caught on camera…Thicklen is charged with five counts of second-degree sexual assault…[and] could be sent to prison for 40 years on each…

First They Came for the Hookers…

…[New York City] has been…targeting…strip clubs by going after their liquor licenses…[after] trumping up charges…some clubs have continued to operate sans alcohol—which does, as a result of other bizarre strip club regulations, have the advantage of allowing dancers to be fully nude…But [alcohol-free clubs are much less popular and]…prohibition also zaps a major source of revenue for both clubs and dancers…

The Course of a Disease (TW3 #30)

Finland has rejected the efforts of its neofeminist “justice” minister to impose the Swedish model, but what they gave her is bad enough: “…the Ministry of Justice has proposed a tightening of the law, so sex-buyers who should have suspected pimping or trafficking can be sentenced…Justice Minister Anna- Maja Henriksson…[says she is] disappointed and…her goal is still a total ban…” They are lowering the burden of proof to only one step short of strict liability, but obviously that isn’t enough to satisfy Henriksson’s anti-sex bloodlust.

King of the Hill

Buried beneath the Profession of Faith, agency denial, masturbatory fantasy, and penis-size bragging is the only worthwhile sentence in this crap: “the FBI [named]…Detroit…as the second largest area for human trafficking in the U.S., with only San Francisco larger…”

The Course of a Disease (TW3 #52)

The same old Labour Party busybodies (with help from like-minded prudes in other parties) are once again trying to impose the Swedish model on the UK, but this time they’re pretending to be a new group inspired by last week’s reprehensible EU vote. If these people were any more transparent they’d be completely invisible. Here’s what Tim Worstall had to say about it:

Flush Criminalization

I love it when Jacob Sullum tears into Nick Kristof:

…how should we view armed agents of the state who invite people to engage in peaceful exchange, only to pounce on them with guns and handcuffs?…Nicholas Kristof thinks they’re heroes. Consider…his latest column equating prostitution with “human trafficking”…Kristof…insists “that isn’t prudishness or sanctimony but a strategy to dampen demand.” This strategy—cops posing as prostitutes—has been a joke and a cliché for as long as I’ve been alive, but Kristof considers it the cutting edge of innovative policing. If targeting customers is all it takes to eradicate black markets, why do they still exist?…Kristof…calls sting operations “marvels of efficiency”—which they are, assuming you want to produce futile arrests and gratuitous humiliation…

As I reported in December, the “marvel of efficiency” sophomorically entitled “Operation Flush the Johns” hasn’t had much luck convicting any of the accused who didn’t just plead out; they finally got their first one this week.

An excellent article by Molly Crabapple on the vile Project ROSE and its equally-vile founder, Dominique Roe-Sepowitz:

…Project ROSE may seem similar to the many diversion programs in the United States…[but] it doesn’t work with the convicted. Rather, its raids funnel hundreds of people into the criminal justice system. Denied access to lawyers, many of these people are coerced into ROSE’s program without being convicted of any crime…Roe-Sepowitz …told Al Jazeera: “Once you’ve prostituted you can never not have prostituted…Having that many body parts in your body parts, having that many body fluids near you and doing things that are freaky and weird really messes up your ideas of what a relationship looks like, and intimacy”…

Remembrance

Too bad the BBC can’t be this honest and sympathetic about modern clients:

Rich loon McCain hires ethically-bankrupt fanatic Dominique Roe-Sepowitz (that’s who “Arizona State” really is) to use an “analysis” method of her own design, and the “study” finds exactly what the two of them want it to find despite the fact that it contains nothing resembling either facts or methodology. What a surprise!

The Public Eye (TW3 #408)

Here’s an excerpt from Melissa Gira Grant’s new book, Playing the Whore, and two more interviews with her; one is with Caty Simon in Tits and Sass and one with Josh Eidelson in Salon. I’m very pleased to see how much coverage Grant and her book are getting in mainstream publications, especially in this time when most of the media are forehead-deep in prohibitionist lies.

The Duke freshman porn starlet has revealed her photo and stage name: Belle Knox. And I like her more with every article she writes:

Whenever Mira Sorvino feels neglected by the media, she vomits out a slew of idiotic fables for credulous reporters: “…this has grown into a highly profitable international business that rakes in $500 billion a year.” Yes, that’s a “B”; Mira claims “sex trafficking” brings in 25% more than the entire GDP of Sweden (even UNODC only claims $32 billion). But to a mathematical retard who believes every single whore makes over $250,000 a year and every pimp about $1.5 million, and that there are millions of “trafficked slaves”, I guess $500 billion seems credible.

Another runaway clown car of unintentional hilarity:

Unfortunately, xenophobia, hysteria and snitching are not crimes.

The Widening Gyre

Though the persecution of a Florida family for homeschooling (including arrests and threats to abduct their children) is reprehensible, it’s unfortunately too common to be newsworthy. What I find interesting is that because the mother is “the founder of a non-profit organization that rescues and restores victims of sexual trafficking”, it didn’t take long for the peanut gallery to ask, “Is it possible that this is…retaliation from those who are involved in sex-trafficking?” because “the human trafficking forces are far more powerful than most of us know and certainly do not want to believe.” Since it’s the state of Florida itself that is harassing them, the implication is clear; this hysteria is tracking right on the same course as the Satanic Panic, whose adherents also began to imagine their bogeymen as part of the government shortly before the whole thing imploded.

I just wish sex worker activists cared more about establishing our social value than about preserving feminist myths:

It Looks Good On Paper (TW3 #311)

The Orwellian language in this article about a “sexual exploitation recovery program” (i.e. scheme to brainwash hookers) is especially chilling: “Selah Freedom expects the new…program to fill quickly and has partnered with the Sarasota and Bradenton Police Departments to bring victims into their care…” The casual reader probably wouldn’t even realize “bring into care” means “arrest and cage”. This story is also notable for its oddly-humble “King of the Hill” entry, which only claims the Tampa Bay area as the third-largest “trafficking hub” in Florida rather than in the whole US.

Dysphemisms Galore

Reporter Maria Arkouli just couldn’t resist turning the rather pedestrian story of a whore arrested for practicing prostitution without a license into “sex trafficking” hentai: “Famous singers…are consigned to prostitution by a ring in Athens which has spread its tentacles throughout Greece and over the Internet…”

When a reporter says something is “surprising”, you can bet it actually isn’t to anyone raised outside of a convent:

It would do more than that: it would utterly destroy the internet as we know it, because no website would risk criminal charges for user-generated content like this blog or reader comments on tens of thousands of others.

The law doesn’t care if you profit from sex workers, as long as you don’t have any direct contact or actually help us in any way. In a new French video game players manipulate a cartoonish, stereotyped streetwalker who must make $150,000 to “escape her pimp” by performing fake orgasm sounds into a microphone and avoiding hazards like cops and STDs (no skill involved in the latter because whores are just stupid victims of fate). The writer of the linked review also profits by using various prohibitionist tropes to save himself the effort of original thought.

Mishra would own half of the business and the Dheris would own the other half…police did not find any evidence of drug activity…and…analysis found only trace elements of illegal drugs on the cash…[the judge] ordered that Mishra receive cash or a check in the value of $1,074,000 with interest.

Another supposed “victim” is caged to force her cooperation in the state’s ugly little morality play: “[An Illinois] woman who claims she was forced to work as a prostitute for her boyfriend remains held…without…bail because she is considered a flight risk and might not return to testify in her boyfriend’s trial…”

End Demand

Though the story is somewhat amusing, note that “end demand” policies turn innocent whores into unwilling Judas goats: “A man caught with a prostitute in his car told police she was there to show him where to buy tomatoes…officers found the [known sex worker] sitting inside Muhammad Ikhlaq’s car while he withdrew £20 from a cash machine, which he said was to pay for tomatoes…”

Unclean Situation

The Sisters of Mercy, Sisters of Charity, Sisters of Our Lady of Charity, and Good Shepherd Sisters will not apologise to survivors of the Magdalene laundries…Neither will [they] make a financial contribution to the Government’s reparations scheme…Co-operation voluntarily given does not compel the nuns in any legal sense. Their negative response invalidates the Government’s assertion that survivors are being afforded restorative justice. There is no justice without the nuns’ apology and/or financial reparation…the orders expect an amnesty for gross human rights violations…

Lest you forget, these same orders still receive tremendous amounts of aid and political support from the Irish government for their anti-whore scheme Ruhama.

No Friend of Ours

Just in case you think it’s only Las Vegas “authorities” who hate whores so much they’re willing to make themselves look like idiots by parroting ludicrous prohibitionist drivel, here’s an unusually-ridiculous example from Reno:

They are manipulated by men who control every aspect of their lives…Some girls are branded – or tattooed – with their pimp’s name…others are forced to perform while their children are held ransom, usually at gunpoint…Girls as young as 11 are being exploited…the average age…is 14…Since 2002, the FBI and local law enforcement agencies have rescued about 100 children identified as possible victims of juvenile sex trafficking…That number does not include the adult women being trafficked, which experts say would be impossible to produce because many women don’t acknowledge that they are under the control of a pimp…[Ron] Chalmers heads the…[police division] that focuses on these types of crimes…about 10 years ago, the women arrested…were generally in their 30s to 40s [and] were drug addicts, he said. But today, the prostitution demographics are completely different…They’re much younger than they used to be, he said…”A significant number of what we see, 80 to 90%, are being exploited – forced into the lifestyle”…

You may remember that the claims made in the “Satanic Panic” similarly became much more extreme, bizarre and demonstrably false as the hysteria drew closer to the point of implosion. That last bit is more than just Maslow’s Hammer at work; it’s an example of the incredible mathematical and sociological illiteracy of hysterics. Whenever a person tells you there’s been a major demographic shift in any human behavior in only one decade – from nearly nothing to “80 or 90%” – it’s a safe bet the speaker is an imbecile who is incapable of considering even rudimentary thought experiments like “where did all the old ones go?” We see the same principle at work under the Swedish model, which claims to have dramatically decreased the number of men who have ever paid for sex.

Banishment

The sex workers in the Solutions Not Punishment Coalition (SNapCO), the Atlanta group which defeated the proposal to banish arrested sex workers from the city, need to get control of their “allies”; not only is the group supporting involuntary diversion programs, its spokeswoman Misty Novitch is belching up the “average debut at thirteen” myth for the media.

It Looks Good On Paper (TW3 #311)

Yet another religiously-based “diversion program” chock full of prohibitionist rhetoric which claims to “help” streetwalkers while refusing to question the justice of the laws by which cops repeatedly victimize them: “Prostituted women” were all sexually abused as children, pimps give us drugs to control us, blah blah blah blah blah…

Caty Simon of Tits and Sass interviewed Kemal Ayrikotu of the Red Umbrella Sexual Health and Human Rights Association on the cultural background to the murder of Dora Oezer; Ayrikotu discusses the lack of rights for both sex workers and transgenders, and criticizes LGBT activists who wish to stress that Dora was a transwoman while ignoring that she was a whore (despite the two being nearly synonymous in Turkey). A War for Peace (TW3 #11)

Bullies With Badges

Note that Adam wasn’t charged with anything; the police stole his entire business to be indefinitely held as “evidence” of someone else’s misdemeanor.

This story about yet another Spanish city’s war on streetwalkers is not really noteworthy, but I love this picture which illustrates it.

Traffic Jam

Remember the supposed “child sex trafficking ring” run by “Somali gangs” that federal prosecutors were all puffed up about last year?

…every defendant who has gone to trial has either been acquitted or had their conviction thrown out. The government’s case was weakened when…a key witness…refused to testify, saying he is afraid for himself and for his family. So prosecutors charged Abdullahi Farah with two counts of contempt of court and obstruction of a child sex trafficking case. He was convicted…in April…and…is facing a maximum of 20 years…for the obstruction conviction…and…life in prison [for contempt]…Legal experts say…it’s almost unheard of for prosecutors to come down so hard on one of their own witnesses…

Considering that “agents said Farah gave conflicting accounts and sketchy details” and the judge “said he had problems with Farah’s credibility”, I think the truth is obvious: sleazebag prosecutor Van Vincent tried to pretend a bunch of petty thugs were a gigantic conspiracy, but drew a judge who wouldn’t roll over for him and is taking it out on the only available scapegoat. Consider the prospect of life in prison for a contempt charge, and then tell me the US isn’t a police state yet.

The main tip-off on…two sisters kidnapped from Dhaka…came from a sex worker in Pune, who contacted one of her relatives in Kolkata, who in turn contacted the girls’ relatives in Bangladesh…these girls had allegedly been lured with false promises and kidnapped by a…close acquaintance…[who] sold them to a brothel…

Banishment

Government actors issue a warning of a problem created entirely by government actions:

Absolute Corruption

…Twenty-five years after it first indicted [Jesse] Friedman, the Nassau County [New York] District Attorney’s Office…could completely exonerate him. Out of a dozen major child-sex-ring cases that roiled the country between 1984 and 2005, Jesse’s is one of the last convictions still standing…in November of 1987…postal inspectors intercepted…child pornography addressed to [his father]…police admitted that not one of the 30 children they…interviewed…reported any kind of abuse. Natural Processes

The supposed penetration of “sex trafficking” into every nook and cranny of the U.S. continues; notice the Profession of Faith in the first one:

They see a lot of that illegal activity through that,” Stenberg said…

If that kind of surveillance state doesn’t scare you, consider instead the rather disgusting sexual fantasies of Florida cops and bureaucrats: “Orange County announced the creation of a task force aimed at stopping human trafficking in central Florida…Some of the victims…forced into prostitution are as young as 12 years old…most of the victims are children…Kathy…was 11 when she was sold to sex traffickers before being rescued by the FBI…”

Obfuscation via Dysphemisms (TW3 #319)

Lack of Evidence

It’s good to see the media finally noticing this:

There is no law that says…condoms [are] illegal…and yet NYPD…routinely…[uses them] as…evidence for…prostitution…one city agency conducts a public-health campaign and…[those] who take advantage of it are…promptly arrested by a different city agency—leading to cases being thrown out of court, a suppressed and redacted…study of the problem, and a bill to address the matter in…the state legislature…arresting people because they are in possession of condoms…distributed…by the city itself…looks an awful lot like entrapment…

Nor are the arrests limited to sex workers; as I’ve explained many times, laws which violate whores’ rights invariably violate everyone’s.

Real People

I love seeing profiles like this one of Australian escort Grace Bellavue; the more the public sees of real sex workers, the harder it will be for prohibitionists to sell their stereotypes and myths about us.

Check Your Premises

This is only “stunning” to those who believe in the “pimps and hos” myth:

A sex-trafficking case got the hook in…Brooklyn…when prosecutors revealed their victim was advertising herself as an escort…the woman, now 19, who claimed defendant Robert Pannell forced her into prostitution in April 2011…advertised herself online…last month. The stunning revelation contradicted the accuser’s testimony that her ordeal as a 17-year-old runaway was the only time she ever turned tricks…

Backlash

The Women’s Legal Centre…in Cape Town…provides legal services for sex workers…[who] face routine harassment, intimidation, and…abuse from police…[who] threaten, arrest, or detain [them] for days at a time…many are released only after paying large fines…WLC began its outreach by offering weekly group workshops…[but] soon expanded, employing four former and current sex workers as paralegals…

Recognizing Doubletalk

An internal investigation of the Wilmington [North Carolina] Police Department’s narcotics enforcement team revealed inadequate documentation of funds, poor…supervision…and a “code of silence” cover-up of a March 2012 undercover prostitution operation…Police Chief Ralph Evangelous…[claimed] the undercover operation was in response to a citizen complaint about…escort services…the narcotics enforcement unit came up with a “unique approach” in [which]…more than $2,000 in city funds…were used…

Translation: The narcotics squad had a party but got caught, and it took the police chief a year to come up with a cock-and-bull excuse.

Peeping Toms

A federal appeals court struck down Virginia’s anti-sodomy law…a decade after…Lawrence v. Texas…The appeal originated in a 2005 case in which a 47-year-old man was convicted of soliciting a 17-year-old girl for sex. The girl refused and reported the incident to police, resulting in a “crimes against nature” charge…

One Size Fits All

As you might expect, Swedish neofeminists do not like surrogate motherhood and consider it a form of “human trafficking”:

Surrogate motherhood is a serious crime against women’s human rights…Even when the woman has voluntarily become a surrogate…she gives up the rights to her own body…surrogacy…opens the door for viewing women and children as goods, and to regarding women as containers…having children is not a human right…

Nor, in the minds of neofeminists, is using one’s natural abilities in a way which violates the neofeminist religion. Though this collectivist stance is evil because it denies women the right to control their bodies, it is more philosophically consistent than that of the US (which allows surrogacy but bans sex work) and Australia (vice-versa). But lest you believe that Swedish neofeminists are truly motivated by concern for women’s well-being:

Equality Minister Maria Arnholm wants Sweden to keep the right to deport women whose relationships with Swedish spouses end within two years…The…rule was introduced in an effort to clamp down on sham marriages and to put an end to so-called “wife imports”. But it has been blamed for forcing women to remain in abusive relationships…[and] a 2012 government-ordered inquiry [recommended it] be abolished…The Centre Party’s Women’s Association has also demanded that the…rule be…[replaced with] “immediate action” against “the practice of wife importation”…

It Looks Good On Paper

Prohibitionists just love to tout “diversion programs” which supposedly “help” whores instead of criminalizing them, but if these are so great why do they need cops to force women into them, and why are their standards so strict that very few qualify to avoid jail? In a recent example from Tucson, Arizona, members of SWOP warned sex workers away from a sting they had learned about, but 13 women still got caught…and only four qualified to escape jail. The scheme’s organizer Steve Kozachik, a local politician with a reputation as a control freak, claimed SWOP’s protecting women from cops was “unnecessary” and that “This is not anti sex worker.” Tell that to the nine women whom the prohibitionists “helped” into cages and branded with lifelong criminal records for trying to earn a living.

Politicizing the Personal

Dr. Laura Agustín feels the same way I do about the concept of “empowerment”, as she explains in this older essay she recently republished:

The verb is transitive: someone gives power to another, or encourages them to take power or find power in themselves. It’s used among those who want to help others identified as oppressed…[the] emphasis [is] on the helper and her vision of her capacity to help, encourage and show the way…To empower me as a sex worker you assume the role of acting on me…

Scrambled Eggs

…a California…law prohibits women from being compensated for donating their eggs for medical research, despite payments to subjects in other human research studies…[and] eggs…donated for fertility treatments…[but] a recently introduced bill…would allow women to be compensated…the California Family Council…[claims sponsor Susan] Bonilla’s bill opens up “dangerous medical ground.” The…anti-abortion group…said eggs should be treated like organs and should not be sold…Bonilla said…”I think women are able to decide for themselves if they want to participate in a clinical trial”…

Saint Death

Jesse Walker published a good short piece on Santa Muerte which includes links to a recent AP article, an FBI scare-screed and an essay comparing anti-Santa Muerte hysteria to the Satanic Panic.

Neither Addiction Nor Epidemic

Neuroskeptic points out the deep connection between addiction rhetoric and crypto-moralism:

…The dopamine theory of addiction is extremely popular today…[but] if you view addiction as essentially about reward (pleasure), surely that means…anything pleasurable could…be addictive?…if…addiction is the direct consequence of over-indulgence in a reward, then aren’t you saying that reward itself is ultimately what’s addictive?…If everything from food to friends to music are rewarding because they trigger dopamine release, then surely all of those things could be ‘addictive’…The more fun, the more (potentially) addictive…this idea – for all its medical, neurobiological, scientific language – actually undermines the concept of addiction as a ‘disease’ and reduces it to what amounts to a moral failing – it casts addiction as over-indulgence…

Finding What Isn’t There

Ministers, the police and social workers have been accused of a “shocking” failure to prevent the spread of modern slavery in the UK, leading to sexual exploitation, forced labour and the domestic servitude of adults and children…Describing government ministers as “clueless”…[about] human trafficking…the most exhaustive inquiry yet conducted into the phenomenon concludes that the approach to eradicating modern slavery is fundamentally wrong-headed. Instead of helping vulnerable victims…the legal system prosecutes many for immigration offences…

Though I hate to defend government officials, I feel compelled to point out that it’s difficult to adapt to ever-expanding definitions, and impossible to produce enough “victims” to satisfy “estimates” which are essentially just made up.

Obfuscation Via Dysphemisms

Gloria…Giammalva…was [sentenced]…to…[21] months in prison and to be partially responsible for a $600,000 money judgment…U.S. Attorney Trent Shores…[claimed] the conspiracy…charged $30 per encounter, which he said meant that 20,000 commercial sex acts were performed by the women who were exploited…Giammalva…conspired with others in the operation of a multistate prostitution business that coerced and enticed women across state lines to participate in commercial sex acts…

Trim off all the dysphemisms and what remains is: she owned an escort service and the prosecutor lied about the fee to ratchet up the number of “counts”.

Coming and Going (TW3 #35)

Dallas officials are trying to push their “prostitution diversion” scheme on the rest of Texas as a replacement for locking women up. While any move away from incarceration is good news, the motivation is a desire to save money rather than a recognition that criminalization of consensual adult behavior is wrong; whores are still regarded as “criminals” to be “rehabilitated”, and all are assumed to be miserable victims who want out of sex work.

Hard Numbers (TW3 #48)

…Steph Key will introduce new laws to [the South Australian] Parliament…to decriminalise all forms of sex work, after a previous attempt was rejected by one vote in November. The new Bill, based on a New Zealand model, would…allow local government…regulatory control…but…prevent councils from outlawing brothels simply because they offer sex work…Ms Key and [Status of Women Minister Gail] Gago were confident the new attempt was more likely to pass…

That’s the Ticket! (TW3 #138)

Dr. Brooke Magnanti on Comic Relief’s subscription to prohibitionist lies:

…This figure comes from a paper that surveyed only street-based sex workers, who represent less than 20% of prostitution…we should be…wary of…any group that throws around this number as if it represents sex work in general…Similarly, we are regularly told that the “average” age of entry into sex work is 13. This is actually incredibly mathematically unlikely, unless there is an epidemic of infants being sexually exploited we don’t yet know about. Former librarian and escort Maggie McNeill has broken down why this oft-repeated assumption is incorrect…The Comic Relief site continues: “The UK is a major destination country for trafficked young people. They are at a very high risk of being sexually exploited.” No source is given for this statement – probably because no such data exists. Confirmed trafficking cases in the UK are more likely to enter other jobs like agriculture, hospitality, and domestic service than they are to become sex workers…

No Friend of Ours

In the process of criticizing Nevada’s proposed “Everyone is a Sex Trafficker” Act, Jennifer Reed also debunks the “sex trafficking” panic:

…Prostitution in the U.S. was largely legal until changing women’s sexual norms led to a “white slavery” panic that resulted in the closing of brothels with the White-Slave Traffic Act, better known as the Mann Act in 1910…The reality was numerous young women were drawn into prostitution for “mundane” economic reasons [but] the ambiguous language of the Mann Act…was used to criminalize forms of consensual sexual behavior for many years…The [American] conception…developed because a crusade against prostitution…[conflated it] with human trafficking, a claim for which there is no evidence, even according to the U.S. Government Accountability Office. An executive summary of human trafficking put forth by the non-profit Center for Health and Gender Equity concludes that “conflating human trafficking with prostitution results in ineffective anti-trafficking efforts and human rights violations because domestic policing efforts focus on shutting down brothels and arresting sex workers, rather than targeting the more elusive traffickers”…investigations…[focus] almost entirely on commercial sex. It is a structure built on vice squads rather than labor investigators…

Comfort Zone

I wrote: “…many European countries seem more interested in ‘trafficking’ as an excuse to restrict immigration than as a genuine concern for the human rights of migrants.” Jim Cusack of The Independent wrote: “The Department of Justice and the courts are turning down ‘nearly all’ asylum requests from African women who say they fled [to Ireland] to escape sex traffickers in other European countries…”

The Biggest Whores

Res ipsa loquitur:

Minnesota’s Supreme Court last week barred attorney Thomas P. Lowe from practicing law for at least the next 15 months after it was revealed that he was billing a client for sex. Lowe…was approached in August 2011 by an acquaintance who asked him to represent her in a divorce. Their…relationship soon evolved into a sexual one, but…Lowe…[billed] the woman for [all] the time they spent [together, including] having sex…[after] Lowe…[dumped her] the woman… attempted to commit suicide and was hospitalized…Lowe was previously on probation for purchasing cocaine from a client…

The second lawyer isn’t nearly as bad, though still terribly unprofessional:

A public defender…is facing charges after allegedly exchanging texts with an undercover cop who he thought was a prostitute, and then trying to exchange sex for legal representation. Christopher Hollander…allegedly sent a text message to a phone formerly used by a prostitute [but now in possession of a cop who] Hollander met…in a hotel room…The two discussed the phony prostitute’s alleged legal trouble. When the officer asked “How much is it going to cost me” for the legal services, Hollander started to caress her hand…then allegedly began trying to kiss and hug the officer, and told her he had two condoms…

Lawyers, if you want to propose exchange of services just say so; real hookers appreciate honesty, not some clumsy attempt at seduction.

Good Fantasy, Bad Reality

Ed Bagley has accepted a bargain in which he pleaded guilty to having sex with his supposed “victim” while she was underage, in return for prosecutors dropping all other charges (despite their insistence that he “swear” that the other accusations are true). The one is bad enough; it can carry a 20-year sentence, and several of the other “conspirators” (as the state labels them) will also get very hefty sentences.

Something Rotten in Sweden (December Updates)

Remember, prostitution has never been illegal in Canada; these men were arrested for the “crime” of talking about it in public, which demonstrates the importance of taking this kind of power totally out of cops’ hands: “Ottawa police swept the city’s downtown core…in an effort to find, charge and re-educate men looking for prostitutes…They arrested 15 men, 13 of whom escaped charges and will attend ‘john school’…a partnership with the Salvation Army…” Please note the Orwellian term “re-educate”.

The Cold, Grey Light of Dawn

Looks like the Philippines is moving toward British-type legalization (erroneously called “decriminalization”): “The Department of Social Welfare and Development…has endorsed a bill…which would decriminalize prostitution but punish those who control and profit from…[it, repealing] clauses…which punish ‘women who, for money, engage in sexual intercourse, or lascivious conduct’…”

It Looks Good On Paper

Another bit of feel-good legislation which capitalizes on hype but will actually help virtually nobody, due to its basis in fantasy: “A bill filed in the Oklahoma Legislature…would erase the prostitution records of human trafficking victims…[who] average…12 to 14 years old…”

Neither Addiction Nor Epidemic

This article has so much to recommend it: Dr. Brooke Magnanti debunks “porn addiction”, describing the “studies” which claim to support it as “poorly conducted surveys on a level of market research, not science.” In the process, she also quotes Dr. Marty Klein and lampoons both Cosmopolitan and Naomi “Stopped Clock” Wolf, all in less than a thousand well-chosen words.

Girls, Girls, Girls!

Of all the media one would expect to be least likely to side with puritans against a business persecuted for supposedly “corrupting public morals”, a rock music radio station has got to be pretty high on the list. Though the article itself is dry enough, the wording and scare quotes in the headline and lede amply demonstrate the editor’s attitude: “Lawsuit Claims Dancing in a Topless Bar ‘Improves the Self Esteem’ of the Stripper – seeks to have San Antonio’s strict new strip club law thrown out, also claims stripping is a ‘socially fulfilling experience’.” It gets much worse; the station appears to have some close association with Nikki Sixx of Motley Crue…author of the titular song celebrating strippers.

A Whore in Church

The most interesting part of this article about sex workers in Malawi wearing hijab to attract Muslim customers is not the mere fact of it (which would simply be an example of the clipboard effect), but rather the fallacious notion (expressed both in text and comments) that a whore cannot be Muslim (or “truly” Christian either). Also worthy of note is the author’s reversal of the usual feminist complaint that not covering up leads to “objectification”; this only goes to show that the real issue such women have is not some imaginary harm to women, but rather heterosexuality itself.

Above the Law

[Las Vegas] police officer John Norman is going to prison for two years…after pleading guilty to…coercing women to expose their breasts after stopping them on the road…Once Norman is released from prison, he will have to register as a sex offender…

The Crumbling Dam (TW3 #13)

Once again, Canadian government prohibitionists are trying to convince the courts that dangerous, repressive laws which deny sex workers’ agency are actually intended to “protect” them:

Hundreds of shadowy body rub parlours operated by exploitative pimps…are operating on the outskirts of Toronto, the Ontario Crown warns in a court document…[urging] the Supreme Court of Canada to let police keep the powers they have to protect female sex workers, who are often cowed into submissive silence…However, a group of prostitutes who have successfully challenged the ban through two levels of court accuse…Crown lawyers of scaremongering. In the decision under appeal, the Ontario Court of Appeal invalidated the…prohibition on keeping a brothel…[and] granted prostitutes the right to…hire staff to protect them…the…court is scheduled to hear the…challenge in June…

Naked Truth

Melissa Gira Grant’s “The War on Sex Workers” appears in this month’s print edition of Reason; though regular readers will already be familiar with much of the ground she covers, it never hurts to revisit it. More importantly, for an unrepentant sex worker to have the opportunity to discuss the neofeminist war on whores in a national magazine (albeit a libertarian one) is a sign that this issue is beginning to move into the mainstream.

Imagination Pinned Down

This article entitled “Sex, Lies and Audiotapes” is 12 years old, but is an excellent look at how “fantastic tales of sexual abuse” are instilled into the minds of the vulnerable, and why radical feminists were largely to blame for “sex abuse” hysteria and the Satanic Panic; it is thus still topical as background for the new guise of those moral panics, “sex trafficking”.

Shift in the Wind

Though it may be difficult to recognize for sex workers in the US, British Isles and any place else strongly affected by “trafficking” hysteria, 2012 actually saw net gains for sex workers; Cheryl Overs reviews the high points (without neglecting to mention the low ones) in “A Good Year for Red Umbrellas”.

Texas Tall Tales

Texans aren’t the only ones who can tell tall tales about new technology being used by “human traffickers” to “entrap innocent girls”:

…Mobile phone recharge shops have been reportedly taking advantage of innocent girls who approach them for recharge coupons and give their numbers. The employees/owners of the shop or their friends call the girls…develop friendships and later misuse them…ruining the girls’ lives…human [traffickers in]…Kundapur…are said to be running a mobile recharge outlet…the accused lure the girls with jobs and then use them for their own ends. Later, the girls are allegedly blackmailed and trapped, and their escape route is closed…apart from flesh trade, a drugs network is also interwoven in the racket…

Mr. Kiss Kiss Bang Bang

As expected, a UK judge has ruled that the case of Mark Kennedy, the cop who was allowed to trick women into sex in order to spy on them, will be heard in a Star Chamber proceeding. What was unexpected was that he would say what Kennedy did was OK because James Bond does it:

James Bond is the most famous fictional example of a member of the intelligence services who used relationships with women to obtain information…[such] fictional accounts…lend credence to the view that the intelligence and police services have for many years deployed both men and women officers to form personal relationships of an intimate sexual nature…in order to obtain information or access.

As Heresy Corner points out, “James Bond isn’t just ‘fiction’, it’s escapist fantasy…[which] doesn’t ‘lend credence’ to anything…and Mark Kennedy’s ‘targets’ weren’t exotic Russian agents with a handbag full of nuclear secrets and the sexual etiquette of a praying mantis…nor were they dangerous international terrorists intent on blowing up airports or shopping malls. They were…largely peaceful activists engaged primarily in democratic dissent, however misguided or naive…”

Buried Truth

Remember Lisa Biron, the anti-gay lawyer who “transported a teen girl…to Ontario …and coerced her into engaging in

sexual acts with another person”? It turns out the girl was 14, there were two men, and Biron also had sex with her. Oh, and one more thing: the girl was her own daughter. She was convicted of child porn charges on the 11^th.

South of the Border (TW3 #49)

The creation of “sex trafficking rings” from people who used to be called “illegal aliens” continues, complete with childish “code names”, bombastic rhetoric, exaggerated numbers and infantilization of sex workers:

U.S. Immigration and Customs Enforcement announced the results of a lengthy investigation called Operation Dark Night. It looked into a sex trafficking ring stretching from Florida to Georgia to North and South Carolina…women…were forced into prostitution and traded like slaves in various cities for about a week at a time…11 victims were rescued and 40 customers called Johns were also taken into custody. Investigators say the women were forced to perform up to 30 sex acts per day…

Like most “trafficking” articles, this one contains the Profession of Faith: “…‘its a bigger issue than many people thought,’ said Joan Garcia-Melendez…‘Human trafficking is a very hidden crime’…Authorities say this is a wakeup call as to how widespread sex trafficking has become…” But what will happen to those poor “victims” who were “rescued”? The BBC says what the American story won’t: “Those who were illegal in the country would be deported.”

Q & A (January 2013)

I mentioned that “the only time [verification services] fail is…when some idiot fails to stick to the plan, gets caught in a sting and then ransoms his worthless hide by giving the busybodies his login info so they can pop several girls before the service gets wise.” One of my readers supplied more details: there were several instances, all in the Appleton/Oshkosh area of Wisconsin, and P411 removed those entire cities from the site as a precaution and directly warned all the ladies who might be targeted. Apparently cops in Little Rock, Arkansas have also attempted the same thing, though less successfully.

Perverse Incentives

Susie Bright on how perverse prosecutorial incentives spawn abominations:

Twice in my career I’ve been asked to serve as an expert witness on the defense team of an obscenity trial…the defendants were low-hanging fruit…targeted because of their…vulnerability…The Justice Department [bags] obscenity law trophies by going after the poor, the suicidal, the insane, the cognitively impaired— because that’s the way they rack up numbers and status. That’s the way they fuel their careers…not by taking on constitutional issues, or injustice, or fat cats who believe they’re above the law…They find someone who’s drooling, or depressed, or friendless— and then throw the book at them. It doesn’t take long because the “defendant-target” is overmatched…

For every complex problem, there is a solution that is simple, neat, and wrong. – H.L. Mencken

American politicians just love “feel good” laws, legislation grounded entirely in emotion and usually labeled with some vague designation including words like “safe”, “protect”, “victim”, “child” or the name of a dead little girl. Such laws usually result from moral panics or lurid news stories, accomplish little to nothing for actual victims of actual crimes, trample on civil rights and are impossible for legislators to oppose for fear of being labeled “soft on crime” or some equally meaningless adjectival phrase. And why do politicians love them? Because they require no research, debate, thinking or other actual work and allow those who support them to blend into the herd, mooing loudly while standing beneath the flag (cue patriotic music). If a news story reports that a law is passed unanimously or near-unanimously, if the chief executive signs it quickly and with great fanfare, if it’s promoted by a variety of special interest groups (especially “anti-crime” groups), and most notably if it was sponsored by one member of each half of the Big Government Party, you can bet the farm you’re looking at a feel-good law whose chief function is to misdirect public attention from whatever shenanigans the politicians are up to at the moment. Here’s a recent example from Illinois, reported on August 6^th in the Chicago Sun-Times:

Gov. Pat Quinn on Saturday announced a new law that will give victims of sex trafficking who have been charged with prostitution an opportunity to clear their names through court. “Sex trafficking is a truly reprehensible crime that preys on the most vulnerable. Victims deserve a chance to clear their records and rebuild their lives,” Quinn said. Illinois previously passed the 2006 anti-trafficking law and 2010 Safe Children Act, which helps support victims who were forced into the sex trade and have criminal records as a direct result of being trafficked…Senate Bill 1037 allows defendants who are victims of human trafficking at the time of their prostitution convictions to file a motion to vacate the conviction if the defendant’s participation in the offense was the result of being a victim…Prostitution convictions limit victims’ abilities to access housing, employment education, immigration status and parental rights, according to the governor’s office. The bill also creates a new filing timeline for victims of sex trafficking because they often endure years of abuse at the hands of traffickers and customers before they are able to seek help.

“The most important thing about Senate Bill 1037 is that it makes sure that the judicial system has a mechanism to ensure that a person who has been the victim of a crime is not automatically considered a criminal,” [bill sponsor Toi] Hutchinson said. “It is good public policy to protect women and children who have been taken advantage of in this most heinous way. They can take the necessary steps to rebuild their lives and become functional members of society after suffering trauma of that magnitude.”

“Victims of human trafficking are often forced into prostitution and other crimes against their own will, and too many of them are being prosecuted as criminals,” [bill sponsor Karen] Yarbrough said. “When we have evidence that involuntary human trafficking was the cause of the crime, even though the victim may not have had the ability or representation to prove it during trial, we must do the right thing and reverse their conviction so they can move on with repairing their lives.” The bill takes effect Jan. 1 and was supported by a variety of institutions, leaders and anti-crime organizations…

There’s nothing wrong with the core concept in principle; obviously somebody forced to commit a crime should not have to suffer penalties for that crime. But as we have seen, coerced prostitution is extremely rare (roughly 1.5% of adult prostitutes and less than 16% of underage ones), and the majority of those are involved in coercive relationships rather than the true “sex slavery” the media, trafficking fetishists and politicians are so aroused by; I’d be very surprised if more than a hundred women in the entire state of Illinois (roughly one-tenth of the state’s statistical share of coerced prostitutes) could truly qualify as “trafficked” in any meaningful way. Even then, the victim would have to be first arrested and convicted of prostitution before being able to take advantage of this law, and that would require her being able to “prove” that she was “trafficked” by whatever criteria the law establishes (one of which is certainly fingering one or more men to take her place in jail). Furthermore, if the Illinois law is anything like New York’s “Safe Harbor Law”, it’s virtually impossible for the majority of prostitutes to take advantage of it:

The Safe Harbor Act, along with initiatives like it that [Rachel] Lloyd and others are promoting across the country, are NOT simple or solutions for most of us. First, they don’t stop arrests of young people for prostitution-related offenses, or the police abuses of young people in the sex trades, including police trading sex in exchange for promises of dropping charges. They also don’t stop arrests of young people in the sex trades that involve “charging up,” i.e. charging young people with weapons or drug-related offenses which may be easier to prove. Second, while they may stop criminal prosecutions of young people for prostitution-related offenses, these laws do not eliminate detention and punishment of young people involved in the sex trades, they just shift young people from the jurisdiction of the criminal courts to family court systems, where they can remain entangled until the age of 21. And, in the end, only a very narrow group of people can benefit from these laws.

For example, in order for the Safe Harbor Act to benefit a young person, they must be under 16 and arrested for the first time and must never have been in family court before. Young people between the ages of 16-18 continue to be charged in adult court. Even those under 16 who can meet the Act’s criteria must still convince a judge that they are a “victim” of a “severe form of trafficking” – a hurdle that…is almost impossible for young girls of color…When young people can’t respond to police and prosecutors’ pressure to give up a “pimp” they never had they get punished by law enforcement and service providers alike, and find themselves back on the delinquency and detention track. Even when…[the law] is found to apply to a young person, they must still follow the rules a family court judge sees fit, which can involve attending a court-mandated program…many of which enforce Christianity on participants…

And even if Illinois’ version of the law corrects the problems (which is highly unlikely considering that Lutheran Social Services of Illinois and the Sheriff of Cook County, Tom Dart, are among its supporters), it still leaves unquestioned the idea that the state has the power to regulate women’s sexuality and to punish women for the “crime” of having sex on their own terms, and that the only way for a woman to avoid state-sanctioned persecution is for her to “prove” to busybodies that she was the “victim” of a man or men, thus surrendering her adult agency to the court by admitting to an inability to manage her own sexual affairs.
