Lack of Evidence

A fine example of barking up the wrong tree:

During a recent trip to Miami, San Francisco residents Heather Cox and Gigi Otálvaro-Hormillosa visited Dean’s Gold strip club in North Miami Beach…they were denied entry…[because] they’re women and weren’t “accompanied by a man”…”The message that women must be accompanied by men is totally infantilizing,” says Otálvaro…”it’s a direct statement of exclusion targeted at bisexual women and lesbians”…

Nope and nope. It’s not “infantilizing” and it isn’t “targeted at lesbians”; the Florida policy is an anti-whore measure intended to keep us from “poaching” clients from the clubs.  Don’t like it, lesbians?  Fucking lobby for decriminalization, then, because as long as we have no rights yours will continue to be infringed.  And guys, don’t think these laws don’t affect you, too:

…The YouTube video’s original caption to the video…“Bought a burger and pulled over to have a few bites. I suppose that constitutes probable cause?”  Fortunately, the citizen…pulled out his phone and started recording when the Austin cop  approached the vehicle…Rick asked, “Why am I getting pulled out of my car?”  “Because you’re being detained.” answered the unknown Austin PD officer…Rick immediately asked, “Why am I being detained?”  “Let’s see. It’s 2 o’clock in the morning and you’re in a parked here by yourself in a high prostitution, high drug area”…

They Still Don’t Get It

This “editorial” cannot have possibly been written by an actual editor, unless this paper hires its editors from the local eighth-grade class.  It is also virtually fact-free and if its nose were any higher up the arse of authority it would suffocate:

…Prostitution has always been a money-making endeavor.  It generates an income for the women and the men who often control them.  But, the profession has become more dangerous because many of the prostitutes are desperate for money to support drug addiction.  That, of course, means crimes related to prostitution have increased dramatically…Most of the women are not street-walkers, but advertise themselves on a website called The Back Page…police respond to ads to snare women, and place fake ads on the site to entice the male customers…Fewer women are now advertising on the site, but the demand from male customers was still too high…prostitutes were more numerous 40 years ago and they frequented the heart of the downtown.  Development in the center city that has attracted families chased the prostitutes away.  We appreciate the police for continuing to work on the prostitution problem and…the developers who continue to make the downtown a better place…

End Demand

Ever wonder what kind of sick propaganda men are subjected to in “john school” for the “crime” of sexual desire?

Imagine your mother or the person you think of like a mother.  Now picture her on the street, offering sexual services for $10 at least a half-dozen times a day…The goal of the day was to outline not only the “what ifs,” such as being assaulted and robbed, but to impart that many prostituting are forced there by circumstances, whether that’s another person, addiction, or mental illness…the men also hear about possible health impacts, from HIV to pubic lice, sexual addiction, and the impacts of prostitution on communities…

Challenge

All anti-sex laws are repeatedly supported by courts until the day they aren’t:

A…judge has refused to find the laws that outlaw prostitution in Ohio unconstitutional in the case against two women who were operating a massage parlor…“Ohio prostitution statue compromises the protected right to sexual privacy by denying consenting adults the right to make decisions about sexuality in the commercial market place,” [defense attorney] Blake Somers wrote in his motion. “Such an instruction is not justified or mitigated by societal moral concerns…making the sale of sex illegal violates the right of sexual privacy derived from the due process clause and the defendant herein seeks nothing more that to invoke the principals of liberty that already exists”…

Still a Child 

Twenty-five years ago, Jim Kelly argued before the New Orleans City Council that women ages 18 to 20 shouldn’t be allowed to work as exotic dancers…The proposed ordinance was approved…but after a recent murder case involving 19-year-old dancer Jasilas Wright, Kelly realized it was not being enforced.  In July, he returned to City Hall to put teeth into the existing ordinance…Local dancers say the ordinance shouldn’t exist at all…”Don’t tell women they can’t work a f—king job when they’re adults,” says Lilith, a 27-year-old dancer at Babe’s Cabaret who started when she was 20. “To assume we’re all victims and have no other options or are forced to be there is simply disrespectful.”  Kelly says he is trying to protect young women…

Buttons, Bags & Banknotes Zoo Weekly

Bauer Media announced that Zoo Weekly would be closing “due to tough retail conditions”.  It has been declared that its October edition will be its last…it is a victory that Collective Shout, Australia’s most vocal anti-porn campaigners, is claiming as its own.  In August…Zoo Weekly was removed from Coles’ shelves after a “successful online campaign” was waged by Collective Shout…history has shown that Collective Shout’s real problem lies with the idea of women displaying their bodies in men’s magazines…The women who appear in these magazines, often dressed in string bikinis, have done so consensually and have been paid for their work…there have been no instances where Zoo Weekly has placed a woman on their cover without that woman’s approval…

A Tale That Grew in the Telling (#419)

Americans disapprove of teaching kids about sex, but they’re all for filling their heads with stupid anti-sex propaganda:

…North Carolina Senate Bill 279 would amend state sex-education standards to require all schools teach age-appropriate info on “the threats” of sex trafficking…The bill also says school administrators must collaborate with law enforcement agents when developing or presenting this material…Training cops on sex trafficking issues is often a collaborative effort by religious nonprofits and the U.S. Justice Department (DOJ) who preach the new gospel of prostitution: that almost all women…were…forced into it and should be treated as victims; that the Internet fuels a thriving child sex-slavery trade; that “ending demand” for adult prostitution by targeting johns and using other tough-on-prostitution measures are necessary to stop children from being sold into sexual slavery; and that there’s a rampant and escalating problem with sex trafficking in the United States.  But there is no solid evidence that any of these things are true.  A DOJ-orchestrated, law-enforcement-centered sex trafficking “awareness” program for public school kids seems likely to spew the kind of fact-lite, panic-heavy propaganda that fueled school anti-drug programs like DARE…

The Course of a Disease (#423)

The Israeli journalist who wrote this article on brothels in Tel Aviv presents a much more nuanced view of sex work than one would see in the American media:

…Reports on prostitution tend to focus on exceptional cases, such as…an underage sex ring…[or] human trafficking, a phenomenon of the 1990s…They concentrate on…“notorious drug and prostitution den[s]”…[such as] the Hasan Arfa area…a warren of tin shacks and garages supposedly overrun by drug users and sex workers…[prohibitionist]  Rebecca Hughes…writes, “Most women do not choose to be prostitutes.”  The actual face of prostitution is more nuanced.  There are hundreds of brothels in Tel Aviv. Many of them operate openly, advertising their services on the street with business-sized cards scattered on sidewalks throughout the city by young men…

Innocence Never Had (#428)

Yet another attempt to cast young people as passive vegetables without agency:

On Tuesday night Sean ’Diddy’ Combs tweeted a petition asking the Associated Press to stop using the phrases “child prostitute” and “child prostitution” in their style guides and news stories.  “They are victims [and] survivors of rape,” he wrote, sharing a link to the Change.org campaign…Because the terms deal with the issue of people who are too young to consent to sex, let alone sex work, the group argues that saying “child prostitute” or “child sex worker” is both insensitive and factually inaccurate.  Instead, the group suggests that outlets refer to these children as “victims and survivors of child rape”…

No.  The number of underage sex workers who are “children” in any meaningful sense is virtually nil; the vast majority are above the age of consent, albeit below 18.  To call them “victims of child rape” is both insulting and factually inaccurate.

Imaginary Crises (#445) 

The people who profit from rape panic just won’t stop creating new bogus “studies” designed to uphold their cherished “1 in 5” myth:

More than 20 percent of female undergraduates at an array of prominent universities said this year that they were victims of sexual assault and misconduct, echoing findings elsewhere…The survey from the Association of American Universities drew responses from 150,000 students at 27 schools…Researchers acknowledged the possibility of an overstated victimization rate because there was evidence that hundreds of thousands of students who ignored the electronic questionnaire were less likely to have suffered an assault…

Here’s another hint: counting everything under “sexual assault and misconduct” as assault is the same as counting everything under “murder and assault” as murder.grumpy Gloria

The Leading Players in the Field, Not (#449)

This Indian critique of anti-whore “feminists” has especially strong words for Gloria Steinem:

…[Steinem’s] opposition to the AI proposal is based upon a rather parochial view of what sex work means to impoverished women, especially in developing countries…Since 2010 I have been engaged in ethnographic research with Durbar Mahila Samanwaya Committee (DMSC)…Steinem visited  Sonagachhi in April 2012 on a six-day “learning tour”, under the guidance of Apne Aap Women Worldwide, an anti-[sex work] organisation…She called this tour a “life changing experience” because she met several women who were…victims of unspeakable abuse.  However…In the last five years I have only met a handful of women in Sonagachhi who were trafficked.  In the initial phase of this research I gathered stories of how the women arrived in Sonagachhi and a pattern soon emerged consisting of abject poverty, abandonment, hunger, motherhood, familial responsibilities, and finally survival.  Most women told me that they arrived in Sonagachhi through a friend, a relative, or a neighbour who was either working in and/or had contacts in Sonagachhi…The women also do not necessarily see their work as “making a choice” in the classic dyad of forced into, or chose to engage in, prostitution or sex work.  Rather, it is the absence of choice and the structural barriers of poverty that lead them to sex work…

Now They Notice

In another example of how the Rentboy raid is being treated differently from the many raids on female escort sites which preceeded it, here’s an interview with a gay Rentboy client; how often have you seen interviews with the clients of female sex workers, despite their far greater numbers?

…I now enjoy my sexuality in a way  in which I don’t think would have happened unless I hired escorts.  It’s specifically because the cash makes it professional.  It’s bad customer service for him to judge me for my interests…I’m not saying he has to put up with everything I want.  In fact, there’s some things that I’ve asked for that he says not to…If he says no, then it’s no…That professionalism and that distance is profoundly helpful.  It takes me to a place where I can just enjoy sexuality.  It’s nice and clean…I see laws against prostitution as intolerant…We know from Romer v. Evans, that mere moral prohibition against something is not sufficient grounds for making a practice illegal.  In Lawrence v. Texas, for the life of me, I cannot see how Kennedy’s reasoning about an ordered liberty about private choices between consenting adults doesn’t cover prostitution.  He has that weird declaration at the end of his opinion that this case has nothing to do with prostitution.  It comes out of nowhere, he just stuck it in there to cover his ass…It strikes me as profoundly cruel for people who have more barriers to an enjoyable sex life, to just criminalize a method that works for both parties…

Don’t Confuse Us With Facts

Compare the judge’s comments about Rue to those made by Judge Himel about Melissa Farley:

…the U.S. Court of Appeals…heard oral arguments in a Texas case challenging the constitutionality of an abortion law, H.B. 2, that has shuttered half the abortion clinics in the state…Judge Catharina Haynes…questioned whether the law was medically justified…“Are we saying if you can find someone in the world to say we need marble floors in an abortion clinic, then that would be good enough to allow the Texas legislature to pass that?”…in recent abortion cases across the country, that is indeed what state attorneys are doing when they hire Vincent Rue, the pioneering junk scientist  behind “post-abortion syndrome”…Rue, discredited by courts decades ago, has since made a career as a behind-the-scenes litigation consultant…Judge Daniel Huyett found that Rue’s testimony “…is not credible…Moreover, his admitted personal opposition to abortion, even in cases of rape and incest, suggests…personal bias”…In…the Texas trial…the state was caught red-handed:  Four of the state’s five expert witnesses were forced to change their testimony on the stand when confronted with emails showing they had lied about who had written their reports…

The More the BetterBetty White nude

Recognize this young lovely?  She’s one of America’s best-loved comic actresses, Betty White, practically a symbol of wholesomeness and niceness.  And she started her career by posing nude in the early ’40s.  I can’t tell you how happy it makes me to discover this; it’s yet another refutation of the Madonna/whore dichotomy and a demonstration of the ubiquity of sex work and the fact that sex workers aren’t mostly pathetic victims.

criminally-charged drug court participants were forced into sexual activity by drug court officer Winfred Eugene Vance Jr. and…Vance’s supervisors did nothing to stop it…Vance blackmailed drug court participants into sexual activity after the participants were threatened with a false failed drug test that could lead to jail time if they did not comply…

Naked Truth

Articles from sex workers, telling the truth about sex work, continue to appear in more mainstream venues.  This one from transgender sex worker Diana Hemingway, entitled “9 Things I Learned in My First Year as a Sex Worker“, does a lot to bust stereotypes and reiterate what I say repeatedly:  sex workers aren’t intrinsically different from others, and sex work is work.

Bottleneck (#313)

This licensing law was sold as a way to “protect” women:

Saskatoon has imposed a temporary freeze on issuing adult services licences, something the operator of a local brothel says is a “very big mistake” and will force the city’s sex workers to resort to illegal and “sketchy” ways of making a living…Canada’s new prostitution laws…now make reference to “offering, providing or obtaining sexual services”…no licences will be renewed until the city determines whether it needs to change its bylaw in light of [this]…

Still a Child 

Agency denial, pimp mythologizing, ludicrous numbers and the other typical trappings are used to divert the reader’s attention from the fact that the “sex trafficked child” who is “rescued” by an “FBI Child Exploitation Task Force” in this story is 18, which the last time I checked is still a legal adult in every part of the United States.

Drawing Lines

A particularly loathsome example of a porn performer trying to pretend she isn’t a whore, because whores are degraded and disgusting and she’s pimped by big companies.  Bonus hypocrisy points: it’s well-known that, like many in her profession, she escorts on the side.

Consider this her nomination to the Hall of Shame.

Facts in the Case of Monica Jones

Monica Jones’ conviction was overturned on appeal:

Defendant-Appellant Monica Renee Jones…was convicted in Phoenix Municipal Court of manifesting an intent to commit…prostitution.  Defendant contends as follows: (1) the trial court abused its discretion in admitting evidence of her prior conviction; (2) the trial court erred in considering her potential punishment in assessing her credibility; (3) the trial court erred in not holding a jury trial; and (4) the trial court erred in holding the city code constitutional.  For the following reasons, this Court vacates the judgment of guilt…

Skewed By Taboo

Another, very thorough look at how the GSS and similar surveys are absolutely useless on sexual topics:

…One of the many reasons sex is puzzling is that we lack reliable data.  People lie to friends, lovers, doctors, surveys and themselves…[in] the General Social Survey…Heterosexual men 18 and over say that they average 63 sex acts per year, using a condom in 23 percent of them.  This adds up to more than 1.6 billion heterosexual condom uses per year.  Heterosexual women say they average 55 sex acts per year, using a condom in 16 percent of them.  This adds up to about 1.1 billion heterosexual condom uses per year…[but] fewer than 600 million condoms are sold every year…About 11 percent of women between the ages of 15 and 44 say they are sexually active, not currently pregnant and not using contraception.  Even with relatively conservative assumptions about how many times they are having sex, we would expect 10 percent to become pregnant every month.  But this would already be more than the total number of pregnancies in the United States…

Note the easy way inane arguments that prostitution magically ignores economics also work against surrogate motherhood:

Rescue industry organization abducts the children of sex workers and brainwashes them against their mothers:

Apne Aap is probably the most unscrupulous and dishonest of the many anti-whore groups in India.

“Authorities” will call it anything to avoid saying a cop raped someone:

Gingerbread House

It takes a special kind of obtuseness and cultural illiteracy to actually name your disguised prison “Gingerbread House”:

[Sex] trafficking of children…is a growing problem around the world.  Thirty-five local kids that entered the Gingerbread House last year are victims or potential victims of trafficking.  Caddo Parish…is handling 13 red flag cases where trafficking may be a factor….Shobana Powell…says…sex trafficking…is…”not this highly organized crime that you see in the movies”…

It’s interesting, however, that even some rescue industry people are now moving away from the myth of international “trafficking rings”.

The Widening Gyre (TW3 #30) Somaly protest

Another example of the effectiveness of disruptive protests:

On Sunday 15 June…Traffic Jam, an Internet based anti-trafficking organisation…[linked to] the American…A 21 Campaign (A21) , attempted to launch their new website in…Sydney…To the surprise and ill-disguised antipathy of the organisers, a group of sex worker activists…gatecrashed the event, refusing to pay the AUD $25 entrance fee, and demanded stage time to speak to the audience about trafficking issues.  The protesters carried placards referring to the recent [exposure] of Somaly Mam…once migrant sex workers and their allies took the stage, their interactions and exchanges with the audience seemed to far out-weigh any of the previous engagement the audience had with the anti-trafficking speakers…[and] the…take-over of the stage outlasted the initial time allotted to the Traffic Jam event…

Checklist

Another pathological-liar cop (pardon the redundancy) spouting ridiculous “signs of sex trafficking”:

Every two minutes, a child is exploited in the sex industry…and Portland has one of the highest…rates…[cop] Mike Gallagher has personally talked with more than 2000 sex trafficking victims…He and others…held a conference to instruct people on the signs of a sex trafficker.  “Things like paying with a prepaid Visa or cash at check in”…Traffickers are often proud of their work and often sport tattoos alluding to it…

Traffic Jam (TW3 #318)

Ugly Mugs…by Peta Brady…is…based on confidential accounts of assaults…given by sex workers for inclusion in the Ugly Mugs  publication (closed, for distribution only to sex workers)…this represents both a breach of trust and an alarming low point in exploitation of sex workers through “pity porn”…Concerns were promptly raised with both hosts of the play – Malthouse Theatre and Griffin – neither were willing to accept sex workers concerns.  Instead we were offered free tickets…presumably because seeing your rape played out live…always makes you feel better…

It looks as though Brady, a Salvation Army worker, used her status as a social worker to steal a copy of Ugly Mugs from an ally’s office in order to use it for her own purposes.

Still a Child undeveloped brain

On July 25, FIRE President Greg Lukianoff testified before the United States Commission on Civil Rights…Commissioner Michael Yaki asked Greg…whether college students’ brains are sufficiently developed to handle freedom of speech…The following is Greg’s answer…”What we’re really saying is that 18- to 22-year-olds are children…[who] can’t handle the real world…[or] the duties of citizenship…we have decided in this country that 18…is considered the age for majority.  We also send our 18-year-olds to war.  Unless you’re actually also willing to make the argument that nobody below the age of…22 should go to war, and we repealed the 26th Amendment, we’ve got a serious problem…

Race to the Bottom

Sex workers in Seattle are trying to fight the anti-whore madness that’s now epidemic there:

Seattle Against Slavery would have us believe that anyone who patronizes a sex worker is guilty of exploiting a victim of human trafficking.  But only a tiny percentage of sex workers are trafficked…Seattle Against Slavery is…partnering with “members of the law enforcement community” to [spread lies]…despite the fact that “criminalization [of sex work] and aggressive policing have been shown to increase sex workers’ vulnerability to violence, extortion, and health risks“…

Shift in the Wind (TW3 #404)

Another respected policy magazine calls for decriminalization, this time The Economist:

…This newspaper has never found it plausible that all prostitutes are victims.  That fiction is becoming harder to sustain as much of the buying and selling of sex moves online.  Personal websites mean prostitutes can market themselves and build their brands.  Review sites bring trustworthy customer feedback to the commercial-sex trade…the web will do more to make prostitution safer than any law has ever done…Governments should…rethink their policies.  Prohibition, whether partial or total, has been a predictable dud.  It has singularly failed to stamp out the sex trade…

Here’s a superb essay from recently-retired stripper Zoee Garza on the “Cupcake Girls” and their patronizing “ministry” to sex workers:

Melissa Gira Grant on the increasing desperation of prohibitionists:

I’ve written before about Equality Now (in Jacobin, and in Reason)…[who] deny that anyone involved in the sex trade dissents with their approach.  Lately their op-eds have turned explicitly against sex workers’ rights, which makes sense, as the past two years have seen the mainstream of the global health and human rights  community joining sex workers in calling for an end to…criminalization…Equality Now appear to be losing credibility as human rights advocates…As more and more…advocates…demand…that sex workers be understood as the experts…the anti-sex work campaigners begin to look quite out of step with the…people they claim to protect…

Lauren Hersh, who wrote the op-ed to which Grant refers, was a prosecutor who resigned in disgrace after she was caught railroading two black men on rape charges.  Grant also commented on a Scott Long article which examines Equality Now’s lies and schemes at great length, ending with this bombshell:

…The Milano School of International Affairs, Management, and Urban Policy is offering a practicum for students…in a project for Equality Now.  “This project would analyze the legalization of prostitution and formation of sex workers’ rights groups…Equality Now seeks to better understand the movement…in order to refute arguments for legalization and lobby for adoption of the Nordic Model instead”…

In other words, Equality Now is paying a prestigious institution to spy on sex workers so as to help it create fake sex worker rights organizations which will lobby for the Swedish model, thus confusing politicians and others into thinking there is legitimate debate among sex workers about decriminalization being best.  The strategy itself is nothing new; it’s why Swedish model missionaries often deceptively and incorrectly label it “decriminalization”.  But that they are willing to go to this extent demonstrates the depth of their desperation, and the fact that the school took down the page as soon as they realized activists had found it (but not before Melissa got this screenshot) shows that they are fully aware of how incredibly unethical this is.

Still a Child

The UK is moving toward defining people in their early twenties as “children”:

…Child psychologists are being given a new directive…that the age range they work with is increasing from 0-18 to 0-25…the change follows developments in our understanding of emotional maturity, hormonal development and particularly brain activity…There are three stages of adolescence – early adolescence from 12-14 years, middle adolescence from 15-17 years and late adolescence from 18 years and over.  Neuroscience has shown that a young person’s cognitive development continues into this later stage and that their emotional maturity, self-image and judgement will be affected…

Keep in mind that since “adolescence” is largely an artificial concept, dividing it into periods like this is equally artificial.  But at least someone with sense is quoted in the article:

Frank Furedi, professor of sociology at the University of Kent, says we have infantilised young people…”There is a loss of the aspiration for independence…and…psychology…reinforces that kind of passivity and powerlessness and immaturity and normalises that…we hold our children back from a very early age.  When they’re 11, 12, 13 we don’t let them out on their own.  When they’re 14, 15, we hover all over them and insulate them from real-life experience.  We treat university students the way we used to treat school pupils”…

Another excellent article by evolutionary psychologist Peter Gray explains that one of the biggest culprits is the eradication of unsupervised play:

…around 1960…adults began…reducing children’s freedom to play on their own…Adult-directed sports…began to replace “pickup” games; adult-directed [activities]…began to replace hobbies; and parents’ fears led them…to forbid children from going out to play…away from home, unsupervised…Over the same decades…[there has been] a continuous…increase in anxiety and depression in young people…the suicide rate…has more than doubled, and…[there has been] a decline in empathy and a rise in narcissism…[which is] exactly what we would expect to see in children who have little opportunity to play socially.  Children can’t learn these social skills…in school, [which] is an authoritarian…setting…[where] children…are not free to quit when others fail to respect their needs and wishes…Yet policymakers…are continuing to push us in the opposite direction — toward more schooling…more adult direction…and less opportunity for free play…

Petite JasmineA Swedish sex worker rights activist was stabbed to death by her ex-husband on Thursday.  Swedish “feminists” pretend to care so very much for sex workers that they’re willing to destroy our lives to “save” us from imaginary “degradation”; selling sex is not illegal, but if a sex worker dares to speak openly about her choice she will be punished in many ways other than imprisonment, such as by expulsion, eviction, police harassment and more:

Several years ago she lost custody of her children as she was considered to be an unfit parent due to being a sex worker.  The children were placed with their father regardless of him being abusive towards Jasmine.  They told her she didn’t know what was good for her and that she was “romantisizing” prostitution, they said she lacked insight and didn’t realise sex work was a form of self-harm.  He threatened and stalked her on numerous occasions, she was never offered any protection…

Activist Jemima pointed out that “Jasmine could have been listened too, could have had custody of her kids, could have been flying off to international conferences and doing TV shows, instead of being prepared for burial, all she had to do was lie…be good little puppets who trot out the party line like defendants at a Stalin era Russian show trial and then the doors of rape crisis centers, domestic refuges and conferences open wide to you…

Another Example of Swedish “Feminism”

This was a real banner week for Swedish “feminists”; besides enabling the murder of a sex worker, we also got this:

A professor in law at Stockholm University has called for legislation prohibiting parents from drinking alcohol in the company of their children.  “It is a parent’s responsibility to be sober when they are with their children,” said Professor Madeleine Leijonhufvud…She compared the offence to minor assault which…carries a penalty of up to six months imprisonment.  While the proposal is aimed at “everyday drunkenness” it in effect suggests that parents would not be able to share a glass of wine at dinner.  “If you have a sick child and need to drive them to hospital then you can’t drink wine”…

Perhaps Sweden should just confiscate all children at birth and raise them in crèches?  But then, of course, people would stop having them.  And the feminists want even criticism of their tyrannical insanity to be criminal: “the Nordic Council of Ministers…[suggested]…the government…take action against…‘anti-feminist attitudes’…expressed in public…Heavy Hand of Justice by Kevin Moore

A 15-year-old Florida girl was arrested…for shooting and possessing a photo of another teen girl engaged in oral sex with a teen boy…She was charged with a felony child porn count.  “The two girls were friends, and one of them was dating the guy,” Detective William Lindsey [said]…”Possession of child pornography is [a crime] no matter what age they are… If she had taken a picture of herself in sexual conduct, she could be charged with child pornography”…

Wholesale Hypocrisy (TW3 #25)

The rather dull-witted and credulous Bonnie Erbe seems to genuinely believe in mathematically and sociologically impossible nonsense, but more shocking is her support for censorship despite her pretense of being a journalist:

…The Internet…provides an almost unfettered platform for…pimps to find, track and enslave girls and women in sex trafficking…local and federal authorities seem powerless to ban the sale of commercial sex online.  Nor do they seem able to keep up with and control the horrendous amount of trafficking the Internet generates…experts point mainly to laws that predate the Internet and define places where criminal commercial sex acts take places as “houses of prostitution” or “brothels.”  Today, no such places exist.  Pimps — mainly men — find customers online and direct them to meet prostitutes, who work out of different motels or apartments or sometimes even their own homes…[in] a New Mexico case…two men…were [cleared of] running “an extensive multistate, online prostitution ring”…after a judge ruled that…their website did not constitute a house of prostitution, though it was used to recruit prostitutes and promote prostitution…It would seem easy to amend anti-prostitution laws to include a ban on websites for procuring commercial sex…

Because when governments ban things, they magically vanish!

Shift in the Wind

Those who were surprised at seeing an anti-criminalization article in The National Review must not remember that A) many “conservatives” at least claim to be for smaller government, and B) the magazine’s founder, William F. Buckley, was a vocal opponent of drug criminalization.

…the proscription of prostitution…continues to be a mystery to me.  Sex remains one of the few things that a free person may give away gratis but which he is forbidden from selling.  It is perfectly legal to sleep around in the United States — subsidized and panegyrized, even — and, as the growing parade of octogenarian billionaires’ wives demonstrates, it is both permissible and socially acceptable to sleep with someone in pursuit of regular material comfort…While the laws surrounding the issue remain such a dizzy and irrational mess, drawing a clear moral line through the morass remains nigh on impossible…To broach this topic in polite company is to invite someone…to parrot the banal old line that “nobody grows up wanting to be a prostitute.”  At best, this is a red herring.  Certainly, few people grow up wishing to be prostitutes.  But there are an awful lot of careers that escape the dreams of children…It is no accident that prostitution, which was almost uniformly legal in the United States from the period of colonization up until the start of the 20th century, was banned in almost every state within the same five-year period during which the Woman’s Christian Temperance Union managed to convince the nation that alcohol should be constitutionally outlawed…

Politicians are usually forgiven; those whose lives they destroy, not so much.

In other words, the nuns abducted children from their Irish mothers and sold them to Americans; if that’s not “human trafficking”, I don’t know what is.Laetitia Rebord

The New York Times seems unable to write about sex work without dysphemisms like “so-called”:

…in France…disabled people struggle to have a sex life.  But their desires are often disregarded, and while prostitution is legal here, soliciting potential clients and serving as an intermediary between prostitutes and clients are not.  The issue of sexual surrogates came up in March, after the National Ethics Committee…issued a report criticizing the practice as the “unethical use of the human body for commercial purposes”…but…some legislators and associations of disabled people are demanding the legalization of sexual surrogates.  “Prostitution is a fake debate; the goals are different,” said Pascale Ribes…[of] the Disabilities and Sexualities Group, an association defending sexual surrogates in France.  “Sexual assistance is about allowing a disabled person who can’t access sexuality in a satisfying way to reconnect with the body”…

Advice to disabilities advocates: foolish reinforcement of whorearchy is not the way to go about winning your right to employ sex workers.

Flush Criminalization

More sophomoric “humor” from New York “authorities” working assiduously to destroy as many people’s lives as possible:

Police shut down…12 massage parlors…for alleged prostitution…arresting owners, managers and workers.  The Brooklyn District Attorney’s office is investigating whether workers were “victims of human trafficking, being manipulated or held against their will”…and whether a central organization was controlling…the operations.  According to DA Charles Hynes, all of the women…gave very similar stories about having children in Asia they needed to support.  NYPD Commissioner was typically…tone-deaf in his assessment of the case.  “We know people in Bay Ridge have back pain…but we don’t think that’s enough to sustain 19 massage parlors”…

That the DA seems to perceive the fantasy of a huge “sex trafficking” conspiracy as more credible than the simple fact that most sex workers have children to support, speaks volumes about his warped view of humanity.

Still a Child

This is no more ridiculous than defining a minimum age above that of majority for any other legal activity, such as drinking or sex work:  “Somalia…has set the minimum age at 40 for anyone intending to practice as a journalist in the country…

A few months ago, when Amsterdam raised the legal age for prostitution from 18 to 21, one sex worker commented that this was a good idea because a woman of 18 is “still a child”.  Now, I’m not going to rehash the obvious arguments which made the rounds when the prohibitionist fad of raising the legal drinking age to 21 seized America like some kind of suicidal mania; nor will I point out that any sane and reasonable person must recognize that selecting leaders, driving a car, getting married and joining the military all have more serious effects on both the individual and society as a whole than the specific reasons one might choose to have sex; nor explain that narrowing a legal bottleneck invariably results in more people doing whatever-it-is illegally (except insofar as I just mentioned them).  Instead, I’d like to briefly consider this bizarre legal fiction that a person capable of reproduction can nonetheless be a “child” in any meaningful way, and to wonder how far this trend can go before it collapses into complete absurdity.

The delusion that some adults are actually children is a fairly recent one, dating back only to late 19th century.  In “The Shape of the Spoon” I quoted psychologist Robert Epstein on why it’s so spectacularly stupid and destructive:

Billy Batson becomes Captain MarvelI’m not saying that young people should be given adult responsibilities at about 13 as they once were, and I certainly don’t think Epstein is either; what I am saying is that referring to teenagers as “children” and pretending that label represents anything other than a legal fiction is not only counterproductive and generative of psychopathology, but also inevitably gives rise to the evil absurdities I regularly mock by comparing them to young Billy Batson turning instantly into a super-powered adult with the magic word “Shazam!”  The idea that equal-to-four-year-olds suddenly become equal-to-forty-year-olds at a mystic ritual moment is idiotic in every respect, but nowhere is it more ridiculous than in the area of sex:  “…it is the hormones of puberty that drive young people to have sex, not knowledge or culturally-induced ‘sexualization’, yet Americans are committed to the self-destructive delusion that if we keep teens in ignorance about sex they’ll stay ‘innocent’ and never think of having it themselves…”  That quote is from “Too Young To Know”, wherein I address the issue of prostitution by legal minors:

There is no material difference between sex for compensation and sex for social reasons except that those who fall into the latter are less likely to use condoms or good judgment.  So, the state needs to pick an age of consent and stick to it, thus eliminating criminalization of motives for having sex.  This is not to say that the state shouldn’t set some higher age at which a brothel or escort service can legally hire a girl, as long as the state recognizes that doing so means that the only sex work an underage teen can do will be on the street, and that the law isn’t going to stop her if that’s what she intends to do…

But obviously the rulers of Amsterdam are far wiser than some sex-addled harlot, and obviously have some foolproof magical means of absolutely preventing women below 21 from working, just as they effectively stop every single “illegal” whore from doing so now.

Ahem.

Anyhow, is there actually any factual basis to the notion that some biological adults are somehow childlike in any way that could be reasonably declared a valid cause for restricting their rights to some degree?  Well, kind of, but not in any sense where the numbers 18 or 21 would be significant.  A lot of brain research suggests the frontal lobes aren’t fully mature until about 25, so maybe we should prohibit university-age people from voting, drinking, marrying or doing meaningful work (most especially enlisting in the military).  But still other research suggests the brain isn’t fully mature until the 30s or even 40s, so perhaps we had better declare anyone below 40 “still a child”.  Or maybe that should only apply to men; a recent highly-publicized “study” by television network Nickelodeon (which I’m sure was conducted with unimpeachably-rigorous scientific methodology) trumpeted that while women mature at 32, men don’t do so until 43.  Obviously, we need to declare people younger than those ages “juveniles”, restrict their sexual and labor choices and try them in special juvenile courts.

teens in diapersThe fact of the matter is, the brain keeps changing throughout life; while it’s getting more powerful in some respects it’s weakening in others, and any increase in maturity after 30 is offset by a loss of adaptability and plasticity.  It is the height of fatuity to declare that the rights of some biological adults  should be restricted due to incomplete brain development, because some fail to attain by 50 the cognitive abilities others have at 15.  The only fair measure of adult competence is experience, and the only way to gain that experience is by doing; that cannot be accomplished in a playpen.  Perhaps we need to return to the medieval practice of dividing growth into thirds: people are given some limited responsibilities at 7, assume self-governance at 14 and take on full citizenship at 21.  But however we divide it, one thing is clear: only an imbecile equates a person of 16 with one of 12 or 6, and no law grounded in such imbecility is worthy of obedience or even serious consideration.
