Only Rights Can Stop the Wrongs (#728)

When it comes to sex work, authoritarians want to have their cake and eat it, too:

Yaroslav Zhelezniak, deputy chairman of the Ukrainian Parliament’s finance committee, is leading a push to ditch…outdated Soviet-era legislation that bans the possession, production and distribution of pornography.  Doing so…would remedy…an unfair contradiction.  Violations of Ukraine’s laws on pornography…are punishable by three to five years in prison.  But Ukraine’s financial authorities have been collecting taxes from creators on websites…like OnlyFans…“It’s absurd,” Mr. Zhelezniak said, especially “in the midst of a full-scale war.”  He also sees another benefit for Ukraine…it would increase tax revenue…since more pornography creators would be willing to declare their earnings — a boost for an economy struggling under the demands of a war that has ground on for over three years…

The Puritan Recrudescence (#1455)

The currently-fashionable “monkey see, monkey do” parade has escaped the US and is careening all over Europe:

France has introduced a law that will require adult websites to run comprehensive age checks [in the name of] prevent[ing] minors from accessing pornographic content…France’s [censorship agency] ARCOM has been tasked with implementing a standard known as double anonymity.  This is [purport]ed to allow a site to verify a user’s age without knowing their identity…ARCOM [lied that] the system “strikes a careful balance between safeguarding children and respecting the privacy of adults”.  PornHub owner Aylo, which also owns YouPorn and RedTube, is already challenging the French law in court…[as] in other parts of the world, web users will be able to bypass any age checks by [us]ing…a…VPN

Shame, Shame (#1514)

Still think realistic porn cartoons are the worst use for this technology?

American police departments…are paying hundreds of thousands of dollars for…technology that uses [computer]-generated online personas designed to interact with and [spy] on “college protesters,” “radicalized” political activists, and s[ex workers or their clients]…Massive Blue, [a] New York-based company…calls its product Overwatch, which it markets [with a typical collection of buzzwords including]…“AI-powered”…”public safety”…“infiltrate…criminal networks”…“border security,” “school safety,” and stopping “human trafficking”…some of these AI characters…include a “radicalized AI” “protest persona”…a “‘Honeypot’ AI Persona”…a 14 year-old boy “child trafficking AI persona,” an “AI pimp persona,” “college protestor” [sic], “external recruiter for protests,” “escorts,” and “juveniles”…cops are…deploy[ing…chat]bots across social media…with the hopes of [destroying people’s lives]…

The Cop Myth (#1529)

When a cop tries to pass murder off as suicide, the victim is usually his wife or girlfriend:

A [typical and representative Mississippi cop named James Durwood Winstead] has been arrested and charged with capital murder [for shooting]…a man…[named] Timothy Byrd [and trying to make it look like suicide.  But his story included]…several discrepancies…[with the] evidence…[so he] was arrested and charged…

The Administrative Court in Düsseldorf is set to decide on the future of online pornography in Germany…The North Rhine-Westphalia State Media Authority (LfM)…demands that pornographic sites meticulously verify the age of all visitors…or…face network blocking.  The operators of the world’s largest porn sites…don’t want to harass their millions of visitors with ID checks…Pornhub and YouPorn, both owned by Aylo…refuse to [spy on visitors thus, so LfM]…demanded that Germany’s largest internet providers block their websites…However, most porn fans are unlikely to have noticed this, as the affected porn sites simply changed their domains.  Pornhub is…accessible at “de.pornhub.org”; the…block only applied to “de.pornhub.com”…In addition, users can easily circumvent a network block…with…a VPN…Two cases before the Düsseldorf Administrative Court revolve around the question of whether the blocking orders issued by the media regulator are even [legal]…

The Last Shall Be First (#1244)

Another disgusting genital inspection law:

…the West Virginia Legislature passed a bill that would allow health care providers to “visually or physically examine a minor”…for the purpose of identifying their “biological sex” without the “consent of the [minor]’s parent, guardian, or custodian.”  The bill, S.B. 456, would define sex based on whether a person produces eggs or sperm…[and limits]  gender-segregated spaces like locker rooms or restrooms…to…a person’s sex…at birth…an amendment…[restricted the “right” to violate a minor against their will to their] “treating health care provider”…[which] was actually an improvement over a previous version of the bill, which…would have allowed teachers to perform the [molest]ations…

In the authoritarian mind,  for students to voluntarily allow other people to examine their genitalia for the purpose of pleasure is a “crime”, but for the same students to be forced by law to allow strangers to examine their genitalia for the purpose of bigotry is “protection”.

Eavesdropping (#1379)

Remember, Amazon eagerly hands data from internet-connected devices to cops:

Well, you’re going to see what happens to you”…

The Notorious Badge (#1519)

Bill Maher…took some time during his “New Rules” segment to exclaim, “Whores are having a moment…You gotta give me more than a week to get used to a new word or phrase or name for what we call something…We did this with homeless until it was unhoused. We did this with illegal alien until it was undocumented migrant…And now we’re doing it with prostitute…If it’s such an important liberal cause…why didn’t you do it 10 years ago or 20 or in 1975?”…

Choke Point (#839) 

A rare good decision from the current SCOTUS:

…all nine Supreme Court justices found in favor of the NRA…because the behavior of New York State, to try to silence the NRA by threatening third parties, was so constitutionally alarming.  If New York could get away with doing what it had done, and threaten a speaker’s business relationships as a means of punishing the speaker, then so could any other state against any other speaker, including those who might be trying to speak out against the NRA…[or] those at odds with…the preferred policies of states like Texas and Florida…This decision is not the first time that courts have said no to this sort of siege warfare state officials have tried to wage against speakers they don’t like, to cut them off from relationships the speakers depend on when they can’t attack the speakers directly…

Choke Point (#1190) 

Can you even imagine this happening in the US?

A Melbourne-based gay sex worker has resolved a discrimination case against two Australian financial service providers, in a “great victory” that he wants to protect others from falling victim to “debanking”…Matthew Roberts…was debanked and denied a…[credit card processing] machine…[after] finance company Mint Payments…switched the institution it used for transactions…and the company asked him to reapply for [the] machine [he had been using for years]…he dealt with company honestly, disclosing his occupation.  But his application was denied…[because] his business was within “a restricted category”…But that…was…after Victoria decriminalised sex work…[making it] illegal to discriminate against someone on the basis of their profession, trade or occupation…Matthew took the companies to court in June last year…and…the case was settled out of court confidentially late last year.  Matthew went public [last] week and said he received no money from the legal action…[but] the two [offending] companies agreed to not restrict services offered to people engaged in lawful sex work…

Opting Out (#1268)

Twitter shifts to an opt-in model:

[Twitter] now officially allows pornographic content…but says it will block adult and violent posts from being seen by users who are under 18 or who do not opt-in to see it.  The…new policies…come as [cens]or pressure grows for platforms around the world to…[censor content by shouting “The] children[!!!!!!” at]…social media [companies].  Historically…Twitter…has not prevented people posting adult content…[but] users who [do so]…have now been asked…to adjust media settings so that their images and videos are put behind a content warning…Users under 18 or those who do not put a birthdate in their profile will be unable to view this content…Similar rules have been put in place for violent content

This appears to be an attempt to head off the nitwit parade led by authoritarians in various US states, Canada, the U.K., France, Germany, and Russia.

When Ambulance-Chasers Run the Hospitals (#1382)

The claims in these nuisance lawsuits are increasingly absurd:

The state of Utah has filed another lawsuit against…TikTok…[fantasiz]ing the video app “created a virtual strip club” that allowed young people to be sexually exploited in exchange for money that TikTok takes a cut of.  The lawsuit [was] filed…by the Utah Division of Consumer Protection, a[n increasingly-popular angle that allows authoritarian governments to circumvent due process]…the…lawsuit also [imagines]…that TikTok LIVE’s virtual currency could allow criminals to host illegal gambling, sell drugs and fund terrorist activities…The state…is also suing…Facebook…[over imaginary “]harm to the mental health of Utah youth[” and]…has passed bills [attack]ing…social platformsprompt[ing] a coalition of…companies…[and a group of] content creators [to sue over]…the state’s [egregious 1st Amendment violations]

Creepy Coppers (#1437)

It’s too bad cops don’t spend all their time policing their own gang:

A [typical and representative Missouri cop named]…David K. Blankenship…and his wife Karlie Blankenship…[have been] charged with…attempt[ing to find] a child [they could use to make child porn after] David Blankenship…uploaded a [similar] video [to] TikTok [and the upload was reported by TikTok]…David and…Karlie…were having “sexually themed conversations” via TikTok direct message, shared videos of young girls they found attractive and discussed their sexual desires involving children under 14 and “how to locate children that are local”…Another search warrant [executed] at Blankenship’s…home found additional evidence…

Free advice: if your sexual fantasies involve anything that would be illegal in real life, don’t share them in writing, especially not electronically.

You Were Warned (#1438)

Wins against censors are increasingly rare these days:

The real fight for free speech…means being willing to stand up to extremist authoritarian bullies, even when the odds are stacked against you.  Challenging regimes where a single satirical post, a meme, or a critical blog can put someone behind bars requires bravery.  But sometimes people have to fight, because it’s the right thing to do…The notoriously thin-skinned authoritarian Turkish President Recep Tayyip Erdogan has sued thousands of people for the crime of “insulting” him (or comparing him to Gollum).  He has jailed journalists for criticizing his government and claims that social media…is a “threat to democracy” for allowing his critics to speak…the makers of WordPress, Automattic…fought back…[un]like…Twitter…after a [2015] demand to remove a critical blog…basically a decade later it has prevailed…this is a rare and surprising outcome.  Turkish courts have rejected similar attempts by the company, but the company hasn’t stopped fighting these fights…It’s especially notable that the main law Turkey relies on for this broad censorship was directly modeled on similar “internet regulations” in Europe (especially Germany’s NetzDG law, which partially inspired the DSA across the EU)…

Dirty Amateurs

Why are amateurs so damned averse to using condoms?

…Calmara claims to use AI to screen photos uploaded by users for STIs.  They want you to open their website, take a picture of your partner’s genitals before having sex, and upload it to their database so that a…[computer] can review it and scan for 10+ “conditions” including herpes, syphilis, and HPV.  Buried in the Q&A section…Calmara makes it clear-ish that they cannot actually diagnose anyone with any STI, the AI only “works” for penises, and you should really just go to a doctor for an accurate STI test.  But you wouldn’t glean any of that from their cocky Instagram or glossy imagery.  “No cap, just facts,” the copy reads beneath an illustration of a dancing robot.  “Up to 90% accuracy, our AI is grounded in real science.”  Uh… sure…the service is so misguided that it’s easy to dismiss it as satire.  But…Calmara is…not satire, and available to download right now…their…own fine print says, “These offerings should not be used as substitutes for professional medical advice, diagnosis, treatment, or management of any disease or condition.”  So what is this service for?  Literally why does it exist when it cannot provide the service it advertises?…

Moral Climate

Never make the mistake of thinking the current zeal for library censorship is limited to either the US or the so-called “right wing”:

Cathy Simpson, the CEO of the Niagara-on-the-Lake Public Library, [h]as [been] fired…[because the board dislikes a group she quoted in] an op-ed column published by The Lake Report.  The Feb. 22 opinion piece, “Censorship and what we are allowed to read”…drew strong criticism from a few…over its promotion of some of the principles espoused by the Foundation Against Intolerance and Racism (FAIR)…[regarding] “hidden library censorship,” which she said takes two forms — “the vigorous defence of books promoting diversity of identity, but little to no defence of books promoting diversity of viewpoint, and the purchase of books promoting ‘progressive’ ideas over ‘traditional’ ideas”…[library board chair Daryl Novak tacitly admitted that Simpson was fired purely due to the] content related to FAIR, [because] “the balance of (Simpson’s) article, you can’t really criticize”…

Censorship Ascendant

Censors are now pretending ideas they don’t like constitute a “crime”:

Police Scotland…will in[timid]ate actors and comedians if a…[wannabe censor points at them and croaks the magic words] “threatening and abusive” [because] under the Hate Crime and Public Order (Scotland) [Law, the taboo magic] can be communicated “through public performance of a play”…the Assistant Chief Constable responsible for overseeing the implementation of the controversial legislation has [washed his hands of it] after just a year in the post…Police Scotland has [threaten]ed that it will investigate every [incident, no matter how trivial, reported as a “]hate crime[“]…despite the force adopting a “proportionate response” approach to [actual] crimes…there [h]as [been] an outcry from artists…[pointing out] that in the past shows ha[ve] been picketed by organisations trying to get them shut down and warn[ing] that “putting theatre in its own category makes it a target”…

I Can’t Breathe (#1329)

It’s about time cops stopped being allowed to cover up their murders so easily:

The Colorado Senate [has] pass[ed] legislation that would bar the term “excited delirium” from use by [cops and medical examiners.  If signed by]…Governor Jared Polis…it would bar the term [or any of its synonyms] from being used in [cop] training or incident reports, or from being listed as a cause of death on a death certificate…Prominent medical organizations have urged [cops and medical] professionals to not use the [pseudoscientific] term…[whose sole purpose is] to justify injury or death to individuals [attacked and restrained by] police…

Thought Control (#1345)

Some censors are so mentally ill they feel threatened by the sexuality of trees:

The Floyd County (Va.) Public Schools have suspended a…community reading of Katherine Applegate’s Wishtree following complaints that the middle-grade novel depicts a monoecious red oak, a tree with reproductive parts that can pollinate and flower simultaneously.  In the book, originally published in 2017, the tree claims an identity that is “both” female and male and responds to diverse pronouns:  “Call me she.  Call me he.  Anything will work”…[wannabe censor] Jodi Farmer…took to Facebook to [warn] Floyd County residents about the [terrifying] reference to…[vegetable biology], calling the book “indoctrination at its finest”…

Apparently, Farmer imagines these scary, scary words will bewitch her children into transkingdomism.

The Next Target (#1371)

Rather than actually filing a lawsuit against Mastercard for its discriminatory policies against sex workers (which would cost them actual money), ACLU prefers to Tweet, to dilly-dally with complaints to the FTC (a bureau of a government which actively persecutes sex workers and encourages corporations to do the same), and now to file a petition which I can’t imagine will prove to be any more effective than its other slacktivist efforts.  Given the wording of the petition and the website page it’s included in, this seems more like an exercise in virtue-signaling than an actual effort to right an injustice, but I reckon it can’t actually hurt you to sign it.

Texas prefers a more piecemeal version of its fashionable mob-rule approach:

More than a year after Roe v. Wade was overturned, many [authoritarian]s have grown frustrated by the number of people able to circumvent [totalitarian] laws — with some [wannabe tyrants] grasping for even [more draconian and unconstitutional] measures they hope will fully eradicate abortion nationwide.  That frustration is driving a new strategy in…cities and counties across Texas.  Designed by the architects of the state’s “heartbeat” ban that took effect months before Roe fell, [these] ordinances…[criminalize] transport[ing] anyone to get an abortion on roads within the city or county limits.  The laws [encourage and enable] any private citizen to sue a person or organization they [decide to accuse] of violating the ordinance.  [Prohibitionist fanatics] behind the measure are targeting regions along interstates and in areas with airports, with the [impossible and deranged] goal of blocking off the main arteries out of Texas and keeping pregnant women [trapp]ed within the confines of their…state.  These provisions have already passed in two counties and two cities, creating legal risk for those traveling on major highways including Interstate 20 and Route 84, which head toward New Mexico, where abortion remains legal and new clinics have opened to accommodate Texas women.  Several more jurisdictions are expected to vote on the measure in the coming weeks…

The Punitive Mindset (#1288) 

I’ve linked a number of articles about D&D in prison under this tag, but I’ve never before read one that actually brought tears to my eyes.  Journalist Keri Blakinger worked on this story about men playing the game on Texas’ death row for The Marshall Project for several years, so it seems to me only fair that anyone who cares about humanity should at least spend a few minutes reading it in its entirety.

Politicians don’t even try to make their new laws Constitutional any more:

…the U.S. District Court for the Western District of Arkansas has halted enforcement of an Arkansas age verification law that…bans minors from using social media platforms…unless they prove they have parental consent…all social media users—including adults…would be forced to turn over official IDs in order to speak or access information online…the state [absurdly] suggested that all of social media should be treated like “a bar” for purposes of excluding minors…[Judge Timothy] Brooks [wrote]…”minors have no constitutional right to consume alcohol…By contrast, the primary purpose of a social media platform is to engage in speech, and…social media platforms contain vast amounts of constitutionally protected speech for both adults and minors…it is likely that many adults who otherwise would be interested in [using]…social media platforms will be deterred—and their speech chilled—as a result of the age verification requirements, which…will likely require them to upload official government documents and submit to biometric scans”…

Torture Chamber (#1346)

Americans’ sick lust for torture is turning ordinary prison sentences into death sentences:

As brutal heat waves continue to engulf large sections of the country, hundreds of thousands of prisoners are being forced to endure deadly temperatures inside heat-retaining steel or concrete facilities that offer little, if any, access to air conditioning or circulation…Despite its notoriously hot summers, Texas is one of at least 44 states that does not offer universal air conditioning in its prisons…70 percent of units in its prisons are entirely or partially uncooled…this year…dozens of incarcerated people have died due to cardiac-related or unknown causes in sweltering Texas prisons…[but] state officials [simply lie]…Texas…has not officially classified a prison death as heat-related since 2012, even as research has shown that intense heat is associated with an increased risk of mortality behind bars, including due to heart disease and suicide…[instead,] Texas…prison commissaries…raised the price of bottled water by 50 percent as temperatures spiked in June…

Texas Jail Project…[h]as [collected hundreds of]…stories of medical neglect and abuse during pregnancy in county jails…We started bringing these stories and impacted community members to the quarterly meetings of the Texas Commission on Jail Standards…[where] we were mocked and brushed off by the commissioners and sheriffs as indulging in “mama drama”.  This kind of dismissive response continued at the county commissioner’s court as well…a sheriff once alleged that we were making up these horror stories of pregnant women being neglected, miscarrying, and giving birth alone on dirty cell floors because “we don’t really have that many pregnant women in our jails”…[in reality] pregnant [women]…were rendered invisible in an already opaque system designed primarily by men, for men…The first successful bill we advocated for in 2009…mandated that jails [keep] count…[which showed that]…300 to 500 pregnant…[women] are booked monthly into Texas county jails…

Not mentioned in this article: the chief architect of the laws that resulted in this huge explosion in the number of female prisoners now resides in the White House.

To Molest and Rape (#1317)

Hey, female cops; how’s that collaboration with the police state working out?

A NYPD captain allegedly sent [dick pics] to a female detective and offered her favors if she would send him her panties, during a “relentless” 18 months of sexual harassment…Brian Flynn…sent more than 45…inappropriate photos and messages to…Michelle Almanzar…and retaliated against her when she spurned his advances…by making her stay late and redo reports and denied her personal time off…”he would often take his frustration out on her work partner as well as her team,” [her] lawsuit [explain]s…

Sleeping with cops is a bad idea even for other cops:

Ammy Ventura…a…civilian [NYPD] employee…[foolishly submitted to the advances of] her supervisor, Widler Lucas…[who claimed] he was…going through a divorce at the same time she was…The pair then started dating in April 2021, with Ventura believing Lucas was divorced…They broke up around September 2021, after…Lucas [started behaving abusively]…Nine months after the pair’s break up, during a shift in August 2022, Lucas…grabbed Ventura by her hair, pulled her behind his desk and forced her to give him oral sex while his office door was wide open…Lucas [later] told Ventura never to speak about the affair, saying, “I’ll fucking kill you” and threatening to “push [her] in front of a train”…

The Last Shall Be First (#1319) 

Both sides in the culture war have completely taken leave of their senses:

The Missouri attorney general, citing a consumer protection law normally used to prosecute fraudulent business practices, issued a new state directive…that would severely restrict gender-transitioning treatment for both adults and minors…[based on the false claim that] they were considered “experimental”…[and claim]ing that the attorney general “is charged with protecting consumers, including minors, from harm”…While there is some debate among medical professionals about how to put in place gender-transitioning treatment for [legal minors], leading medical groups in the United States…oppose legislative bans…

It is doubtful that this outrageous overreach will withstand a legal challenge; the action is therefore pure virtue-signaling intended to win votes, as is this equally extreme overreach by the Other Team:

The Washington state House approved a bill that would authorize state agencies to hide [legal minors] seeking transgender medical intervention from parents…under the bill, a disagreement between a[n adolescent] and parents over the [adolescent]’s desire for a medical transition constitutes “abuse and neglect,” only because the parent hasn’t “properly affirmed what the child [sic] wants”…

The Vultures Descend (#1330)

Just a reminder that regardless of what tyrants declare, many overseas pharmacies will sell to US customers without playing “Mother-May-I” games:

The Supreme Court has temporarily blocked heavy restrictions on the use of mifepristone…and will allow…physicians to continue using mifepristone for abortions past seven weeks and distributing the pill by mail and without an in-person visit…Kacsmaryk[‘s decision] in Texas…was robustly criticized by legal scholars and medical experts…[and] was in conflict with another decision issued by a district judge in Washington state…Judge Thomas Rice said that the FDA could not change how it regulates the drug in the locales that had filed suit…the…5th Circuit…partially blocked Kacsmaryk’s ruling, but said that instead, the FDA had to revert its approval of mifepristone to what was permitted in 2016: only allowing the drug to be used for people up to seven weeks of pregnancy, prohibiting its provision through telemedicine and requiring three in-person physician visits for anyone getting a prescription.  Currently, the FDA permits mifepristone to be used up to 10 weeks of pregnancy, and the World Health Organization recommends its use up to 12 weeks of pregnancy.  Both endorse telemedicine for medication abortions…
