Thought Control (#1256)

The more vague the law, the more authoritarians like it:

A Broker in Pillage (#1326)

Airports are among cops’ favorite places to lurk in order to rob people:

[Pigs and spooks lu]rking at…Atlanta International Airport rarely find drugs on passengers at departing gates.  More often, they find money.  Records show [thugs] have s[tolen] millions of dollars from passengers at boarding gates.  The [robbery] is administratively [justified by belching out the magic words “]proceeds of drug trafficking[“] even [though] no drugs are [ever] found…[they] do not arrest the passenger.  They [simply rob them]…Most cases never go before a judge….passengers are forced to [somehow] prove their money “innocent’ on the spot at the airport gate or it’s s[tolen]…passengers are forced to pull up bank statements on their phones or otherwise provide proof the money isn’t from drug trafficking.  Merely flying from Atlanta to Los Angeles is suspicious, according to [porcine fantasies], because it’s a “known drug trafficking route”…

Stalkers in Blue (#1334)

Cops are sexual predators who often specifically target traumatized women:

A Greenville [South Carolina cop has] resigned after[being caught lying] about whether he had sex in his patrol car with another [cop.  But just a few months ago]…Timothy Matthews…was the subject of an anonymous complaint by a woman in the charitable organization Jasmine Road, a residential program for…wom[en who had bad experiences in]…prostitution…[because] he [repeatedly pressured her for]…her phone number [and bombarded her with texts after she gave it to him]…

Panopticon (#1346)

Bureaucrats who committed illegal surveillance refer to their victim as a “public nuisance”:

…the Michigan Supreme Court…has the chance to decide whether a municipal government…can circumvent constitutional protections by farming out the task to a private company…warrantless drone surveillance is [explicitly un]constitutional…[but] the appeals court…said that excluding any evidence gathered would be inappropriate, so the state Supreme Court can functionally determine whether local governments can do this and get away with it.  Multiple civil liberty advocacy organizations have submitted amicus briefs…argu[ing] that “if the Township gets its way, it will not only profit from its privacy violations, but open the door to other local governments deploying cheap, pervasive, flying surveillance devices to surveil private property for the smallest of civil infractions…Without consequences for arbitrary invasions into [Fourth Amendment] rights, no one can be secure in their person, house, papers, or effects”…

Shifting the Blame (#1360)

How many women died as a result of inaction by the murderer’s cop buddies?

Rex Heuermann, the New York architect accused of being the Gilgo Beach serial killer, has been linked to…the deaths of Shannan Gilbert and Karen Vergata…four witnesses [have come] forward with information about Heuermann…The first…went to Heuermann’s house for a sex party in February 1996 with her boyfriend, who was a cop, and Vergata…During that time, she spoke with [Heuermann’s wife, Asa] Ellerup, who…told the witness that she was “afraid of Rex”…the second witness…[i]s a taxi driver…[who] saw Gilbert and Heuerman together when she picked her up in the fall of 2009…[Gilbert was] “crying and shaking”…[because Heuermann had tried to cheat] her [with] an envelope of paper scraps instead of money…

The Next Target (#1371)

While Mastercard chooses to discriminate vs sex workers via an elaborate concern kabuki derived from “sex trafficking” propaganda, Visa prefers to burble reasonable-sounding rhetoric about “risk” in order to justify charging sex workers more money to access their services than other businesses.  Back in the old agency days, I simply lied to my card processor and called my company a consulting firm in order to avoid high fees, excessive scrutiny, or arbitrarily being dropped by the processor.  But things have changed a great deal in the past two decades, and there’s no way for an online provider to cloak herself as I did.  This article in XBiz is too dense for me to understand, but if you’re an online sex worker you probably already understand many of these terms, and may find it helpful.

For Better, For Worse

Liz Brown recently published a roundup of efforts in various states to change prostitution laws, four of them for the better and two for the mostly-worse.  Liz covers the developments with her usual thoroughness so the article is well worth reading in its entirety, but since there are several tags tracking these legal maneuvers, it doesn’t hurt to synopsize them here (along with a few comments of my own, and links to earlier stories about prostitution law changes in those states).

Hawaii

…Senate Bill 1204…introduced by state Sen. Carol Fukunaga…would repeal a section of Hawaii law criminalizing prostitution…and a section criminalizing “commercial sexual exploitation”…It would also repeal laws that criminalize “promoting prostitution,” “loitering for the purpose of engaging in or advancing prostitution,” “promoting travel for prostitution,” “street prostitution,” and soliciting prostitution near schools or parks…Another measure introduced by Fukunaga…would establish a working group to “study the effects of New Zealand’s model of decriminalizing prostitution on sex workers, their clients, and the broader community”…and “make recommendations for amending Hawaii laws to decriminalize prostitution”…

New York

…Julia Salazar[‘s]…S4396…has attracted eight co-sponsors so far…[it] would repeal all parts of state penal law “that make sex work between consenting adults illegal”…[and] also repeal other statutes related to consensual adult prostitution…

Unfortunately, there is a competing Swedish model bill sponsored by prohibitionist Liz Krueger which would treat sex workers as moral imbeciles and target their partners, friends, co-workers and families for persecution, and the governor has held discussions with its supporters.

Rhode Island

…House Bill 6064 was introduced on March 3 and…would allow sex workers to come forward about crimes they witnessed or were victimized by without worrying that police would then arrest them for prostitution…or “procuring or attempting to procure sexual conduct for the payment of a fee,” loitering for prostitution, “soliciting from motor vehicles for indecent purposes,” or practicing massage without a license…

I’m not especially impressed with laws like this, one of which was recently passed in California.  But there are also re-decriminalization efforts going on in the state.

Vermont

…H.372…has attracted 14 sponsors…and…would repeal the part of Vermont’s criminal code that outlaws engaging in prostitution, soliciting someone for prostitution, aiding and abetting prostitution, and related activities (such as permitting a place to be used for lewdness or prostitution and transporting someone to a place where they will engage in prostitution)…

Vermont’s current law actually defines all extramarital sex as “prostitution”, whether or not money is exchanged.

Massachusetts

[Prohibitionist filth] Kay Khan…[is once again trying to] implement what’s known as the Nordic model of sex work laws, in which paying for sex is illegal but selling sex (at least under some circumstances) is not.  The Nordic model…[i]s not recommended by human rights, health, or sex worker advocacy groups, since continuing to criminalize prostitution clients keeps the industry underground and leaves in place most of the harms presented by full criminalization.  A recent study of sex work law changes in Europe  found that…the Nordic model [is] associated with higher rape rates…

Tennessee

[Politicians] Page Walley…and…John Ragan…have introduced measures (H.B. 1383 and S.B. 0182), [basically similar to the one on offer in Rhode Island, with an important difference: they]…would also institute heftier penalties for people paying or attempting to pay for sex.  Right now, the crime of “patronizing prostitution” in Tennessee is already a Class A misdemeanor, punishable by up to 11 months and 29 days in prison and/or a $2,500 fine.  The…[new] law…would make patronizing prostitution a Class E felony, punishable by one to six years in prison and up to $3,000 in fines.  Increasing…penalties for…customers doesn’t stop prostitution.  But it may make customers more reluctant to engage in screening…and…other conditions that could increase sex worker safety, out of fear that doing so will leave a paper trail or otherwise make them more vulnerable to arrest…

If Men Were Angels 

It’s getting harder to tell the preachers from the cops:

A former [pastor and] teacher at a [Pennsylvania] evangelical school was convicted [on August 31st] of sexually assaulting a first grader there in 2007.  Randy Lee Boston…denied the allegations, [claim]ing…that he had barely any interaction with the alleged victim while he was enrolled at the school.  But in an interview with police, a recording of which was played in court, Boston admitted to having sexual desires “connected to young boys” and being attracted to their bodies…

Choke Point (#593) 

Wells Fargo has repeatedly shown itself to be among the worst perpetrators of this abuse:

Sex workers…are reporting that the bank Wells Fargo has sent them notices terminating their accounts effective immediately, in what they see as an extension of the crackdown measures banks and other large institutions have been implementing over the past few years.  In the letters, which are dated August 25…Wells Fargo offers zero explanation for the decision…Alana Evans, the president of the Adult Performance Artists’ Guild (APAG), says that she has been a client with Wells Fargo in good standing for nearly 30 years…Spike Irons and Sofie Marie, who run…a porn production company…primarily use[d] the[ir now-closed] account to pay out independent contractors…They have since applied to two other banks and been rejected…Former adult performer Raylene has been out of the industry for a decade, and says she’s had her Wells Fargo account for 22 years.  She, too, received the same notice…despite the only adult industry-related payment on her account being residuals from a lifetime contract with Streammate…In 2014, JP Morgan Chase closed down many adult performers’ accounts without providing any explanation…

See No Evil (#1167)

Legalese for “get out of my courtroom, you opportunist”:

A federal judge…dismissed a lawsuit filed by a man who, as a baby, had graced the cover of Nirvana’s seminal album, Nevermind, and argued 30 years later that the iconic photo of him drifting naked in a pool had been a form of sexual exploitation…Spencer Elden…[even] accused Nirvana…of engaging in child pornography…The judge, Fernando M. Olguin, wrote in his eight-page ruling that because Mr. Elden had learned about the album cover more than 10 years ago, he had waited too long to file his lawsuit, making his claims untimely…

Dangerous Speech (#1186)

The government’s evil clown show continues in a new ring:

Oral arguments in the Lacey/Larkin appeal took place Sept. 2 before a three-judge panel of the Ninth Circuit, where the defense presented a forceful case that the government didn’t deserve a retrial…[one] issue was the testimony of California cop Brian Fichtner during last year’s…mistrial due to prosecutorial misconduct…the government…repeatedly mentioned or elicited testimony related to sex trafficking or child sex trafficking, though Lacey, Larkin, et al. are not charged with such…[prosecution witness] Fichtner, who investigated Backpage previously for then-Cali AG Kamala Harris’ failed 2016 prosecution of Lacey and Larkin, was…eviscerated on cross-examination by the defense and forced to admit that the content of the ads on Backpage was legal and on its own did not give law enforcement probable cause to arrest anyone for prostitution…this point…is important because the appellate court must find that the government had a reason to sabotage its own case for the U.S. Constitution’s prohibition on double jeopardy to kick in…the prosecution faced certain defeat, and so chose to throw the case, and retool its strategy for a retrial…

Another Vermont city achieves de facto decriminalization:

Montpelier has become the second city in Vermont to repeal its antiquated prostitution ordinance in the past year…most municipalities in Vermont do not have ordinances banning prostitution [so]…repealing the language…bring[s] Montpelier in line with the rest of the state.  Though bills proposing to decriminalize prostitution were introduced during the past two legislative sessions, they did not advance and prostitution remains criminalized at the state level…

The Cop Myth (#1232)

How long will America ignore the costs of its sick worship of state-sanctioned violence?

California…[cops murder]ed nearly 1,000 people in six years…[despite] recent legislative attempts to curtail police violence by toughening the rules of engagement for officers, requiring deescalation training and bringing in outside investigators when unarmed civilians are killed [but not actually holding the murderers responsible as ifthey were non-cops]…For the sixth straight year, Los Angeles County was the setting for the largest number (172) and highest rate (27.4 incidents per 100,000 residents) of [police violence too serious to ignore] in the state last year…

Modern fascism has spun a terrifyingly-extensive surveillance net:

[Cop shop]s from suburban Southern California to rural North Carolina have been using an obscure cellphone tracking tool, [usually] without search warrants, that gives them the power to follow people’s movements months back in time…[cops] have used “Fog Reveal” to search hundreds of billions of records from 250 million mobile devices, and harnessed the data to create location analyses known among [pigs] as “patterns of life”…The tool is rarely, if ever, mentioned in court records, something that defense attorneys say makes it harder for them to properly defend their clients in cases in which the technology was used.  The company was developed by two former high-ranking Department of Homeland Security officials under former President George W. Bush.  It relies on advertising identification numbers…culled from popular cellphone apps such as Waze, Starbucks and hundreds of others that target ads based on a person’s movements and interests…that information is then sold to companies like Fog…

Prohibition turns the body of every citizen into a “crime scene”, which can be violated by cops at will:

Former boxing champion Mike Tyson has been capitalizing off his notorious 1997 ear-biting incident, in which he chomped down on opponent Evander Holyfield’s ear, by selling THC-infused edibles shaped like ears with a bite chomped out of them.  His company, Tyson 2.0…plans to expand these “Mike Bites” to more states this year. But that won’t include Colorado [because] a 2016 state law prohibits marijuana edibles from being shaped like humans, animals, fruit or other objects that could attract children…

Because everybody knows that every person under 18 is so irresistibly drawn to any exposed body part, they will instantly run up and attempt to eat that part, and the only way to prevent it is for everyone over 18 to wear burqa-like garments that expose absolutely no flesh whatsoever.

This one really was a “former” cop:

Andrew Vernon…a retired [cop], paid a 14 year old girl to pose in sexually explicit positions and uploaded these to a pornographic website…[other cops] found images on his laptop of teenage girls…[and] an adult woman who[m] he secretly recorded taking a shower…Vernon has been sentenced to 18 months imprisonment…he…claim…to [the girl that he had] erased them all, when in reality, he had…uploaded some to an amateur porn…website…police recovered a total of 441 images from his laptop, USB and SD cards…

I Spy (#1206) 

In mass surveillance, fascism beats communism hands down:

It was revealed last week that hackers obtained the information of some Apple and [Facebook] users by forging an emergency legal request, one of several mechanisms by which [cop shops] can…demand that tech companies hand over data such as location and subscriber information…privacy advocates [explain]ed [that] the forgery was a warning sign that the system is in need of reform…An emergency legal request, like the one the hackers forged…doesn’t require a subpoena or warrant, [and judges tend to rubber-stamp the ones that do]…Here are some of the main ways [cops] can get hold of your data [without your consent]…

You Were Warned (#1224)

These attempts to destroy the internet are just going to keep getting worse:

…the Kids Online Safety Act of 2022 (KOSA)…would [invent]…a new legal duty for platforms to [censor]…a wide collection of content [and establish] that platforms can be sued…if young people encounter it…[the law would create] an elaborate age-verification system, likely run by a third-party provider…[and demands platforms create] parental controls, turned on and set to their highest settings [by default]…The parental controls would…require a vast number of online platforms to create systems for parents to spy on—and control—the conversations young people are able to have online, and…likely result in further tracking of all users…in order to avoid liability…nearly every online platform would [be forced to] hide or remove huge swaths of content…KOSA would apply to anyone under sixteen—an age group that child rights organizations agree have a greater need for privacy and independence than younger teens and kids…KOSA’s incredibly broad definition of a covered platform would include…everything from Apple’s iMessage and Signal to web browsers, email applications and VPN software, as well as platforms like Facebook and TikTok…

Woman who made a career in non-consensually harming people thinks being a sex worker is shameful:

A Colorado s[ow] retired with a $30,000 separation agreement instead of facing an internal investigation over [her] OnlyFans page…Melissa Williams…was [a state thug] for 28 years, spending the last [few] years [tormenting human beings locked in cages]…She had the OnlyFans account for 18 months without any problems, but then coworkers found out and a [fellow sow squealed on her]…Williams [denied]…being a sex worker…[apparently believing that being] pa[id for porn is not]…sex…[work if you happen to be a state employed thug who is not wearing her magical clown costume at the time, or something]…

This case also bears a few similarities to that of Kristen Hyman, who left a job inflicting violence consensually for one where she could inflict it non-consensually.

Ireland’s decision to criminalise prostitution is “facilitating” harassment of sex workers and violent attacks against them, a scathing new report has found.  Research carried out by Amnesty International warned [Swedish-style criminalization inflicted] in 2017 was driving sex workers to put their lives at risk in a desperate bid to dodge the police…

The Mob Rules (#1198)

Until SCOTUS acts, this will only get worse:

The…Texas [abortion ban]…allows private citizens to sue abortion providers or people who help a [woman]…get an abortion after six weeks’ gestation, but…a bill proposed in New Hampshire…would let…[a man] claim[ing] to be the…“biological father”…go to court and request an injunction that would prohibit the…[mother]…from getting an abortion…successful [plaintiffs]…would need to cover all prenatal medical expenses not covered by insurance and pay $250 a month for “adequate nutrition”—though notably that support ends…[after] birth.  If the pregnant [woman] doesn’t show up to the hearing, the judge would grant an automatic injunction blocking the abortion—no exceptions.  If they get an abortion anyway the court could hold them in “civil or criminal contempt,” without listing specific penalties…

My Body, My Choice

An argument I’ve often made myself:

…feminists should embrace a definition of sexual freedom that goes beyond the right to prevent reproduction and which focuses on women’s sexual autonomy…Anti-abortion advocates have embraced paternalistic arguments that assert they know better than women about their best interests and the harms of abortion…in much the same way mainstream feminists have claimed to know better than sex workers about how they should use their bodies. However, decriminalized sex work and access to abortion allow women in economic precarity escape destitution…the decriminalization of sex work has been treated as niche or counterproductive to the goal of sexual freedom…this…has contributed to the political embrace of access to abortion as the priority issue for feminist organizing, while women’s groups have openly contested women’s right to be free from criminalization while engaging in commercialized sex…

Pretext

If this keeps up, soon we’ll just be able to abolish nearly all laws and call everything cops choose to accuse anyone of “human trafficking”.  Think of the time and labor savings!  Threaten everyone with life in prison, let them plead down to one of a few minor and equally-vague offenses like “money laundering”, “conspiracy”, “racketeering” or “hate”, then put them on ankle monitors for a decade or two.  International Utopia!

Cops and Robbers

Another bunch of racist vigilantes playing games with people’s lives:

Florida prohibitionists are now tripling down on their awful anti-whore laws:

Florida lawmakers just voted to create a public registry of people [accused by cops of] attempting to pay for sex.  After an initial defeat…the registry—arguably the worst part of a new Florida crime bill capitalizing on human-trafficking propaganda—was revived and reinserted before the measure’s passage…The final version…creates a database of [adults caught in cop sting operations]…targets strip clubs, and mandates that a slew of state workers and businesses jump through new hoops to accommodate a few politicians’ latest attempt to get their names in the press…The Soliciting for Prostitution Public Database will list anyone who has been convicted of, or plead guilty, to “soliciting, inducing, enticing, or procuring another to commit prostitution, lewdness, or assignation” [which of course includes sex workers arranging duos or giving references or other help to other sex workers]…The new measure also classifies strip clubs as “adult theaters”—then makes it a first-degree misdemeanor criminal offense for the operator of any adult theater to fail to keep proper records.  The law also creates wide new categories of workers and businesses that are [forced to endure]…anti-prostitution and pro-surveillance propaganda disguised as tips for teaching bystanders how to prevent human trafficking…

Just in case you needed another reason to be disgusted by this power-mad sociopath:

Kamala Harris is making the potential punishment of social media platforms that don’t censor what she [represents] as hateful speech a focal point of her presidential campaign…[she] wants social media to do more to stop…ideas [she disapproves of, such as sex worker rights] from being expressed and spread online.  It’s not clear what she thinks the companies should specifically do, but she’s definitely laying the blame on Facebook and Twitter and YouTube for the existence and proliferation of angry people online…what she wants with her prosecutor background is to force compliance with whatever rules she puts into place and use the threat of punishment to shut down resistance…just [like] California parents who were threatened with jail time because of her support for criminal truancy laws…or [her repeated and illegal]…attempt[s] to bring pimping charges against the publishers of Backpage…
