…the scam starts by an alleged woman contacting a man through an online dating app or website…The texting then turns sexual and includes the exchange of nude photos and plans to meet…the male victim…is then called by a person claiming to be a part of Iowa’s Internet Crimes Against Children Task Force.  The scammer tells him the woman is underage and there is now child pornography on his phone.  The scammer says child pornography is also on the woman’s father’s phone because she was using it communicate with the male victim.  The scammer then tells the victims he will need to replace the father’s phone or face legal action…The [supposed] father tells the victim to wire several hundred dollars to him to pay for the new phone…Victims are encouraged to [turn themselves in to the pigs & hope to be believed]…

Reuben…Coppa’s Rendevu mobile web app is an on-demand platform for adult services that hopes to make the industry safer for both clients and working professionals…Rendevu has secured $700,000 in a recent round of funding which makes it the only funded app in the niche.  The app lets professionals display real time availability, list prices, and display ratings including profile accuracy.  On the client side, the app pre-authorises credit cards to ensure safety and confirm the payment before services are rendered.  The appointment process also involves an ID confirmation by the escorts which adds another layer of security…Rendevu looks like a game changer for an industry sorely in need of disruption.

If these idiots had bothered to consult even one sex worker, they’d know that we have no interest in having our industry “disrupted”.

The Red Umbrella (#724) 

I’m glad to see this piece of shit flop:

An Australian lawyer chides prohibitionist peers:

…Prostitution in France brings in an annual turnover of €3.2 billion, a new study funded by the European Commission has found…France’s nearly 40,000 prostitutes…bring in an average gross total of €87,700 a year – much of which is sent abroad.  The authors of the report, who are campaigning for the abolition of prostitution, say that there is a serious tax evasion on these earning that totals €853 million a year.  They added that the total “cost” on society was €1.6 billion…The profession also proves costly for indirect social consequences, the study noted, such as imprisonment for pimping, health expenses, and addictions.  Maîtresse Gilda, spokeswoman from the French sex-workers union Strass said the figures in the study were “delusional”…

The idea that sex workers are to blame for the costs of criminalizing us is the exact moral equivalent of a bully who hits another child with his own hand while mocking, “Stop hitting yourself!”

California’s Division of Occupational Safety and Health has issued a set of safety standards for all California porn production sets.  The 21-page standards presentation…goes into graphic detail about the safety precautions that are to be undertaken when adult video actors perform various acts.  Here’s one eye-opening detail from the document:  “the employer shall provide, at no cost to the employee, appropriate personal protective equipment such as, but not limited to, condoms, gloves for cleaning, and, if contact of the eyes with OPIM-STI is reasonably anticipated, eye protection.  Personal protective equipment will be considered “appropriate” only if it prevents blood or OPIM—STI* from passing through to or reaching the employee’s eyes, mouth, or other mucous membranes“…“OPIM—STI” means pre-ejaculate, ejaculate, semen, vaginal secretions…or…any other bodily fluid…in situations where it is difficult or impossible to differentiate between bodily fluids…

Yes, that means goggles.

Absolute Corruption (#449)

Radley Balko uses the case of Fran & Dan Keller to discuss the Satanic Panic in general:

…”[Texas’] highest criminal court…threw out the 1992 sexual assault convictions against Dan and Fran Keller but declined to find the former Austin day care owners innocent of crimes linked to a now-discredited belief that secret satanic [sic] cults were abusing day care children nationwide.  The Kellers spent more than 22 years in prison…The nine judges did not provide an explanation for why they rejected the Kellers’ innocence claim”…dozens of innocent people were sent to prison for crimes for which there was no evidence other than the coerced testimony of kids, and for which those same defendants would later be exonerated.  Here’s an excerpt from the concurring opinion of Judge Cheryl Johnson, who would have declared the couple innocent:  “This was a witch hunt from the beginning.  The allegations…were based on the testimony of a three-year-old child who…was in therapy for numerous psychological and behavioral issues“…That the highest court in Texas still can’t bring itself to declare the couple innocent, in spite of all that we know now, shows just how difficult it can be to undo the damage caused by a moral panic and junk science in the courtroom…One of the best treatments of the panic is the movie Witch Hunt, which focuses on Kern County, arguable the epicenter of the panic…

In recent months, The Fact Checker has exposed a series of dubious factoids, each of which are endlessly repeated by politicians and, even more irresponsibly, by the media…In 2008, Michelle Stranksy and David Finkelhor of the respected Crimes against Children Research Center at the University of New Hampshire wrote a report explaining the problems with the Estes/Weiner estimate, as well as other claims about the extent of the juvenile prostitution.  “PLEASE DO NOT CITE THESE NUMBERS,” the report pleaded…how did such an out-of-date guesstimate get touted as a current “Justice Department” figure?…in 2010, the Office of Justice Programs published an article in its Juvenile Justice Bulletin that cited the Estes/Weiner estimate…But the bulletin makes clear that this is only an opinion article and it does not express the official position of the Justice Department.  A Justice Department spokeswoman confirmed that…“No reliable national estimate exists of the incidence or prevalence of commercial sexual exploitation and sex trafficking of minors in the United States”…[politicians] should be ashamed of citing a figure that is so out of date and discredited…All lawmakers should stop using it and post prominent corrections of their statements on their Web sites…

Rare honesty in a mainstream American newspaper:

Let’s be honest.  Paying for sex has been around a long time, and it’s not going away anytime soon.  Recent court cases have established sexual rights and privacy in protecting what consenting adults do behind closed doors, but those rights end for people who wish to exchange sex for money…some people do not believe sex workers should have the same legal rights as other workers.  A study recently published in The Lancet found that even partial criminalization…such as the Swedish model…places sex workers at equal risk for human-rights violations and exploitation.  Trying to stop demand will not stop prostitution…Nearly every industrialized nation has made prostitution partially legal or outright legal. [MSNBC’s]…new series, Slave Hunter: Freeing Victims of Human Trafficking…reveals…what happens behind closed doors in the sex trafficking underworld.  The series highlights the…work of human rights advocate, Aaron Cohen and his partner, former Las Vegas vice detective, Chris Baughman…MSNBC’s cameras follow Cohen and Baughman as they…identify trafficked women via on-line ads and then arrange to meet them in New York City hotel rooms with Cohen posing as a potential john.  When the women are open to help, Cohen and Baughman…[help] them to escape their bonds and build a new life…other times, the trafficked women sadly succumb to the powers of their “pimp”…

We can only hope this blows up in NBC’s face the way To Catch a Predator  eventually did.  Hey, guys, do you know the word for men like you who prey on women in order to enrich and aggrandize themselves?  Oops.

Another, more obsequious blog reversed the roles by calling the deal “Houston’s dance with the devil” and breathlessly informed its readers that “Houston…has long been regarded as the nation’s hub of human trafficking”; I’d call that a claim for the #1 spot, wouldn’t you?

Islan Nettles was out…with friends when a group of young men…learned she was a transgender woman and began taunting and maliciously beating her—right in front of a police precinct in Harlem…[the 21-year-old] was punched in the face, knocked to the ground and beaten until she lost consciousness…she…fell into a coma…[and later] died…Nettles’ alleged assailant, Paris Wilson, was booked on a misdemeanor assault charge and freed on $2,000 bail…Nettles’ death was officially ruled a murder…[but] Wilson has not yet been arraigned on any murder charges…

Somewhere in the Middle

The mainstream media touted another bogus client study last week; this one used a single Backpage ad placed twice in each city, and thus (unsurprisingly) generated wildly-varying figures for their “estimate” of the fraction of men who buy sex.  The design presumes that all clients use Backpage and that all men will respond to a generic ad for one particular type worded by ignorant amateurs; it’s like counting the pigeons near one statue at some random time and using it to estimate the number of all birds in the whole city.  The academic behind this is the ethically-retarded Dominique Sepowitz of Arizona State, who has a history of reporting her survey subjects to the cops; her department is also involved in “Project ROSE”, which entraps streetwalkers and then offers them a “choice” of jail or Bible-based brainwashing.  And who funded this bogus “study”?  Try the Phoenix Police Department, Arizona State’s “Office of Sex Trafficking Intervention”, and Asstoon & Dumi’s THORN.  In other words, it’s about as trustworthy and reliable as anything from Melissa Farley or the Schapiro Group.

Rice…Mr. Friedman’s lawyer, Ron Kuby, and…Andrew Jarecki, [director of Capturing the Friedmans]…[said] the report was a biased whitewash by the office that originally botched the case…“Rice has made a craven, but not surprising, political decision in failing to admit to the wrongdoing of the…D.A.’s office and former sex crimes chief Fran Galasso, in the face of overwhelming evidence of Jesse’s innocence,” Mr. Jarecki said.  Mr. Kuby said that the district attorney’s office had fought Mr. Friedman’s efforts at every turn and that this was just more of the same…“Fortunately, the conclusion of this bogus reinvestigation clears the way for the Friedman team to return to court”…

Traffic Jam

Remember the supposed “child sex trafficking ring” run by “Somali gangs” that federal prosecutors were all puffed up about last year?

…every defendant who has gone to trial has either been acquitted or had their conviction thrown out.  The government’s case was weakened when…a key witness…refused to testify, saying he is afraid for himself and for his family.  So prosecutors charged Abdullahi Farah with two counts of contempt of court and obstruction of a child sex trafficking case.  He was convicted…in April…and…is facing a maximum of 20 years…for the obstruction conviction…and…life in prison [for contempt]…Legal experts say…it’s almost unheard of for prosecutors to come down so hard on one of their own witnesses…

Considering that “agents said Farah gave conflicting accounts and sketchy details” and the judge “said he had problems with Farah’s credibility”, I think the truth is obvious:  sleazebag prosecutor Van Vincent tried to pretend a bunch of petty thugs were a gigantic conspiracy, but drew a judge who wouldn’t roll over for him and is taking it out on the only available scapegoat.  Consider the prospect of life in prison for a contempt charge, and then tell me the US isn’t a police state yet.

Absolute Corruption

Twenty-five years after it first indicted [Jesse] Friedman, the Nassau County [New York] District Attorney’s Office…could completely exonerate him.  Out of a dozen major child-sex-ring cases that roiled the country between 1984 and 2005, Jesse’s is one of the last convictions still standing…in November of 1987…postal inspectors intercepted…child pornography addressed to [his father]…police admitted that not one of the 30 children they…interviewed…reported any kind of abuse.  But…they kept re-interviewing the children—some as many as 15 times, and often for hours at a stretch…The children began to buckle, telling tales of extraordinary abuse…the Friedmans’ computer class was [claimed to be] a nonstop nightmare of coerced sex acts, where Arnold and Jesse abused kids…in plain view of other students…playing “naked leapfrog,” sodomizing kids as they jumped from one to the next…[children were supposedly] molested an average of six times during every one of the 20 90-minute classes they took…

Natural Processes

Of those who report their rapes, around 4–5% also describe experiencing orgasm. As I have repeatedly pointed out, sex worker rights is not an isolated “fringe” issue, but rather one deeply tied into other issues including civil rights (especially those of women and sexual minorities), bodily autonomy, moral panics and witch-hunting, universal criminality, the police state, mass incarceration, lies told by “authorities” and the ability of state actors to destroy the lives of individuals with impunity.  Over the past three years I have slowly expanded the scope of my subject matter, but with rare exception I think most of y’all can see how each topic I cover is tied in together.  But every once in a while I run into an item which, while not technically sex-work-related, is nonetheless linked to so many of the same issues that it lies very close to the center of the web.  Today we’ll look at the case of Bernard Baran, who has been brutally victimized by the state for virtually his entire adult life using exactly the same methods (employed by some of the same people) as are still regularly employed against anyone connected with sex work.

The story (as explained in this 2009 article by Radley Balko) starts in the early days of the Satanic Panic, just as it was beginning to blossom in earnest:

Baran was convicted in January 1985 of molesting six children at a pre-Kindergarten daycare facility in Pittsfield, Massachusetts…[he] was one of the first people in the country to be prosecuted in the daycare sex abuse panic of the 1980s, a bizarre, nationwide hysteria fed by fears of satanism, homophobia, and a wing of child psychology that used unproven interrogation techniques critics say caused children to recount sexual incidents that never took place…Prosecutor Daniel Ford likely engaged in serious misconduct and open bigotry in winning his conviction…yet…has never been investigated or disciplined for his role in the case…and [is now] a judge on the Massachusetts Superior Court…Ford [presented]…an edited video interview…[showing] several children alleging that Baran had sexually abused them.  But edited out was footage in which some of the children denied any abuse by Baran, accused other members of the daycare faculty of abuse or of witnessing abuse, and, most importantly, depicted interrogators asking the same questions over and over—even after repeated denials—until a child gave them an affirmative answer.  Some children were even given rewards for their answers…

The case against Baran was also awash in homophobia.  According to court documents, the first parents to come forward with accusations against Baran in September 1984 had just days earlier registered a complaint with the center upon noticing Baran was “queer” by the way he walked and talked…[when a] child later tested positive for gonorrhea of the throat, Ford used the test…at trial, even though A) the child never accused Baran of forcing him to perform oral sex, B) the child, in fact, specifically denied having sexual contact with Baran on the witness stand, C) Baran tested negative for gonorrhea, D) the boy had told his mother two months prior that his stepfather had orally raped him, and E) on the very day Baran was convicted, charges against the stepfather were turned over to the D.A.’s office for possible prosecution.  Baran’s counsel was never informed of the allegation against the stepfather…Ford implied that Baran’s “lifestyle” made it probable that he contracted gonorrhea at other times and knew how to quickly eradicate it to cover his tracks…An affidavit signed by Baran’s boyfriend at the time also paints Ford as a homophobe…[who] spent an inordinate amount of time asking Baran’s boyfriend about his own sex life, employing variations of the word faggot, and a mocking, drawn-out pronunciation of homosexual…in the ensuing months, Baran’s boyfriend was pulled over by police officers and further harassed on a daily basis, and that Ford told him, illegally, that if he spoke with Baran or Baran’s defense attorney, he would be arrested…

As if this weren’t bad enough, Baran’s defense attorney was incompetent and offered practically no resistance to Ford’s one-man jihad.  Eventually, a group of civil rights attorneys (including Harvey Silverglate) took up the case and began to work toward a new trial; they recognized that the unedited videotapes would show the lengths to which the children were manipulated, and “filed a motion for the tapes in 2000.  For three years, then District Attorney Gerard Downing, who assisted in Baran’s original trial, claimed to be unable to locate the tapes.  When Downing died of a sudden heart attack in December 2003, David Capeless took over as D.A…[and] was able to produce them within months.”  Silverglate and company moved for a new trial in June of 2004, and Baran was released on bond when a judge granted that motion exactly two years later; exactly three years after that prosecutors finally dropped all charges:

…the appeals court added in a footnote that if the state wanted to retry him, Baran could file a motion for a hearing on Ford’s possible misconduct.  By dropping the charges, the D.A. avoided that hearing.  “In my opinion, the possibility of an embarrassing hearing into misconduct by a former prosecutor and now sitting Superior Court judge was the main reason, if not the reason, they decided to drop the charges,” Silverglate claims.  “The appeals court opinion cut a bit too close to the bone for them.”  So while Bernard Baran is free after 22 years…there is no plan to look into the actions of the prosecutor, now a sitting judge, responsible for the conviction.  In his position on the Massachusetts Superior Court for the last 20 years, Ford has presided over some of the state’s most serious criminal trials.  He also serves on a committee that helps determine the state’s rules and guidelines of criminal procedure…

Bernard BaranDuring the 22 years he was imprisoned for “crimes” that existed only in his accuser’s evil minds, “Baran…was raped and beaten more than 30 times, necessitating six different transfers to new…institutions.”  With help from the National Center for Reason and Justice, an organization founded “in 2002 [by] several writers, human and civil rights advocates, and attorneys…to support Baran and others falsely accused of child abuse,”  Baran sued the state and won $400,000 compensation last August.  But when he asked for his records to be expunged, Massachusetts attorney general Martha Coakley (whom we have seen before)  refused without any valid reason:

At 2 p.m. on February 26, Bernard Baran, represented by attorney John Swomley, [asked] a Massachusetts judge to expunge all records of his arrest and conviction.  Baran wants to go on with his life with a completely clean slate…The State of Massachusetts, however, is inexplicably fighting to keep Baran from expunging the records of his case.  NCRJ calls on the State to serve justice by immediately processing the expungment.  “Massachusetts Attorney General Martha Coakley in the past has had a troubling record with these cases,” says…Swomley…“Now is her chance finally to do something right, something no reasonable person could possibly think unwise.  We were surprised that the State opposed the expungement of Baran’s records…”

I’m sure Swomley is just being diplomatic, because I’m not surprised at all.  Coakley is well-known for her puritanical anti-sex crusades (including a major role in the persecution of Backpage), so her dedication to pillorying Baran is wholly predictable.  And as long as we keep giving unlimited power to the least-evolved members of our society, none of us should be surprised when they then use that power to act out their own twisted fantasies on living human beings.
