Yes, that’s a gay man demonizing a kind of sex he isn’t interested in.  Breathe deep of the putrid stench of that irony.

The Hooker Vote

The fact that Hof endorsed Ron Paul in ’12 should tell you that this has nothing to do with the candidates’ actual positions.  From a press release that was probably sent to everyone who blogs on sex work:  “Prostitutes at Dennis Hof’s…Moonlite Bunny Ranch…announce their support of the Hillary Clinton presidential campaign…” The so-called “Hookers For Hillary” campaign’s embrace of “health care reform” seems primarily an attempt to demonize “illegal” sex workers by casting us as vectors of disease who need to be micromanaged by the benevolent state and licensed pimps like Hof lest we spread plague like a host of scarlet-clad Typhoid Mary Magdalenes.

Worse Than I Thought

Landlords of massage parlors, spa managers and even motel managers who knowingly allow prostitution on their premises could face prison and fines under [new Rhode Island laws]…The pandering law…would be amended to include those who allow prostitution on their premises, because they derive money from the illegal activity.  That includes landlords, managers, owners of spas or businesses, or any other place where commercial sex is practiced or allowed.  Under both bills, the penalties for a first offense would be one to five years in prison, and fines between $2,000 and $5,000…

It’s like they’re competing with each to see who can inflict the most mindlessly-draconian sentences:

People who solicit prostitutes would face increased penalties under a bill that [unanimously] passed the Florida House…The penalty for a first offense would increase from a second-degree misdemeanor to a first-degree misdemeanor.  A second offense would be a third-degree felony punishable by up to five years in prison and a third offense would be a second-degree felony punishable by up to 15 years in prison…

Amsterdam (#45)

Dutch “authorities” outlaw more aspects of sex work, then feigning surprise when the number of illegal whores increases:

The number of licensed brothels and escort agencies in the Netherlands fell to 674 in 2014, compared with 1,127 in 2006…The figures also show six out of 10 local authorities have no licensed sex business within their boundaries….researchers say the decline may be due to the rise in the online sex industry…Justice minister Ard van der Steur says it is difficult to get a grip on the size of the unlicensed industry but that exploitation, human trafficking and forced prostitution are a serious issue…

Sex workers in Edinburgh are facing increased health risks following the controversial police crackdown on saunas…Fewer women are attending the specialist NHS clinic set up to support them – and…sexually transmitted infections have increased.  Sex workers are also giving up on condoms, with saunas refusing to stock them because police can use possession of them as evidence of selling sex…many women had moved away from saunas and now operated from other venues, like flats or lap-dancing bars…

Pay attention to this: a motel chain is systematically ratting out guests to cops:

The popular hotel chain, Motel 6, has recently decided to partner with the police to violate the rights of their guests.  Without the consent of the guest, or even informing them whatsoever, Motel 6 employees will now turn over the guest information to the police, who will then run a background check on the subject…I highly doubt that all, or even 10%, of the 1,100 Motel 6’s in North America have a huge sex trafficking problem. I doubt many of them have real “major” crime issues at all. Yet, Motel 6 is allowing the police to run the names of all their guests, regardless of probable cause, incident, or reasoning…

The Sky is Falling!

A reporter breathlessly asks if dating sites have a “prostitution problem“, in other words if sex workers use them to advertise.  You know, like sex workers have been using personal ads to advertise for as long as such things have existed.  But poor little Caitlin seems to imagine that the practice only started with “the advent of Craigslist”, and furthermore that large numbers of professional escorts will waste their time going on dates without first ascertaining whether money is forthcoming.  Her ignorance is so pronounced that it merely comes across as cute rather than deeply insulting when she suggests that it’s sex workers who need (presumably compulsory) “safe-sex education” rather than her fellow amateurs.

The biggest news story of the week was the release of a World Health Organization report calling for total decriminalization of both drugs and sex work; it was accompanied by this reiteration of The Lancet‘s support for our position:

Sex work must be decriminalised if the world is to stand a chance of controlling the AIDS pandemic, say scientists contributing to a series of research papers in the Lancet medical journal.  Sex workers…are subject to repression, violence and abuse…at the hands of those who are supposed to uphold the law, according to the series of seven research papers presented at the International AIDS Conference…decriminalisation of sex work…across all settings…would reduce HIV infections by 33% to 46% over the next decade…

Original Sin (TW3 #321)

Neofeminist rhetoric and pop “addiction” charlatanry has now been completely incorporated into evangelical Christian beliefs about sexual “sin” to form a fully-developed “sex trafficking” religion:

Opposition to sex trafficking is almost universal…But many also…believe pornography production and distribution is a “victimless crime.”  They don’t connect the dots that lead from pornography directly to sex trafficking.  Pornography is a powerful stimulant that can actually alter brain patterns, creating addiction…Our sexualized culture, with its constant sexual portrayal of women, affects not only boys and men but girls and women, too.  Mass-marketing advertising campaigns directed at young girls seem to dictate that they must dress and act like prostitutes to be valued…girls increasingly view themselves as objects in a process called “sexual self-objectification.”  One result is today’s epidemic of “sexting”…Catherine Mackinon says that consuming pornography is an “experience of bought sex and thus it creates a hunger to continue to purchase and objectify, and act out what is seen.”  Pornography, she says, is “advertising for trafficking”…

Pimping the Pimp

Nevada “authorities” continue to use ridiculous “pimp” myths to enrich themselves and increase their power:

…A bill which would provide more resources for victims of human trafficking passed in the House of Representatives…Metro Police’s Vice Section rescued 91 women from the slave trade last year and 148 the year before.  The legislation could have an impact on men who trap these women. The prosecution of pimps wouldn’t be possible without the rehabilitation of survivors…The bill accesses millions of dollars for non-profits, who apply for money to serve homeless, runaway victims of severe trafficking…

Presumably, “rescued from the slave trade” actually means “arrested and caged for consensual sex”, because all the police departments in the entire country don’t discover anything like 91 coerced prostitutes per year.  And “serving victims” seems to mean “locking up whores indefinitely until they agree to participate in kangaroo courts.”

Number Puzzle (TW3 #324)

Cathy Reisenwitz spoke to some German sex workers:

…Germany’s decision to legalize prostitution not only helped sex workers, but actually decreased the number of human trafficking victims…According to the data, violence against sex workers is down, while sex workers’ quality of life is up…From 2001…to 2011, cases of sex-based human trafficking shrank by 10 percent…The mean age of a sex worker in Germany is 31.  Besides not being supported by data, the claim that legalizing prostitution increased human trafficking also defies common-sense economics…sex slang

As you may recall, we’ve seen this tactic before in Canada.

King of the Hill (All Traffick, All the Time)

Having his ridiculous numerical claims debunked multiple times in the national media hasn’t stopped Texas politician John Cornyn from making more of them:

Child sex trafficking has historically had a huge effect on the current immigration crisis in the U.S., and according to two Texas congressmen…hundreds of thousands of victims [have been] identified…”At least 700,000 people were reported as victims of international trafficking each year, 14,500-17,500 of which are women and children who are trafficked specifically into the United States”…

To Protect and Serve (TW3 #413)

Since their local case was dismissed, they took it to the feds:

…30 strippers are suing the San Diego police department after cops…forced…[them] to pose “nearly nude” for photos taken by members of the police department’s vice squad…approximately 10 officers detained the women for nearly an hour without a warrant or probable cause, and…cops made “arrogant and demeaning comments” while “ordering the women to pose in various positions and expose body parts so that the police could ostensibly photograph their tattoos”…Police department spokesperson Lt. Kevin Mayer described the raids and photos as a “routine” part of the city’s permit to regulate establishments with nudity…and…is meant to deter the women from engaging in “illegal acts”…

When I miscarried at 22 weeks in 1994, the cops weren’t even informed, much less involved.  If that happened today, it might be very different (especially if I weren’t white).  This detailed article on the Rennie Gibbs case touches on other, similar travesties, but also establishes the case as part of the pattern of willful incompetence perpetrated by Steven Hayne, Mississippi prosecutors’ go-to medical examiner for over 20 years because he was willing to declare just about anything a murder without the slightest scrap of valid scientific basis.  Veteran Agitator readers will no doubt remember Hayne, whom Radley Balko wrote about many times.

Another week, another rapist cop:

A San Jose [California] police officer has been arrested and charged with raping a woman…after she had argued with her husband…  Geoffrey Graves…and three other…officers responded to a [domestic violence call]…the woman…[said] she wanted to spend the night at a hotel…Graves…[followed her] to her room…and…[forcibly] raped her…Police Chief Larry Esquivel called the case…”an isolated incident”…

It’s so very isolated that I have another one right here:

Sheriff’s deputies arrested [an]…Irwindale police sergeant on suspicion of sexually assaulting a woman…David Paul Fraijo…stopped [a newspaper carrier on her route, then groped and orally raped her]…the [resulting] lawsuit…was [settled] in January…for $400,000…Fraijo faces a maximum penalty of life in…prison…

Some cops don’t even “isolate” their attentions to one woman at a time:

A U.S. Border Patrol agent [who raped] three undocumented immigrants was found dead in his Texas home, likely by his own hand…a…woman…told officials that [Esteban Manzanares] had attacked her, her 14-year-old daughter, and another 14-year-old girl…She and [her daughter] had been raped and left for dead…[Manzanares tied up the other girl in his home] until he finished his shift…then returned…raped her, and committed suicide…

In a CNN piece…last year…Jane Wells and John-Keith Wasson…blatantly ignore the voices of sex workers…As representatives of two of the largest sex worker rights organizations in India and Uganda, we hope to ensure that [their] voices…are heard…Wells and Wasson…cite imaginary statistics…[and] falsely state that a “small percentage of voluntary sex workers” are somehow condemning a vast number of women into sexual slavery…

The Course of a Disease (TW3 #408)

The European Parliament recently recommended that its member states should criminalise sex work.  This has prompted 26 Danish researchers to sign a protest letter against the proposal, as they believe that…politicians have ignored the majority of the research in this field, including reports from the UN, WHO and Human Rights Watch, who all recommend a decriminalisation of sex work…

The ACLU actually did something for sex workers for a change:

Whither Canada?

The Canadian government’s consultation on prostitution laws ended on Monday, but it hardly seems likely to have much influence over politicians, who have already decided to pursue some form of criminalization instead of listening to the sensible advice of sex workers, human rights advocates and even many criminologists.  By the public discourse, one would think the New Zealand model didn’t even exist; editorials like that in the Globe and Mail pretend that the only two legislative models in the world are the Dutch and Swedish modelsdisguised cop (which criminalize either some or all sales of sex, respectively).  And though a sizeable fraction of the members of the Liberal Party (whose past leader Pierre Trudeau famously said, “There’s no place for the state in the bedrooms of the nation”) support decriminalization, a motion to adopt that as official policy was pulled in the name of political expediency.  So though most of the Canadian media oppose blanket criminalization (even under its fake-moustache Swedish disguise), only the Ottawa Citizen has come out in favor of full decriminalization:

…supporters of the Nordic model…say [prostitution] is a commodity sale [that] is inherently objectifying and exploitative…A woman who believes she is freely choosing her job…is a victim whether she knows it or not…that same notion underpins many of the world’s most sexist ideas — including the idea…that rape is a property crime.  We in Canada don’t generally talk about rape that way any more, but we still use that language when we talk about prostitution.  We use phrases like “selling her body” or even “selling herself” — rather than “selling sex”…We don’t say that a hairstylist “sells her hands” or that a doctor “sells herself”…a woman’s value as a human being has nothing to do with whom she chooses to have sex with or how often or what conditions she imposes on that choice…sex is merely the service she sells…

Something Rotten in Sweden (December Updates) Maxine Doogan

sex workers [protested] a San Francisco anti-trafficking panel discussion…about “Discouraging Demand”…[including] the “John School”…Maxine Doogan…[of] the Erotic Service Providers Union…[said] “Using the term ‘john’ to describe our clients is like using the N-word…It’s a derogatory means of dehumanizing the customers.”  Law enforcement efforts that go after clients ultimately increase risks for sex workers, she continued.  “Any criminalization of our customers is going to bring us more violence”…Doogan also cited the Supreme Court of Canada’s landmark decision…striking down…anti-prostitution laws that the justices unanimously agreed were…dangerous…

For Those Who Think Legalization is a Good Idea

the law which regulates sex work in India today [is] the Immoral Traffic (Prevention) Act (ITPA), 1956.  This does not criminalise sex work per se, but, as the Lawyers’ Collective that works for sex workers’ rights points out, it results in “de facto criminalisation through prohibition of soliciting, brothel and street work”, and this “has effectively undermined sex workers’ ability to claim protection of law”…Often sex workers are evicted from the only roof they had with their children in the name of “closing down brothels”…[the avails law] criminalises…their children as soon as they cross the age of 18, and old parents and younger siblings who many sex workers support.  However…“The criminalisation of soliciting is one of the most obvious legal problems…Sex workers are arrested even when they’re not soliciting”…

Against Their Will

This has a few irksome passages, but it’s probably much more palatable to rescue industry types than the way most sex worker rights activists might express it:

…Imagine someone flying across the country to pick up an individual they only recently met.  They are removed from everything they have ever known.  Then they’re placed in a home where they can’t have contact with anyone in the outside world.  Sounds much like trafficking?  It also sounds like a rescue…More often than not the story of Captain Save a Ho and the “fair maiden” ends with the girl running out as friends console the rescuer saying, “You did the best you could”…“She had too many problems”…or “Maybe she was wounded beyond repair”…The term “rescue” naturally implies that a person is incapable of helping themselves, and sometimes this is true…but the effects of being rescued can leave a lasting emotional mark on the survivor, which is difficult to overcome in the new life…

Saving Them From Themselves arrested teen girl

[Virginia] police say a teenager is facing child pornography charges after allegedly tweeting nude pictures of herself…The teen’s phone was confiscated for evidence, and she was charged with one count of distribution of child pornography…this could end up…with jail time…investigators say they are seeing a surge in these types of cases because teens see it as harmless sexting.

How dare they form their own opinions!  Only “authorities” have the right to determine what is harmless, and teens must be taught that by the infliction of much more severe harm.

Neither Addiction Nor Epidemic

David Ley…and colleagues conducted a review [showing]…only 27 percent…of articles on porn addiction contain…actual data, while [most suffer from]…poor experimental designs, [low] methodological rigor and lack of model specification…The review…found very little evidence — if any at all — to support…the purported negative side effects…There was no sign pornography was connected to erectile dysfunction, or that it caused any [brain] changes…people reporting “addiction” are more likely to…have a non-heterosexual orientation …high libido…and…religious values that conflict with their sexual behavior and desires…the research team said pornography might improve attitudes toward sexuality…increase quality of life…and…provide…a legal outlet for illegal sexual behaviors or desires, and its consumption or availability has been associated with a decrease in sex offenses, especially child molestation…

Above the Law

The lengths to which prosecutors and reporters will go to avoid saying “rape” when the rapist is a cop are nothing short of amazing:

Sorrento Police Chief Earl Theriot admits he committed sex acts with an unresponsive woman…and now faces a federal sentence for lying to the FBI about it…Theriot…placed her in the front seat of his police vehicle and took her to his office where he “engaged in…sexual contact with her”…

And in Hawaii,

[Alexandria Gregg]…is suing the…department of public safety and [prison warden] Neal Wagatsuma…for…[sexually] shaming…her and other female inmates…“During open public meetings of male and female detainees…Wagatsuma repeatedly forced…[female inmates] to stand at a podium and speak about their private, intimate and traumatizing sexual experience”…the warden ordered [them] to elaborate on…incidents of rape as well as sexual preferences.  The public questionings were videotaped by male detainees…“Typically, the detainees selected for filming were young attractive women”…Press Freedom Index

Naked Truth

A good article by Melissa Gira Grant on the real effects of political crusades against sex work.  Note that though Salon chose to point fingers at “the right” in its headline, the article itself makes no false partisan distinctions:

…Super Bowl lent the excuse for New York and New Jersey…to step up their routine anti-prostitution policing, in anticipation of an increased demand for commercial sex that, in Super Bowls past, has never been borne out.  NYPD’s vice unit coordinator Anthony Favale doesn’t even seem to mind that the hype is just that, telling Time, ”I don’t know if the increased number [of prostitutes] is a legend or not, but I am exploiting the opportunity”…Long before the media turned the Super Bowl into a…story of violence and exploitation…people engaged in the sex trade have been documenting…all the ways anti-prostitution policing pits them against law enforcement and puts them at risk when they need help…

Sometimes the absurdity of the idea of consensual crime is blatantly obvious:

The European Union is [finally] enforcing laws which…require countries to estimate how much cash changes hands on their black markets.  Those figures will be taken into account when calculating national GDP and allocating the £120-billion Brussels budget.  EU officials say the change will ensure consistent economic comparisons between member states.  As prostitution and drug use is legal in some member states – like the Netherlands – officials say it’s only fair for other states to acknowledge those activities in their national accounts.  Prostitution in the UK is expected to be valued at £3 billion a year, and drug dealing at around £7 billion…

The scandal of counsellors in “crisis clinics” that claim to offer “abortion support” claiming that terminations can cause breast cancer and women to become child sexual abusers was exposed this week…The vast majority of such “clinics” in the UK…are run by…Christian Action Research and Education (CARE)…the secretariat for the All Party Parliamentary Group (APPG) on Prostitution and the Global Sex Trade.  This APPG aims to promote the so-called Swedish Model…It’s been revealed over and over again how far left second wavers are beholden to anti-homosexuality, anti-trans, anti-sex work and anti-abortion interests, yet many people refuse to acknowledge the truth…I think Pee Wee Herman says it best…


Deafening Silence

Time bravely denounces police violence against sex workers!  But only in China, of course; American anti-whore police violence is A-OK:

…A 6,000-strong [police] force reportedly raided 12 hotels and entertainment venues in Dongguan] leading to 67 arrests — 90-odd cops for each of the alleged perpetrators.  Two police chiefs were later suspended, according the South China Morning Post… “Swept Away: Abuses Against Sex Workers in China“…documented torture, beatings, physical assaults, arbitrary detentions and fines.  Another report, by Asia Catalyst, found that escaping custody meant paying bribes.  Periodic “busts” focus on shaming women, not stemming the trade.  In a now-notorious 2010 case, Dongguan officials publicly paraded male and female suspects, barefoot and handcuffed, through the street…But…China’s netizens know where the real shame lies…“clean [up] your so called police troops, that’s what people really want to see” [said commenters]…“Arrest 67 officials [instead]”…

the Dutch justice ministry announced the planned closing of…19 prisons…[due to] a continued decline in crime rates.  Additionally, those who are convicted are choosing electronic tagging instead of incarceration.  This allows people to go back to work and continue as productive members of society. Innocence Never Had

A 17-year-old girl found stabbed to death in…Yorba Linda [California]…was a victim of human trafficking…about two weeks before she was killed…Officers identified Aubreyanna Sade Parks as a victim of human trafficking during a crackdown on prostitution in Santa Ana….Parks was turned over to county social service workers…[and] taken to a shelter but walked out in the following days…Larry Soo Shin [has been arrested for the murder]…

It’s bad enough that criminalization almost certainly contributed to this young woman’s death; do they really need to erase her agency in an attempt to increase that criminalization for living sex workers?

The Public Eye (TW3 #403)

Considering it’s in an Irish newspaper, this is nothing short of amazing:

…Watching [Northern Ireland’s justice committee] in action, you could very well be back in Salem in the final years of the 17th century…Laura…Lee’s treatment was so bad that she has registered a complaint with the Assembly…Lee does much of her sex work with terminally ill and disabled men, offering them a discount from her normal rate…In one of the most repulsive parts of the hearing, Paul Givan asked her, “Why would you exploit a disabled individual and make him pay?”, as though Lee was targeting defenceless men and entrapping them into having sex with her…[these] posturing men…clearly fancy themselves as grand inquisitors, when in reality they mistake boorishness and stupid sneering for incisive interrogation.  It is [they], not…Laura Lee, who should be ashamed of themselves.

R.I.P. Gloria Leonard

Gloria LeonardPorn star and men’s magazine publisher Gloria Leonard died on February 3rd after suffering a stroke at her Hawaii home on the night of January 31st; she was 73, but had been in good health.  Like me, she was already over 30 when she began sex work and had already had a previous career (in her case, as a stockbroker).  She was hired as publisher of High Society in 1977 and still continued to star in and direct movies for several years afterward; she also pioneered one of the first phone sex lines in 1983.  During the feminist “porn wars” she became an outspoken advocate of sex work, and served as president of the Free Speech Coalition from 1998-2001.

R.I.P. Al Goldstein Al Goldstein

Al Goldstein, the gleefully-controversial publisher of Screw magazine, died on December 19th after a long illness and an even longer decline in fortunes; he was 77.  Screw debuted in 1968 as a sort of déclassé foil to Playboy, and Goldstein was arrested many times on obscenity charges; my very first memorable exposure to anti-sex feminism was an episode of the Tomorrow show in which a neofeminist dumped a shredded copy of Screw on his head (I was 12 or 13 at the time).  The New York Times obit is excellent, and worth your time; though his name is less well-known than those of the more successful and mainstream porn magnates, Goldstein was a lot more influential than you may realize and is remembered quite fondly by many in both the sex and publishing industries.

The Punitive Mindset (TW3 #337) Chris Grayling as Scrooge

For the first time this Christmas, people in [UK] prison will not be able to receive parcels from their loved ones under petty and mean new rules introduced by the Justice Secretary Chris Grayling.  The new rules…forbid prisoners from receiving any items in the post unless there are exceptional circumstances…families are prevented from sending in basic items…such as cards, paper…pens…books…magazines…clothes and underwear…Instead people in prison are now forced to pay for these items out of their meagre prison wages to private companies who make a profit from selling goods to prisoners…

The moral panic on the supposed prevalence of trafficking in the global sex industry rests on a lie:  that the majority of sex workers are trafficked.  In fact, the opposite is true.  However, on the basis of this fiction, the dangerous abolitionist campaigns in favour of the criminalisation of clients…are gaining ground in several EU countries  …our research [found] that…only…about 6% of female interviewees …felt that they had been deceived and forced into selling sex…Most …thought their rights could be more asserted and their vulnerability reduced by decriminalising sex work…All…thought that restrictive migration policies and…criminalization…make people more likely to take risks and accept undignified and dangerous working conditions…

The Course of a Disease (TW3 #342)

Following a series of articles in…The Guardian, ICRSE and many sex workers organisations, academics and allies have signed a letter demanding…fairer representation [of] the debate on criminalisation of clients.  To this date, the letter [has] not been published…”  The letter corrects both (unintentional?) errors on the part of the Guardian itself and (deliberate) misstatements of fact in Swedish model propaganda, and was signed by many whose names you may recognize.

Pierre Fallavier, who…advised [Somaly Mam’s organization] Afesip between 1999 and 2007, wrote…that from the beginning of his relationship with the organization, [staff raised] concerns…that [victim narratives]…disseminated by Afesip [were] “exaggerated”…Fallavier said…“[I] find it unfair to point solely at Afesip for fabricating stories…This…is the approach that all major international NGOs use…They take bits and parts of the life stories of different beneficiaries and make up a ‘typical’ sob story…they are unapologetic, and…it is well known to anyone working in that sector…This is marketing…and it is only with extreme stories that they will get people to give the cash they need”…

Under Every Bed (TW3 #349)

The latest installment in Al Jazeera’s rapid descent into “trafficking” hysteria:

…Most victims of [sex] trafficking…in Spain come from Brazil, China, Nigeria, Paraguay and Romania, according to the police, who estimate the number of victims in the country at 12,000 and the earnings of the sex trafficking rings…at 5mn euros ($6mn) a day…”they don’t tend to recognise that they are victims,” said Paula Mandillo…with Mujer Emancipada…The first European Commission  report on human trafficking in Europe…put the number of victims between 2008 and 2010 at 23,632…Spain had the second-highest number of victims…in the European Union, after Italy…sex trafficking rings often use babies…to coerce [victims] into forced prostitution…[so] authorities…are…carrying out DNA tests on women and children at border posts, to verify that they are related…

If Spain has 12,000 “victims” and it’s second after Italy with 12,001, that gives the two countries together 24,001 of the total 23,632 victims.  Obviously math skills are not a requirement for either police work or reporting.

The Crumbling Dam (TW3 #351)

Look for a full column on the Canadian Supreme Court’s landmark decision week after next; I’m waiting to see if any politicians will open their mouths to insert their feet.  But in the meantime, here are three standout pieces on the subject.  First, one of the lawyers on the case expressed her opinion on one politician’s call for the Swedish model:

Elin Sigurdson…[said] “asymetrical criminalization…isn’t consistent” with the…ruling…”The same issue of danger and jeopardy will persist when one of the parties rather than the other is criminalized…it couldn’t be upheld under this decision…because you’re going to find the exact same problems persisting”…

Then Dr. Brooke Magnanti weighed in:

…Already, the decision is being decried by the losing side with complaints of how dangerous it would be for Canada to become “the next Amsterdam.”  On the one hand this is true:  the Dutch system does not work.  I have a friend who is an escort in the Netherlands and her home is regularly raided by police who accuse her of running an unlicensed brothel, even though she’s an independent escort who works alone…sex workers would prefer to not work in a country like the Netherlands…and certainly not in the dangerous and misguided setup endorsed by Sweden…most sex workers advocate for full decriminalization—as seen in the laws of New Zealand and New South Wales, Australia—as the best way to ensure minimum abuses and maximum access to rights…This is a view also supported by the WHO, UNAIDS, and other international aid agencies…Will Canada’s government craft a model of decriminalization, or something else, in the year until the new ruling takes effect?…

And on that last point, from Australia:Nikki Thomas, Terri-Jean Bedford and Valerie Scott

…The Swedish model…works to silence any alternatives to the narrative trope of pitiful victim in need of rescue…[it makes] big claims about ending prostitution…but the research does not back this up…and…sex workers [are] further stigmatized…sex workers…can guide our social policies towards best practice…Can we hear their voices ringing loud and clear?

Catastrophic Consequences

Because “bottleneck effect” is not in the lawhead vocabulary:

Health chiefs in Edinburgh want a network of tightly-regulated brothels to replace…[the] saunas…NHS Lothian revealed the plan during discussions with police and other agencies…Police Scotland are determined to close down Edinburgh’s saunas despite warnings that it will drive the sex trade underground and increase crime and sexually-transmitted diseases…A terse email from an unnamed NHS official said:  “Sauna owners are speaking to us about condoms and they are suggesting Police Scotland are insisting that ‘no items of a sexual nature will be permitted on the premises’…This will cause us big problems in terms of public health.”  Police Scotland replied…[that their] “aim is to stop the saunas being used for criminality – i.e. brothel keeping and other illegal activities”…

This essay first appeared in Cliterati on October 27th; I have modified it slightly for time references and to fit the format of this blog.

Nearly three years ago I wrote an essay entitled “Social Autoimmune Disorder”, in which I compared modern society’s persecution of sex workers to a disease “in which the body’s protective systems turn from attacking pathogens and other invaders to attack some portion of its own tissues instead”:

The bodies of societies sometimes also develop such syndromes; the systems which were meant to protect society from invaders or other troublesome organisms are instead turned against some of its own systems, sometimes even vital systems.  And just as in biological autoimmune disorders, those who are affected most are usually women…one…[example] is the continuing persecution of prostitutes in England and the United States, despite the obvious social function we serve…

macrophages killing cancer cellIn the past few decades police, especially in the United States and countries over which it has a powerful influence, have gone from primarily fighting those who harm the body of society (violent criminals) to primarily attacking the body itself (ordinary citizens accused of violating any of the countless laws against nonviolent, consensual behavior).  And when these infected police departments attack the mechanisms society has evolved to channel its libido, the metaphor folds back upon itself:  the figurative disease may result in the spread of literal disease.

Many of the persistent myths about sex work are exactly the opposite of the truth.  For example, prohibitionists often claim that pornography and stripping increase “violence against women”, when in fact the prevalence of rape, child molestation, domestic violence and other social ills decreases with the increased availability of, and decreased stigma against, porn and other forms of sex work.  Another looking-glass claim is that whores spread disease; in fact, the incidence of every kind of sexually-transmitted infection in developed nations is much higher in the sexually-active portion of the general population than it is among prostitutes, and only 3-5% of all STIs can be traced to either side of a paid sex transaction…which is to say that over 95% of them come from unpaid sex.  The reasons for this should be obvious: sex workers have a vested interest in keeping ourselves clean and we enter into relations calculatedly rather than in the heat of passion or as the result of inebriation, so we scrupulously use condoms while a great many amateurs (especially those under 25 and above 50) do not.

In a sanely-run world, sex workers would be held up as examples of how to have an active sex life while protecting oneself from the potential dangers thereof…but no part of this world is sanely-run.  Instead, sex workers are widely stigmatized where we aren’t outright criminalized, and the tools we use to protect ourselves are labeled “prostitution paraphernalia” in the diseased minds of the police.  In many places (including most of the United States), cops steal sex workers’ condoms and represent them as “evidence of prostitution”; the obvious effect of this is to discourage the use of condoms among everyone likely to be harassed by police, professional or not, thus resulting in a public health nightmare.  Unfortunately, the concept of harm reduction is completely alien to those who are obsessed with conformity, “law and order”, arbitrary rules and “sending messages”; they are wholly unable to recognize that their precious laws pose a clear and present danger to society, and therefore endeavor to enforce compliance even when the facts are directly before them.

sauna raidNor is this self-destructive behavior limited to countries where it is well-established by precedent; even in places where officials have by some miracle been made to see the wisdom of harm reduction policies, the police can be counted on to act in ways which endanger everyone unless they are forcibly restrained from doing so.  Scotland provides a perfect example: until recently, the country had eight different police forces; but when they were all brought under one umbrella, prohibitionist fanatics from Glasgow got in control,  and in only a few short months have done their level best to wreck the system of tolerated brothels which has kept Edinburgh sex workers safe for decades.  But in late October, they unveiled their crowning idiocy:

…Police chiefs [sent]…a letter…[asking] the city council to add new conditions to licences, including that “no items of a sexual nature will be permitted on the premises”…[HIV group the Terrence Higgins Trust and sex worker organisation Scot-Pep savaged the proposal, which they said would ruin decades of sexual health education]…A recent report by the World Health Organisation…read: “Condoms should never be considered to be evidence of sex work, either in official laws or through unofficial law-enforcement practices, and condoms should never be confiscated from sex workers”…[and] MSP Margo MacDonald said…“this…makes the police look…rather amateurish”…

The police, who were obviously unprepared for such strong resistance, backpedaled furiously:  “Police Scotland does not advocate the banning of condoms…at no point do the recommendations make reference to the banning of condoms…”  Pull the other one, gents; only the hopelessly gullible could believe that you didn’t intend the purposefully-vague “items of a sexual nature” to include condoms.  Fortunately, the council proved somewhat less credulous than they might have been, only allowing themselves to be bullied out of cancelling the licenses of six out of the thirteen saunas; the other seven were renewed without the foolish and dangerous restrictions demanded by the police.  It seems unlikely that this will deter their attempts to harass sex workers into hiding for very long, however; remember that the violent raids to which the saunas were subjected in recent months came despite the fact that their licenses were duly renewed last year.  Unless the burgeoning power of police to victimize peaceful people is radically amputated, it must eventually result in catastrophic consequences for any society so afflicted…and as I have warned many times before, though such consequences always start with sex workers or other marginalized groups, they never end with us.
