DNA animationOne month ago tomorrow, the United States Supreme Court ruled that it’s perfectly hunky-dory with them if cops take DNA samples from individuals arrested for “serious crimes”.  Not convicted of, mind you, or even charged with; merely arrested for is good enough.  According to these august legal minds (well, five of ‘em anyhow; Justice Scalia the Unpredictable and the entire distaff side of the court disagreed), no wrong has been committed if the cops respond to a rape by simply arresting every man in the vicinity, forcibly taking their DNA in order to “identify” them (Maryland’s excuse in the case), and then checking every sample against the rape kit.  As Scalia wrote, this constitution-shredding rationalization “taxes the credulity of the credulous”:

The Fourth Amendment forbids searching a person for evidence of a crime when there is no basis for believing the person is guilty of the crime or is in possession of incriminating evidence.  That prohibition is categorical and without exception; it lies at the very heart of the Fourth Amendment.  Whenever this Court has allowed a suspicionless search, it has insisted upon a justifying motive apart from the investigation of crime…

So let’s say that, in the example above, the police find the rapist.  Hooray for the diligent CSI heroes!  And then what happens to the DNA they took from all the other guys they brought in?  Why, it goes into a database, to be used however the police see fit, with no oversight or restraining policy whatsoever:

…a growing number of local law enforcement agencies…have [begun]…amassing their own DNA databases of potential suspects, some collected with the donors’ knowledge, and some without it.  And that trend…is expected only to accelerate after the Supreme Court’s recent decision…These…databases operate under their own rules, providing the police much more leeway than state and federal regulations.  And the police sometimes collect samples from far more than those convicted of or arrested for serious offenses — in some cases, innocent victims of crimes who do not necessarily realize their DNA will be saved for future searches…[some] agencies [even] pool…their…databases….and…rapid DNA testing devices…could provide a greater incentive for local authorities to build and maintain their own database…

DNA collectionAnd it’s not only suspects and crime victims:  some foolish hookers have voluntarily surrendered their DNA to the cops (supposedly so their bodies can be identified more easily if they’re murdered); equally-foolish parents are giving up that of their kids against the fabulously-unlikely possibility of abduction; in the UK cops regularly file children’s DNA; and in the US the government routinely takes and retains genetic material of newborns without parental consent.  And as of yesterday, Mississippi mandates the retention of DNA from babies born to mothers below 16:  “The DNA will go into a database from which police may draw if they begin to investigate whether the mother was a victim of statutory rape.  The DNA will not go into the statewide criminal database. That means the…father’s DNA is not available for matching for any other types of cases.”  It’s not available now, but of course that can change with the stroke of a gubernatorial pen.

But if you’re an adult and you’re never arrested for a serious crime or become a victim of such a crime yourself, and never, ever will be, you’re relatively safe, right?  Guess again.  Swanee Hunt and her ilk are pushing for the government to retain the DNA of any man caught in an “end demand” sting (using the excuse that Melissa Farley claims that clients commit “lots more crimes” than other men).  This is not only possible but likely under Maryland v. King because, as Scott Greenfield explains, there’s no “conceptual ledge” to stop the descent down that slippery slope from “serious crimes” to misdemeanors:

…DNA is collected from people convicted of crimes regardless of this decision, so they are by definition removed from the people affected by it.  That leaves only the people who are arrested but not ultimately convicted…Given…the fact that defendants are presumed innocent until convicted, there can be no question as a matter of law that…DNA [is] being seized from innocent people.  The argument in King is that these are defendants charged with serious offenses.  The purpose of this detail is to distinguish the swabees from people given traffic tickets, from whom DNA is not collected under this law…The problem with this rationale is that the defendants from whom DNA is taken, being innocent, are…innocent of everything.  They are innocent of traffic infractions and murder, all at the same time.  So what if they’re charged with serious offenses?  An innocent person charged with murder is still innocent, and indistinguishable from an innocent person charged with any other crime.  Or even the innocent person not charged with a crime, for that matter…

In other words, there is nothing – absolutely nothing – which can stop legislators from now allowing or even mandating DNA collection from anyone accused of any infraction, including solicitation.  Or “improper lane usage”.  Or cutting up in school.  What’s that, you say?  It wouldn’t bother you even if they made it a condition of getting a driver’s license because, hey, you have nothing to hide?  I’ll let Gideon take that one:

…great, can I have your credit card numbers and your social security number too?  No?  You mistrust me, a solitary individual against whom you have recourse, yet you willingly subjugate yourself to a faceless, untouchable government?  All it takes is an accusation…and…you’re condemned to navigate the panopticon…You know who decides what is a crime and what isn’t?  The government.  You know who decides who has broken the law?  The government.  You know who decides whether to prosecute an individual?  The government.  You know who puts on evidence to prove that someone is guilty of a crime (and usually wins)?  The government.  You know who uses DNA to prove guilt?  The government.  You know [who] has people (jurors) blindly following its dictates?  The government.  You know who you signed over your privacy, your personal information, your DNA to?  The government.  Think they won’t use it against you tomorrow if they suddenly dislike you?  If you answer yes…is it because…you don’t think this sort of thing will happen to you?…the Government isn’t seeking data on “non-privileged” people.  It’s all of us.  You.  Me.  The guy down the street.  You may think you’re different than me or my typical client.  The government doesn’t.  They’re the ones who you think will protect you, yet they’ve already proven that they see no difference between you and a criminal

DNA is a lot less volatile than a fingerprint; it can persist in testable form for decades.  If I sell my truck and the buyer then abandons it after kidnapping someone or robbing a convenience store,Vodoo doll guess whose DNA is all over the seats and steering wheel?  Oh, yeah, mine and my husband’s.  We leave DNA all over the place, every day, and if you think the cops wouldn’t use that “evidence” to connect you with a “crime”, guess again; it needn’t even be anything any reasonable person would consider a real crime.  Modern technology has made the old witchcraft belief a fact:  if an evil person gets ahold of some part of you, no matter how small, he then has power over you.  And modern police states want to ensure they have that power, to be used at the whim of any prosecutor, over every single living person within reach.

Another of the greats has passed on.  Though his name is less familiar to the general public than those of many far less talented and far less influential authors, virtually everyone has seen and appreciated screen versions of his work; he wrote almost half of the best Twilight Zone episodes, most of the Vincent Price “Poe” movies of the early ‘60s and many other films you may know (including the thrice-filmed I Am Legend).  And since I can’t possibly do his memory justice in this small space, here’s a proper tribute from regular reader Franklin Harris.

Beside the usual rampant illogic, mathematical illiteracy, blatant racism and “King of the Hill” foolishness, you’ve got to love Wendy’s claim that cops need to web surf all day to “find victims”.

P411 lilyTwenty-two female escorts were arrested last week during a two-day sting in…Denver…The women were advertising on two websites — DenverBackPage.com and Preferred411.com…” Despite the involvement of the FBI’s lugubriously-named “Innocence Lost” project, note that verified professional adult escorts were targeted via P411; these cops had no illusions they might find “trafficked children”.  In fact, the sting was enabled by one creating a fake profile and then arranging several “coffee dates” with escorts and asking for “OKs”, which the escorts gave in violation of P411 rules; their accounts were suspended for their negligence in enabling predatory monsters to hurt other sex workers.  Ladies, ONLY give OKs to men you actually see behind closed doors; how can you possibly know whether a man is dangerous if you’ve only seen him in public?

Profound Ignorance (TW3 #310)

A scathing demolition of the horrendous “study” which claimed legalized prostitution increases “sex trafficking”, and also of the “sheer implausibility of the claims that 30% of all prostitutes are trafficked…”:

The…scare campaign…over “sex trafficking”…becomes a complete and total mess…because [campaigners confuse]…the transport of unwilling people…into forced prostitution…and…the illegal movement of willing people across borders to enter the sex trade…people from poorer countries…wish to…move…to richer countries.  And such is the system of immigration laws that many of them will be unable to do this legally…

Cathy Reisenwitz also had a few things to say:

The Guardian recently quoted UK solicitor general Oliver Heald QC describing “victims” of trafficking as people who pay a lot of money to escape their home countries and then are forced to pay it back…That’s not slavery, it’s indentured servitude, and it accounts for two-thirds of immigrants to America from the British Isles in the 17th century.  Anti-prostitution and anti-immigration campaigners have  hijacked the term “human trafficking” to describe any instance of a person crossing a border to do sex work…It requires buying into the rather insulting idea that women aren’t capable of choosing to leave their homes and do sex work abroad…once you establish that women aren’t capable of making their own choices, you can justify taking all kinds of rights and liberties away from them…

The End of the Beginning

Corrections officials are refusing to remove a sex offender’s name from the state’s public database, defying [the] order…[of] The Court of Appeals [which] ruled…that [Robert Merle Haines Jr.] should not be named on the…registry because [it] did not exist at the time of his crime and registration would be a form of retroactive punishment, which the Maryland Constitution doesn’t allow.  Corrections officials say federal…requirements prevent them from complying with the ruling…

Another Small Victory (TW3 #317)

Consider for a moment the incredibly dangerous precedent a prosecution victory would have set; state “experts” would be allowed to define any person as a victim in any crime regardless of that person’s viewpoint.

More egregious use of “pimp” mythology to justify Nevada’s draconian “sex trafficking” law:

Because of their age, they will have difficulty working inside most [hotels].  For most, that means hitting the streets under the eye of a pimp and more experienced prostitutes.  And the more they must rely on the pimp, the more difficult it is to pry them from his clutches…So when Assembly Bill 67 surfaced…earlier this year, the police welcomed it as a way to send a message to pimps that there would be a higher price to pay for running young girls…

Once again:  teens don’t turn to sex work because a “pimp” abducts them from their loving families, and 84% of them have never as much as met one.

Macbeth and Banquo Meeting the Witches on the Heath by Théodore Chassériau (1855)Every profession has its superstitions, and those falling under the general heading of entertainment – acting, sports, music, sex work and others – are among the worst.  Athletes have various taboos about their equipment and some won’t change their clothes during a winning streak; actors won’t say the phrase “good luck” or mention the play Macbeth  backstage for fear of drawing down disaster; musicians often have lucky charms or pre-show rituals.  Since one of the greatest harms which can befall a whore is to be arrested, there are a plethora of magical rituals, formulae or prohibitions which are used by the superstitious to ward off that probability.  Not one of these has even the slightest basis in reality, but many swear by them and cannot be convinced that they do absolutely nothing to reveal a cop, prevent arrest or serve as a defense in court.

Probably the most common of these superstitions is the “cop test”; many hookers believe that there are certain things a cop is not allowed to do (such as take off his shoes, display his penis, feel her tits, etc), and therefore if a man will do one of those things he isn’t a cop.  Probably the most absurd of these is also the most common: it is believed (by many drug users as well as whores) that if a cop is asked the question “are you a cop?” or “are you affiliated with law enforcement?” or whatever, he has to answer truthfully.  These tests are doubly ridiculous because even if they were true in the first place (which they aren’t), a cop could still simply lie in the police report and in court to say he didn’t do whatever it was he wasn’t supposed to do.  This is why that other common ritual, the payment ceremony, is just as useless as the cop test:  if you let a cop in your door or walk into his, it doesn’t matter whether he hands you the money in an envelope or a roll, whether you count it in front of him or not, whether you pick it up or leave it lying on the nightstand, or even whether he gives it to you at all; the police report will say you agreed specifically to perform certain sex acts for a set sum, no matter what you actually did or said.  As the expression goes, “you can beat the rap, but you can’t beat the ride”; if you meet a cop and he wants to arrest you he will do so, even if you aren’t even a hooker, and no magical formula will prevent that.

abracadabraThe notion that certain rites, gestures and words will protect those who use them from malevolent beings is an ancient one, as is the complementary idea that these creatures cannot do perfectly ordinary things that humans can do with ease.  Vampires cannot pass running water, go out in the daytime or enter a house without permission; they are revealed by mirrors and repelled by crosses and garlic.  Devils cannot pass through certain magical inscriptions and must abide by the letter of any pact to which they agree.  Fairies are repelled by salt and iron, and can only gain power over mortals who venture away from known paths or break certain rules.  Why do people believe these things?  Why were the monsters of folklore not basically unlimited and virtually unstoppable like those in so many modern movies, and why do people insist on believing that the power of modern villains is bounded by these same kinds of mystical geases and taboos?  It’s because we need to sleep at night.  Vampires, devils and faeries were very real to our ancestors, unlike the fictional villains of modern movies; you know very well that Jason and Chucky and Freddy Kreuger and the alien aren’t real, so it doesn’t matter if there are no limits on their power.  But if you believed that they were real, and you lived in a thatched cottage that wouldn’t keep out a determined dog (much less a werewolf), you had better believe there were rules the monsters had to follow and wards to keep them away, or else you’d live in a perpetual state of fear.

Modern harlots are like those peasants of earlier times; we are surrounded by powerful predatory fiends lying in wait to pounce on the unwary victim in order to drag her off to their lair.  So it shouldn’t be terribly surprising that many of us choose to believe that there is a mirror or incantation that will dissolve their disguises and reveal the corrupt beasts beneath, or a charm that will offer protection to the one who knows how to use it.  Unfortunately, we are at a disadvantage in comparison to our ancestors:  while their magical wards never failed because the monsters they were intended to foil never truly existed in the first place, the threats to our freedom and safety are very real…and the magical formulae to which we cling are utterly powerless against them.

EeyoreI sometimes feel as though I’m becoming the Eeyore of the sex worker rights movement, the resident wet blanket who reacts to every bit of seemingly good news cheered by other advocates by letting them know exactly why it’s not as good as they think it is.  Now, that’s not really true because my overall outlook is that sex worker rights are inevitable; however, there are bound to be a huge number of individual developments between now and then, both good and bad, and I think it’s important to recognize which are which.  Take this one, for example:

…In a letter…to Commissioner Raymond W. Kelly, the Brooklyn district attorney, Charles J. Hynes, said his office would not use possession of condoms as evidence of prostitution or loitering for the purpose of prostitution.  “Accordingly…the collection and vouchering of condoms as evidence by members of your department…should immediately cease.”  Advocates for sex workers have argued that officers’ use of condoms to support their arrests discouraged prostitutes from using condoms, presenting a public health risk.  A 2012 report by…Human Rights Watch found that such arrests sowed a fear of carrying condoms among sex workers…the Police Department’s chief spokesman, Paul J. Browne, said the department agreed that “it is not necessary to seize condoms as evidence of the intent of an individual to engage in prostitution.”  But…[he] added:  “We do not rule out their evidentiary value when going after pimps and sex traffickers.  If there is a bowlful of condoms in a massage parlor, we want our officers to be able to seize them as evidence against the trafficker.”  While prosecutors are generally wary of excluding whole categories of evidence, there is a growing consensus that condoms should not be part of prostitution cases that do not involve sex trafficking…Nassau County…prosecutors already reject condoms as evidence, even in more serious cases.  “It was very important to me to also extend the ban to traffickers,” said Kathleen M. Rice, the…district attorney.  Without it, she said, “traffickers will refuse to hand out condoms to their workers and in fact prohibit their use”…

While advocates were cheering this two weeks ago, my immediate reaction was “In other words, they’re just going to label more cases as ‘trafficking’ now.”  That’s already happening all over the country, not just New York; what was once recognized at simple prostitution is now being shoehorned into the “trafficking” narrative so cops can brag about heroically “rescuing” women, prosecutors can score the bigger points inherent in felony convictions and both can steal money and goods from those so accused.  Nor does a lack of evidence have any effect; even when sex workers testify that they were not coerced, prosecutors simply discount their testimony as “false consciousness”.  Most hookers are not idiots; we can read what is plainly written on the wall.  When prosecutors say they will continue to use condoms as evidence of “trafficking” and then demonstrate that they intend to call most if not all sex work “trafficking”, the net effect is no change whatsoever.

And that’s not even the worst of it.  This action is a classic political dodge, exactly the same as the one used in San Francisco two months ago; making this a policy rather than a law allows it to be suspended at any time, which will be as soon as the heat is off.  Once the media forgets about the issue, the policies will quietly be rescinded as needed.  Of course, they don’t even need to do that; both San Francisco and New York still pretend that cops arresting whores is for our “protection” from those evil “traffickers” we’re too weak and childlike to “escape”.  Even the Nassau County DA quoted in the story, who might seem sympathetic, refuses to get it; she has aggressively pursued an “end demand” strategy which casts sex workers as the “victims” of evil clients rather than rational actors in a business transaction, and pretends big, bad “traffickers” are forcing workers to do bareback, when it’s actually their personal decision.  I predict a lot more district attorneys will make similar announcements this year; it’s an easy way for them to feign concern for us while conducting business as usual and getting the feds to pay for it.

Eeyore's houseThere’s one small glimmer in this gloom:  apparently, the American media pay enough attention to Human Rights Watch for its reports to become big news, and that news exerts sufficient PR pressure for governments to at least make a show of changing their policies; besides the condom report, a recent one on the dreadful harm the sex offender registry inflicts upon young people has likewise attracted considerable media attention and may soon result in a few of the braver politicians making displays of concern.  But while HRW is officially pro-decriminalization and last month openly called for it in China, the only thing it has so far asked of American “authorities” is a restriction of the sort of evidence they use to harass us; that will be changing soon, and I am told a full report on the injustices inflicted on sex workers in this country is forthcoming (complete with an explicit demand for decriminalization in the US).  Media coverage of that might engender a political pretense of looking at decriminalization which would be, as Eeyore put it, “Amusing in a quiet way…but not really helpful”; however, the resulting public discourse would help to shine light on matters the prohibitionists would prefer to remain obscure…and that would be a cause for optimism.

Traffic Jam

Remember the supposed “child sex trafficking ring” run by “Somali gangs” that federal prosecutors were all puffed up about last year?

…every defendant who has gone to trial has either been acquitted or had their conviction thrown out.  The government’s case was weakened when…a key witness…refused to testify, saying he is afraid for himself and for his family.  So prosecutors charged Abdullahi Farah with two counts of contempt of court and obstruction of a child sex trafficking case.  He was convicted…in April…and…is facing a maximum of 20 years…for the obstruction conviction…and…life in prison [for contempt]…Legal experts say…it’s almost unheard of for prosecutors to come down so hard on one of their own witnesses…

Considering that “agents said Farah gave conflicting accounts and sketchy details” and the judge “said he had problems with Farah’s credibility”, I think the truth is obvious:  sleazebag prosecutor Van Vincent tried to pretend a bunch of petty thugs were a gigantic conspiracy, but drew a judge who wouldn’t roll over for him and is taking it out on the only available scapegoat.  Consider the prospect of life in prison for a contempt charge, and then tell me the US isn’t a police state yet.

Absolute Corruption

Of those who report their rapes, around 4–5% also describe experiencing orgasm. And here’s the reality.  Obviously, the general doesn’t consider beatings and gang rape by the police to be forms of oppression.

Few arrestees qualify for the “diversion” program, and of those who do only a third complete it.

According to Because I’m a Whore, this bill is much better than the last one and has the support of sex workers; if passed, South Australia would be the third place in the world to have true decriminalization.

Quinn…said she disagreed with publicizing the names…[but] favored an “incredibly effective” program in Brooklyn…that forces “johns” to sit through a program intended to deter bad behavior…

And no, “john schools” are not “incredibly effective”.

Finding What Isn’t There

police admit they do not know the scale of trafficking in Victoria’s illegal brothels and cannot say how many…there are.  The cloak of anonymity and secrecy surrounding the industry makes it hard for police to investigate, Senior Sergeant Marilynn Ross told [a parliamentary] inquiry…”we suspect that in a small number of…licensed brothels human trafficking is occurring…on a…larger scale”…

Translation:  “There’s no evidence whatsoever and the real experts say otherwise, but this makes a perfect excuse to ask for more power to stick our noses into people’s private business.”

Worse Than I ThoughtTraffic in Souls

As I predicted, the cancer of incredibly-broad “sex trafficking” laws based on the CASE Act is spreading, now to Pennsylvania:

House Bill 663, which was unanimously passed 195-0…expands what the state considers “commercial sex acts” and raises the crime of buying or selling people for sex work from a third-degree to a…first-degree felony.  Under the new bill, the definition of commercial sex includes being forced to perform “any sexual activity…in which anything of value is given…or received”…

The bill’s sponsor complains that the “current law is vague”, but what he actually means is that it isn’t vague enough.

So Close and Yet So Far

Another would-be ally misses the bus by not bothering to check with sex workers first; though she makes several very good arguments against criminalization and recognizes from the title on that sex work is work, she also overestimates the role of pimps and the prevalence of street work, accepts the false “sex trafficking” dichotomy, supports regulation and licensing and ends by undermining her own argument with the typical mealy-mouthed disclaimer, “I am not endorsing the act of selling sex.”

Another rescue industry icon is exposed as a con artist:

The media have conflated two totally different statements.  What Hashimoto said about military personnel needing whores is true and every experienced commander knows it, no matter what political crap the Pentagon may emit.  But that isn’t the same as his disgusting rationalization of the enslavement of the comfort women, who were neither professional sex workers nor volunteers.

It’s great to see ever-larger numbers of academics openly declaring that the “trafficking” narrative is largely an excuse for restricting migration:

“anti-trafficking”…essentialises gender and childhood, it confuses and obfuscates, and…it…acts against the interests of many that it purports to serve…the state is directly and inescapably the source of vulnerability…those formally excluded are given…the right NOT to enter, to be protected from movement.  The [victim of “trafficking”]…is supposed to return home.  Indeed the narrative is that she wants to return home, and part of her innocence and victimhood is that she never wanted to move in the first place…immigration controls are claimed to be a mechanism of protection for migrants, rather than a mechanism of oppression…

And here’s a UN official on bogus data and bad definitions:

…data is often taken from methodologies that are not…estimates…media…have often reported that 79% of trafficking is for sexual exploitation, based on the “Global Report on Trafficking in Persons” by UNODC…[but] the data is of victims identified by state authorities and of convicted traffickers…The internationally recognized definition of human trafficking states the purpose of human trafficking is for exploitation…yet [it] is…equated with sex work or irregular…migration…as a result…data on trafficked persons almost exclusively focused on women and children trafficked for sexual exploitation…

St. John’s, Newfoundland has just over 200,000 people, which means fewer than 100,000 males.  The escort interviewed for this article (“Iris”) says there are about 30 escorts working there full-time, and doing such good business travelling girls are stopping in as well.  Now, ask yourself:  is it credible that only about 14,000 of those men have ever paid, that the majority of those who did are now regulars and that those working girls are doing well on an average of 1 client per day?  Or is it more likely that the claim few men ever pay for sex is completely absurd?  As Iris said, “We wouldn’t be doing this well if your husbands and boyfriends and friends weren’t coming to see us.  It’s that simple.”

To make a great distinction between being paid for an hour’s sexual services, or an hour’s typing, or an hour’s acting on a stage is to make a distinction that is not there.  –  Margo St. James

Margo St. James in WashingtonForty years ago today (on Mother’s Day of that year), Margo St. James founded COYOTE, the very first sex worker rights organization.  Ironically, she was set on that path in 1962 by a cop who decided she looked like a streetwalker and a judge who convicted her of prostitution without any real evidence:  “I said in court, ‘Your honor, I never turned a trick in my life!’ he responded, ‘Anyone who knows the language is obviously a professional.’ My crime was I knew too much to be nice girl.”  Once she had a criminal record, she found that she could not get any other work, and so decided she might as well do what she had been accused of.  And though she only worked for four years, she continued to identify with the hookers and eventually founded an organization called WHO:

…Whores, Housewives and Others.  Others meant lesbian, but it wasn’t being said out loud yet, even in liberal bohemian circles.  The first meeting of WHO was held on Alan Watt’s houseboat.  The name COYOTE came from novelist Tom Robbins who dubbed me the COYOTE Trickster…Richard Hongisto, a liberal sheriff elected in San Francisco about that time attended my parties.  He had been a cop, and had a sociology degree.  I…asked him what it would take to get NOW, and Gay rights groups to support prostitutes’ rights…He said that we needed someone from the victim class to speak out…I decided to be that someone…and I hoped the hookers would join me.  The PR people responsible for getting the sheriff elected volunteered to help me with COYOTE…I started organizing internationally with…Jennifer James, an anthropology professor…[who] coined the word decriminalization and was responsible for getting NOW to make it a plank in their 1973 convention.  COYOTE published a newsletter from 1974-79 and the Hooker’s Ball became popular, attracting 20,000 people in 1978…

Let that sink in:  the largest mainstream feminist organization actually supported sex worker rights for a short time, though the neofeminists destroyed that within just a few years.  Still, it looked for a while as though there was nowhere to go but up.  COYOTE chapters sprang up in Sacramento and Florida, and similar organizations were formed elsewhere; there was PONY in New York, PUMA in Massachusetts, CUPIDS and PEP in Michigan, KITTY in Kansas City, PASSION in New Orleans, OCELOT in San Diego, KAT in Los Angeles, ASP in Seattle and DOLPHIN in Hawaii.  On June 2nd, 1975 French whores in Lyon held the protest which led to the formation of the French Collective of Prostitutes, and a sister organization soon formed in England; they and several others joined with COYOTE “to form the International Committee for Prostitutes’ Rights (ICPR), the organization whose work and example helped to win prostitution law reform in a number of European countries and provided an example which inspired similar campaigns in many other parts of the world.”  In 1976, COYOTE filed the lawsuit which led to decriminalization in Rhode Island, and by 1977 even well-known journalists and politicians were listening.

Had HIV not arrived on the scene a few years later, criminalization might have been merely a black period of history by now.  But arrive it did, swinging the balance of power to the neofeminists and their fundamentalist Christian allies.  Margo moved to Europe to help sex worker rights efforts there, and COYOTE was directed by Samantha Miller and Gloria Lockett, who worked to make the organization more responsive to the concerns of minority sex workers and those who weren’t escorts (including strippers, phone sex operators, etc).  During the AIDS panic of the ‘80s and the neofeminist ascendance of the ‘90s, COYOTE was too busy fighting disinformation and stigma to make any actual progress, and by the time new organizations like SWOP started to appear around the turn of the century it had run out of steam.St. James Infirmary logo  Margo (who had returned to the US in 1993) decided to concentrate on sex worker health, and in 1999 COYOTE became the St. James Infirmary, which provides free medical care and social services for sex workers.  The only other remaining chapter is the Los Angeles one, which has been inactive since about the same time.  But though the mother of all sex worker organizations has ceased to exist in its original form, every current activist group owes it – and Margo – a debt of gratitude for showing that it could be done.

R.I.P. Ray Harryhausen

The greatest special-effects artist of all time has passed away at the age of 92.  His movies are among my all-time favorites, and no digital creature has ever entertained me as much as Ray’s masterful puppetry still does.  And even though he’s been retired for 32 years, I don’t think I’m alone in feeling that the world will be just a little less magical without him.

A Colorado woman was convicted of prostitution for answering a personal ad; after trying to talk her into having sex in a parking lot, a disguised cop “shoved a fistful of cash in front of her face and issued a command: ‘TAKE IT!’…Moments later, the car was surrounded [by] ‘Guns and guys in black with masks on’…the prosecution focused on the word ‘roses’ in the Craigslist ad…”  Maybe if this sort of thing starts to happen more often, amateurs will start to wake up to the fact that anti-whore laws harm everyone.

A Tale That Grew in the Telling

Last month saw the publication of the EU’s first Trafficking in Human Beings report, which…is (properly) littered with disclaimers…Unfortunately…the press release…[went] for the handy soundbite…so we’ve been deluged with headlines like “Human trafficking increased by 18%” when…the report doesn’t show it did any such thing…if all the statistics were accepted as readily as the “18% increase” has been, it would be a little bit inconvenient for some…Contrary to what we’re constantly told by the anti-trafficking movement, the most recent figures make it hard to discern any link between trafficking and the legal status of sex work.  The Dutch rate is very high, but the Cyprus rate is higher – and Cyprus has much stricter laws than the Netherlands…Romania, where sex work itself is illegal, is nearly as high.  Hungary (legal), Portugal (legal) and Lithuania (illegal) are tied for last.  Austria and Germany are also relatively low – in fact, Germany and Sweden are tied, at 0.8 per 100,000.  And the German rate has remained more or less constant over the three years surveyed, while Sweden’s has quadrupled…But sex workers’ rights advocates shouldn’t leap on those figures, either, because truthfully the whole report is pretty hopelessly undermined by its methodological weaknesses…

Sometime…[in] April, an Ohio transgender woman was…stabbed repeatedly and then tied to a concrete block and cast into a pond.  She was left with no clothes below the waist, perhaps to shame her…But…insensitive stories by the local press…[wrote] about [her] as if she were a bizarre spectacle, not a victimized human being…the Cleveland Plain Dealer…used a mugshot of [Cemia] Acoff instead of the other readily available photos…the [headline which now reads]…“Oddly dressed body found in Olmsted Township identified,” originally said “oddly dressed man,” (you can see it in the url; it was changed after readers and activists protested)…the story [also] refers to her as Carl Acoff (her birth name) and uses a male pronoun...[a follow-up] story…details what she was wearing…lists old petty “crimes”…[and refers to the] hormones [she was carrying as] “dangerous drugs”…

The Widening Gyre (TW3 #317)

Maddie Collier’s response to Rakhi “pop stars cause sex trafficking” Kumar is well worth reading in its entirety, but here’s a sample:

…The anti-sex trafficking cause is already thick with moral panic, misinformation, and ill-informed, PR-boosting celebrity activists, and you’re cluttering the already-diminished discourse with further nonsense….[which spawns] attitudes and policies that actively harm sex workers.  You are ignoring the freely-available  perspectives and requests of real-life sex workers because they interfere with your romantic notion of the Prostituted Woman as a forlorn, passive victim who needs to be saved.  If you engage with sex workers before you form a view on what’s oppressing them, you might find that criminalisation and stigma are higher-priority concerns than mythical drug-dealing pimps wielding persuasive charm and Beyoncé’s hotpants…

Anatomy of a Boondoggle (TW3 #317)

The newest excuse for police rape of sex workers is that Asian massage parlors are “sophisticated”:

…an undercover police officer…[repeatedly paid for sex] over five months…in a fight against prostitution and human trafficking.  Officers say such methods led to…[their raiding] two businesses [and] arresting…four alleged prostitutes and two alleged pimps.  But the methods…were criticized…by legal…experts and women’s advocates as excessive, unnecessary and misapplied…prostitutes can be arrested and charged in Indiana as soon as an agreement to pay for a sex act is made…Plus…if the women indeed had been…working…against their will, the sex acts they performed on the officer only contributed to their humiliation, exploitation and degradation…Aaron Dietz, head of the…Task Force…which conducted the nine-month sting, said…the sophisticated nature of the prostitution ring required officers to take more extreme measures…Dietz and others wanted to emphasize that it was not a pleasurable experience for the officer, but entirely necessary.  “No one…really wants to go into these…It’s something that’s ethically and morally very trying, so I’d do anything to keep guys out of there.”

You’d do anything?  Then how about advocating for decriminalization, you fucking filthy liar?
