The Rape Question

Imagination Pinned Down

This is just a typical lurid “survivor” narrative, but contains an unusually telling passage near the end:  “For 17 years, Lloyd told no one what she had been through…Six years ago, she contacted the Human Trafficking Task Force of Southern Colorado and met people who convinced her that she was dragged into a life of prostitution — and that it wasn’t her fault…” As usual, all events are conveniently decades in the past, with no witnesses, and she only came out with it after others convinced her that it happened.

With Friends Like These…

The title is, “For Smart Prostitution Laws, Ask a Prostitute”.  The first couple of paragraphs sharply criticize the Canadian laws which were struck down, and the middle section discusses misconceptions about sex workers and implies we need to be consulted on new laws…then the author rapidly descends into evil pimps and helpless victims, and concludes by advocating the Swedish model.

Watershed

Slowly but surely, it’s becoming acceptable for female public figures to declare their support for something other than criminalization of sex work. Legal journalist and former assistant district attorney Robin Baton recently published “Why Prostitution Should Be Legalized in the U.S.”, and while she fails to see the problems with the license-and-regulate view that’s probably just because she hasn’t thought it through; she uses arguments based on the principle of self-ownership, the lack of a bright, clear line between prostitution and other female behaviors, and the sports analogy.  And though (as Scott Greenfield expressed it) “she’s no Maggie McNeill”,50 Canadians Who Changed The World it’s still good to see this in a US medium.

Book Reviews (TW3 #339)

Another honor for Chester Brown, the acclaimed cartoonist (and friend, and reader) who drew the cover for my book:  he’s been included in a new book entitled “50 Canadians Who Changed the World”.  Chester says the book isn’t very good and downplays his hiring of sex workers (depicted in Paying For It), but I still think it’s great that he was picked out of the many notable Canadians the author could’ve written about.

Though the talk of criminality and disease is typical in the West, I simply cannot fathom why so many people whose minds were not broken by Mao are nevertheless happy to repeat the ludicrous propaganda that prostitution magically ceased to exist after his official proclamation.

Mary Honeyball, desperate to smear the 549 organizations (it has since grown to 560) who spoke out against her revolting scheme which this week imposed the Swedish model as a non-binding standard for all of Europe, fell back on the usual ridiculous neofeminist ad hominem by branding them all “pimps” (savor the absurdity of that for a moment before proceeding).  The ICRSE naturally had an answer to that, and here our friend Laura Lee and ally Dr. Belinda Brooks-Gordon confront Honeyball on Newsnight.

The Swedish model’s detachment from reality is so profound even Time magazine can’t miss it, despite the reporter’s belief in “sex trafficking” myths.

Why is it that people just don’t get that sex work follows the same rules of economics as any other business?

P411 lilyTwenty-two female escorts were arrested last week during a two-day sting in…Denver…The women were advertising on two websites — DenverBackPage.com and Preferred411.com…” Despite the involvement of the FBI’s lugubriously-named “Innocence Lost” project, note that verified professional adult escorts were targeted via P411; these cops had no illusions they might find “trafficked children”.  In fact, the sting was enabled by one creating a fake profile and then arranging several “coffee dates” with escorts and asking for “OKs”, which the escorts gave in violation of P411 rules; their accounts were suspended for their negligence in enabling predatory monsters to hurt other sex workers.  Ladies, ONLY give OKs to men you actually see behind closed doors; how can you possibly know whether a man is dangerous if you’ve only seen him in public?

Profound Ignorance (TW3 #310)

A scathing demolition of the horrendous “study” which claimed legalized prostitution increases “sex trafficking”, and also of the “sheer implausibility of the claims that 30% of all prostitutes are trafficked…”:

The…scare campaign…over “sex trafficking”…becomes a complete and total mess…because [campaigners confuse]…the transport of unwilling people…into forced prostitution…and…the illegal movement of willing people across borders to enter the sex trade…people from poorer countries…wish to…move…to richer countries.  And such is the system of immigration laws that many of them will be unable to do this legally…

Cathy Reisenwitz also had a few things to say:

The Guardian recently quoted UK solicitor general Oliver Heald QC describing “victims” of trafficking as people who pay a lot of money to escape their home countries and then are forced to pay it back…That’s not slavery, it’s indentured servitude, and it accounts for two-thirds of immigrants to America from the British Isles in the 17th century.  Anti-prostitution and anti-immigration campaigners have  hijacked the term “human trafficking” to describe any instance of a person crossing a border to do sex work…It requires buying into the rather insulting idea that women aren’t capable of choosing to leave their homes and do sex work abroad…once you establish that women aren’t capable of making their own choices, you can justify taking all kinds of rights and liberties away from them…

Another Small Victory (TW3 #317)

Where are the Victims? (TW3 #322)

A novel attempt to use New York State’s sex trafficking law…ended with mixed results…as the men were convicted…of promoting prostitution and of money laundering, but…acquitted of…sex trafficking…The law defines trafficking based on the methods the pimps use to control the prostitutes, rather than whether the prostitutes view themselves as victims…prosecutors…presented an expert to testify that women working as prostitutes are often not aware that they are victims.  But three of the women themselves  testified for the defense…and…were upset…at the…[suggestion] they were not to be believed…

Consider for a moment the incredibly dangerous precedent a prosecution victory would have set; state “experts” would be allowed to define any person as a victim in any crime regardless of that person’s viewpoint.

More egregious use of “pimp” mythology to justify Nevada’s draconian “sex trafficking” law:

Because of their age, they will have difficulty working inside most [hotels].  For most, that means hitting the streets under the eye of a pimp and more experienced prostitutes.  And the more they must rely on the pimp, the more difficult it is to pry them from his clutches…So when Assembly Bill 67 surfaced…earlier this year, the police welcomed it as a way to send a message to pimps that there would be a higher price to pay for running young girls…

Once again:  teens don’t turn to sex work because a “pimp” abducts them from their loving families, and 84% of them have never as much as met one.

Traffic Jam

Remember the supposed “child sex trafficking ring” run by “Somali gangs” that federal prosecutors were all puffed up about last year?

…every defendant who has gone to trial has either been acquitted or had their conviction thrown out.  The government’s case was weakened when…a key witness…refused to testify, saying he is afraid for himself and for his family.  So prosecutors charged Abdullahi Farah with two counts of contempt of court and obstruction of a child sex trafficking case.  He was convicted…in April…and…is facing a maximum of 20 years…for the obstruction conviction…and…life in prison [for contempt]…Legal experts say…it’s almost unheard of for prosecutors to come down so hard on one of their own witnesses…

Considering that “agents said Farah gave conflicting accounts and sketchy details” and the judge “said he had problems with Farah’s credibility”, I think the truth is obvious:  sleazebag prosecutor Van Vincent tried to pretend a bunch of petty thugs were a gigantic conspiracy, but drew a judge who wouldn’t roll over for him and is taking it out on the only available scapegoat.  Consider the prospect of life in prison for a contempt charge, and then tell me the US isn’t a police state yet.

Absolute Corruption

Natural Processes

Against Their Will

Careful reading finds the most interesting details tucked away in news stories: “Senators [in the Philippines support]…strengthening the law against human trafficking… the bill…[would] ensure added protection for…law enforcers, who have been recipients of harassment suits for ‘lawful acts done in good faith during authorized rescue operations’…”  In other words, it makes cops and bureaucrats immune to lawsuits filed by sex workers who were “rescued”Fuck you, traitor against their will.

If this article had been published in the US, you can bet it would be warped to fit the “trafficking” paradigm.  But since it’s from Al Jazeera, the problems are discussed without denying the women’s agency or the advantages of their arrangement:

The European Women’s Lobby (a group so detached from reality that it believes a video of a dude performing cunnilingus on a bunch of women will somehow turn men off to paying for sex), claiming to represent over 200 (unnamed) women’s groups, last week “demanded” the European Union impose the Swedish model on member states despite the fact that it does not actually have that power.  The English Collective of Prostitutes responded with a well-linked nine-point refutation of the EWL’s absurd, unsupported claims; guess which one got worldwide media coverage?

Considering how much money US Marines collectively spend on sex workers every year, it’s absurd for some Marines to make nonsensical anti-sex work statements just to please prudes.

What a Week! (TW3 #22)

I’m sure this had absolutely nothing to do with the owner’s winning a judgment against the city a few months ago:  “State and federal police have raided inner-city Sydney brothel Stiletto, owned by gambling identity Eddie Hayson…A spokeswoman for NSW police said the search warrant was attached to a joint operation codenamed Polaris making investigations ‘into a drug and money laundering syndicate’…”  Unsurprisingly, they found absolutely nothing.

Officials admit that they knew their law to hold websites criminally liable for third-party content was unconstitutional:

The state of Washington has abandoned its defense of legislation…that could have exposed website operators to legal liability…The Internet Archive, represented by the Electronic Frontier Foundation…worried that [the law] could effectively make its archives of the Web illegal…so it joined a lawsuit by Backpage.com…now Washington state officials have…[agreed] to permanently block the law…[and] will pay $200,000 to defray the plaintiffs’ legal expenses, and Washington state attorney general Rob McKenna will “work with the…legislature to repeal the current unconstitutional version” of the law.

A Tale That Grew in the Telling (TW3 #35)Sunitha Krishnan

You’d think that in the age of ultra-realistic digital effects, people would recognize that just because someone made a movie doesn’t mean the subject is real:  “[Sunitha Krishnan] has rescued thousands of women from prostitution and [has taken]…her advocacy to films, through [Ente,] a depiction of a real life sex-trafficking story…The activist…says she has received death threats and been targeted by acid attacks and even beaten up over a dozen times…”  All the beatings have succeeded, yet not one of the acid attacks or death threats have?  How convenient!

The Course of a Disease (TW3 #49)

Kate Gould is not a sex worker, but she’s done her homework and clearly “gets it”.  Her attack on Rhoda Grant’s Swedish model campaign, “Why I’m Opposed to Criminalising the Purchase of Sex”, is excellent, but the comment thread is suffering from the usual influx of lie-vomiting trafficking fanatics and deserves input from rational sex worker supporters (hint, hint).  Meanwhile, here’s Dr. Brooke Magnanti on how the proposed law as written will actually (like California’s Proposition 35) criminalize many human interactions virtually nobody would call “prostitution”.

This Week in 2010 and 2011

This week I exploded lots of lies, including ones about adolescents, the Super Bowl, decriminalization, STIs in porn, the purpose of a law, prostitution terminology and “sex trafficking”, and Julian Assange.  We also looked at bad jobs and the meaning of “legalization”, and saw a sleighful of short articles on HIV, halfway whores, maid cafes, sex rays, spiders, Rachel Wotton, Jill Brenneman, an important “trafficking” study, pompous masseuses, politician sex crimes, France, a pervert prosecutor, lethal butt injections, “sex school”, schadenfreude, Pedobear and strippers.

Usually when I report on a number of short news stories in a column, I have some sort of commentary on them; these stories, however, largely speak for themselves so I present them with only minimal comment.

Well, At Least They’re Consistent

Florida is well-known for its legislative and judicial excesses, but back in the Social Purity Era its legislators apparently decided that fornication should be illegal whether money changed hands or not.  The law has rarely been enforced, but a legislator now wants to get rid of it and other outdated laws; as you might expect, none of his colleagues are interested.  From the August 31st Sun-Sentinel:

…”Cohabitation” of unmarried people is currently a second-degree misdemeanor, punishable by $500 or up to 60 days in jail.  The same penalty applies to cheating husbands and wives — though only to opposite-sex couples.  The laws have been on the books since the late 1800s, but are rarely enforced.  In 2006, though, a Jacksonville woman did take advantage of the law and have her husband arrested for cheating, according to a news report.  (It’s not clear how the case came out.)  Now, Rep. Ritch Workman, R-Melbourne, is on a mission to repeal the statutes penalizing adultery and cohabitation, as well as other laws he finds outdated, like a requirement that all bicycle riders keep one hand on the handle bars.  He filed…the bill last week — it’s HB 4021 — though he hasn’t returned phone calls about it for the past two days.

Nobody else much wants to talk about it either.  Asked how Gov. Rick Scott felt about the measure, spokeswoman Amy Graham replied simply, “This isn’t an issue the governor is focused on.”  The bill has no Senate counterpart.  And given the almost-certain opposition of social conservatives who lobby hard on “family values” issues, it’ll face tough sledding in an election year.  Consider the response of State Rep. Dennis Baxley, R-Ocala, who previously headed the Florida chapter of the Christian Coalition:  “I’m not ready to give up on monogamy and a cultural statement that marriage still matters,” he said.

I guess Workman hasn’t yet learned that most politicians never want to limit the number of ways they can harass, threaten and persecute people.

Somehow, I Doubt He Thought This Through

A Kansas man who called police yesterday to claim that he was robbed by two female escorts hired via an online service later admitted that he just “wanted a refund” from the women.  Ahmed Hasnain, 26, was arrested on a misdemeanor charge in connection with the bizarre incident at a Motel 6 in Wichita, according to a Wichita Police Department report.  Hasnain…told cops that he had expected only one hooker to show up and “didn’t like that there were two women.”  After paying the pair $160, Hasnain decided that he wanted his money back…So…[he] called 911 at around 5 AM to lodge his complaint. Based on his own statements, Hasnain was charged with patronizing a prostitute. Perhaps he will consider calling the Better Business Bureau the next time he wants to register a consumer complaint.

And perhaps in the future he’ll also reserve 911 for real emergencies, like McDonald’s running out of Chicken McNuggets.

The British Policy on Sex Rays

In the United States, teachers who are discovered to have done sex work in the past are removed from the classroom lest their bodies emit invisible “sex rays” which might contaminate the tender little asexual innocents who discover them by watching porn.  In England, sex-ray phobia is just as prevalent, but apparently bureaucratic inertia protects sex-working teachers despite their being officially condemned.  According to a BBC story from September 1st:

Benedict Garrett, 31…was found guilty of unacceptable professional conduct but left free to continue teaching.  A disciplinary hearing was told pupils at Beal High School in Ilford had seen him in a trailer for a porn film.  Mr Garrett said:  “What is wrong about it?  I can’t see anything…I don’t think I’ve done anything that goes against my values and I worked incredibly hard as a teacher.  What a teacher chooses to do in their life outside that work is up to them.”

…Mr Garrett…whose [stage name] is Johnny Anglais, said he had no plans to return to teaching…He admitted it “might be slightly embarrassing” if students had seen his porn films, but “no more than me starring as a monkey in the school musical”.  He said students should not have seen his pornography work, as it was intended for over-18s, but added:  “It’s perfectly natural.  Get over it.”  He added he did not see himself as a role model, asking:  “If teachers are role models, why do we tolerate teachers who smoke, when smoking is linked to thousands of deaths?  Do we look at teachers who are fat and say you shouldn’t be teaching?  Obesity is linked to thousands of deaths,” he added.  “However, I’ve heard from students who have told me they believe I’m a role model because I’m standing up for what I’ve believe in.”

Norman Wells, from the Family Education Trust, which campaigns against pornography and supports policies which promote marriage, said:  “Benedict Garrett is being naive if he imagines that performing as a stripper and appearing in porn films is compatible with teaching responsible attitudes towards sex and relationships as a teacher of personal, social and health education.  The vast majority of parents would be uncomfortable, to say the least, to have their children taught by someone involved in the sleazy world of the sex industry.”

Presumably, the sleazy world of politics is OK with Mr. Wells.  Maybe Melissa Petro and Tera Myers should move to the U.K.

Michael Weinstein Isn’t Happy About This

More news about the porn performer mentioned in my column of September 1st, from the Huffington Post of two days later:

An adult film performer who tested positive for HIV and caused the porn industry to shut down production as a precaution has been retested and…does not have the virus…production can now resume, said Free Speech Coalition executive director Diane Duke.  “The industry will be abundantly cautious as we try to nail down the reasons for what now appears to have been a false positive result on a previous test,” Duke said.  The actor, who was in Florida, had been slated to work on a shoot for Mofos.com, but production was halted last week when the test came back positive for HIV.  Duke declined to release the performer’s name, age or gender, citing the person’s right to medical privacy.  She also declined to say how her group learned of the case…which…was found at an out-of-state clinic that does not report to California health officials, Duke said.

The porn industry was similarly shuttered in late 2010, after porn actor Derrick Burts was diagnosed as HIV-positive.  His case was confirmed, and he has since left the industry to become an advocate for the use of condoms in pornography.  The Free Speech Coalition is working on a database to track sexually transmitted disease testing among porn actors, a task formerly handled by the Adult Industry Medical Healthcare Foundation before it closed in December 2010.  Known as AIM, the San Fernando Valley clinic had catered to porn stars since it opened in 1998.  It was forced to close because of inadequate licensing.

The last line is incorrect; the clinic was actually forced to shut down by an illegal “cease and desist” order from the Los Angeles Department of Public Health, as reported in my column of March 7th.
