Pyrrhic Victory (#974) 

When a headline asks a question, the answer is nearly always “no”:

…the Facial Recognition Technology Warrant Act…would require federal officials to get a warrant if they’re going to use facial recognition technology to attempt to track a specific person’s public movements for more than 72 hours.  The bill does not prohibit the use of facial recognition technology to identify people or…to monitor events in real time.  Indeed, it says the authorities can use facial recognition to identify people, even without a warrant, as long as “no subsequent attempt is made to track that individual’s movement in real time or through the use of historical records after the individual has been identified”…The bill also doesn’t stop the feds from accessing or using the hundreds of millions of face pictures they’ve already collected from drivers licenses and passports.  In fact, it specifically gives such use a thumbs-up…

The biggest problem with democracy is, of course, that being oppressed by violent thugs enforcing bad, evil laws invented by self-serving sociopaths who win popularity contests isn’t really a lot different from being oppressed by violent thugs enforcing bad, evil laws invented by self-serving sociopaths who are descended from other self-serving sociopaths who were on the winning side of some war centuries ago.  Without a solid constitution guaranteeing individual rights against a government whose powers are strictly enumerated, how the oppressor class justifies its tyranny is of little consequence to anyone who doesn’t have a say in the proceedings.  After all, “democratic” American institutions approved of the claimed ownership of human beings until mid-19th century; the violent oppression of racial and ethnic minorities until the mid-20th century; the violent oppression of most sexual minorities until the beginning of the 21st century; and the violent oppression of some sexual minorities (not to mention the de facto violent oppression of some minority groups and the de jure oppression of others) to the present day.  As a member of one of those groups, I can assure you that it’s cold comfort to know that the rapist thugs trying to destroy my life employ excuses made up by many power-mad busybodies rather than by a few power-mad busybodies, or that those busybodies were supposedly picked by “the people” rather than by a god or gods.

At one time, one’s religion was almost entirely determined by where one was born; Greeks followed the Greek religion, Egyptians the Egyptian religion, Chinese the Chinese religion, etc.  Most people simply followed the religion they were born into, and the few who questioned it were, in general, either banished or violently murdered.  But as humans started moving around more and even mixing with people who were born in different places, they became more tolerant of foreign religions; to be sure, there were still plenty of jihads, witch hunts, inquisitions and the like, but in the truly great cities a number of different religions might coexist with little friction.  And in the modern world, most developed areas are home to people of at least several different religions, and many choose to have no religion at all.  But while religion has thus developed to be less intrinsically tied to circumstances of birth than it was for most of human history, its twin sister nationality has barely developed at all.  It was very easy for me to renounce Catholicism; I didn’t have to move or lose my friends or property, and the only social consequence was some disapproval from a few members of my family.  And while it’s certainly true that renouncing religion is a lot harder than that in some places (for example, in some parts of the Muslim world), renouncing nationality is universally difficult (and sometimes virtually impossible).  Renouncing Americanism would require me to lose my home, my friends, and many of my assets; I’d have to get used to different ways, possibly even learn a new language, and could look forward to being seen as an outsider in my new land for the rest of my life.

It doesn’t have to be this way; some political thinkers have proposed that government, which we conceive of as rigidly connected to a physical territory, could be as borderless as religion has largely become.  People could choose a government as they can now choose a religion; they would be subject to that government’s laws and taxes (and reap whatever benefits it offered) just as they now are subject to the restrictions and tithes (and reap whatever benefits) of their chosen religion.  No doubt most would stay with their nationality of birth, just as most people stick with their native religion; there would probably be large areas where most people belonged to one nationality or another, just as the majority of Brazilians are Catholic, the majority of Iraqis are Muslim and the majority of Indians Hindu.  But nobody would be forced to uproot and lose everything merely to change government, and being stateless or anarchist would be no more difficult than being agnostic or atheist currently is in the Western world.  If you want a different model of how this would work, consider insurance companies; nobody thinks it’s weird or threatening that their friends or neighbors pay premiums (taxes) to a different organization and have different benefits and limitations (laws) than they do.  Want a nanny state that takes most of your income and has lots of laws but provides all kind of benefits?  You can have that.  You want a police state where armed goons watch you through cameras and then leap into action to “protect” you at the touch of a panic button?  I’m sure some government will offer that.  A theocracy?  Sure, but your neighbors can still sin like crazy if they contract with a secular government.  And naturally, some would choose no government at all.

Obviously there are a LOT of problems and complications with this idea; for example, mineral rights have long been divorced from the property under which they lie, but what about common resources like air and water?  Treaties would need to be worked out for that.  Roads and other civil engineering projects could be free to the citizens of the government or governments which built them, while others paid a toll (toll tags could parse this automatically).  Violent crimes would probably be handled by the victim’s government, subject to whatever treaties & reciprocal agreements it had with the offender’s; violent crimes committed by anarchists would automatically be handled entirely by the government of the victim, thus providing an incentive for everyone to contract with some government, if only for legal protection in case a citizen of a “presumption of guilt” state decided to point at them.  Governments could still require residence in a certain place if they wanted, just as certain cults do, and every government would maintain some capital territory in which its power was absolute (just like companies, universities, etc have their own campus rules and security forces).  But in general, people would be free to choose the government that was right for them, and within a few centuries people would consider our current “You must obey us or die because you are within this set of imaginary lines” system as barbaric and monstrous as we consider forced religious conversion.

The Missing Word

Only ten years for this horror, while people renting rooms to sex workers get life sentences:

A South Carolina restauranteur was sentenced to [a short term in] prison after admitting he used violence, threats, and intimidation to force a black man to work more than 100 hours a week with no pay…Judge R. Bryan Harwell sentenced…Bobby Paul Edwards to [a mere] 10 years in federal prison after he…[admitted to enslaving] Chris Smith, an intellectually disabled black man…In 1996, when Smith was only 12 years old, he accepted a job at J&J Cafeteria…Six years later, Edwards took over as manager and stopped paying Smith.  Over the next 17 years, Edwards would torture, imprison and withhold pay from Smith, claiming that his pay was kept in an “account” that was inaccessible to Smith…[who was forced to] work…18 hours a day, six days a week.  On Sundays, he only had to work 11 hours…he never had a work break or a day off [and was] forced to live in a “cockroach-infested” apartment behind the business, Smith [said] that Edwards’ family never tried to intervene…When Smith’s family would try to check on him, Edwards would lock Smith in the kitchen or even in the freezer.  On the rare occasion that Smith indicated displeasure or tried to escape, he was [verbaly abused,] hit in the head with a frying pan, burned with hot tongs, [and] beaten with belt-buckles…Customers reported that they sometimes heard Smith being beaten and screaming for his life [but none of them could be bothered to do anything until]…Geneane Caines, who was friends with the Edwards family, was [told by]…her daughter, who worked at the eatery…how Edwards abused Smith…Edwards was sentenced to 10 years…[and] ordered to pay [a mere] $272,952.96 in restitution [for 17 years of slavery]…

The judge actually believes $3.08/hour, no overtime or punitive damages, was sufficient compensation to Edwards’ victim.  Smith should fucking own that place.

Property of the State 

Pregnant women are uniquely vulnerable to state coercion:

A 25-year-old woman named Chelsea Cheyenne Becker was arrested and charged with first-degree murder in Hanford, California, after delivering a stillborn baby in September.  [Prosecutors claim] the stillborn had toxic levels of methamphetamine in its body…cases like this are part of a burgeoning, disturbing pattern, in which the rights of pregnant women are directly pitted against those of the “unborn child,” a term that encompasses fertilized eggs, embryos, and fetuses.  It’s a direct result of the so-called “fetal personhood” movement, which seeks to legally redefine a fetus as a person as a means of overturning Roe v. Wade…there have been cases, already, of women being charged for taking prescription medication while pregnant — one woman was reportedly charged for taking a Valium

Here’s an interesting article about how the UK’s horrible Contagious Disease Acts – laws which infringed on human rights so severely they actually inspired English church ladies to fight on the side of whores for a while – affected the landscape of sex work in India, with special attention to Calcutta.  While the article does get some things wrong (as is nigh-universal among articles about sex work written by amateurs), most of the errors are minor and the author appears pretty solidly on the side of the whores, even to the point of describing how 19th-century whore stigma is still alive and harming Indian sex workers to this day via other vestiges of British colonial law.

The Truth About “The Truth About…”

Shannon Maley [of Airdrie, Scotland] had a…vendetta against a 20-year-old man with learning disabilities who was dating her sister.  She barely knew him, yet claimed he sexually assaulted her and her friends.  Maley then created multiple social media accounts under the young man’s name and sent herself disturbing and threatening messages in order to frame him.  She has since pleaded guilty to “perverting the course of justice and also to harassing witnesses”…Maley’s messages to herself included threats “to set you on fire and watch you burn alive”…Maley had apparently intimidated her friends into making accusations against [the young man] as well.  One of those friends eventually admitted that…he…had not sexually assaulted her and that Maley had harassed her and tried to influence their testimony…Maley’s story unraveled after she accused [her victim] of sending a threatening message while he was in prison without access to the Internet…

The Uighurs are a Turkic Muslim people who have for centuries inhabited the vast and remote Xinjiang region of China, an area so unknown to Europeans that they often imagined it as the site of mysterious realms, from the Kingdom of Prester John to H.P. Lovecraft’s Plateau of Leng.  Starting in 2014, the conformity-obsessed Chinese government has worked to turn this enormous area – larger than any European country except Russia – into the world’s most tightly-controlled police state, polluted by thousands of roadblocks and checkpoints, infested with cops and rotten with surveillance systems.   Then in the spring of 2017, mere mass surveillance and police harassment turned into a systematic campaign of rounding up Uighurs and condemning them to concentration camps for such “crimes” as having a beard, using Twitter or discussing Islam.  Within a year Western journalists discovered that Beijing had apparently created a file (including DNA records) on every single Uighur, and was in the process of “disappearing” more than 10,000 people per month into a network of hundreds of “re-education” centers where (in addition to brainwashing) they are subjected to monstrous yet childish humiliations such as having their faces and heads forcibly shaved; being given only haram pork to eat; and being forced to renounce their faith, chant moronic communist slogans, and do clownish dances in front of giant Chinese flagsUighur expats search the Chinese social media app TikTok for videos of the horrors which slip past Chinese censors, and a few weeks ago the world at large got to see a small glimpse of what these prisons look like, thanks to footage obtained by spy drones operated by a mysterious human rights group:

…chilling drone footage published online…appeares to show Uighur Muslim men at a train station being transferred…to detention camps…China’s ruling Communist Party…hold[s] up to one million mainly Uighur people in…concentration camps…[though of course] China vehemently denies the allegations…and…insisted its camps are simply “re-education” centres focused on training and skills development…[and that] “members of the public who have been chosen for re-education have been infected by an ideological illness”…

The abominations go far beyond their most visible manifestations, however.  Uighur children are being abducted from their families and confined to state-run orphanages where they are indoctrinated in pro-government propaganda and only allowed to speak Mandarin, and adults are forced to install spyware on their phones.  And the surveillance and harassment is spreading far beyond Xinjiang; “police are now using facial recognition technology to target Uighurs in wealthy eastern cities like Hangzhou and Wenzhou and across the coastal province of Fujian,” and police visited and threatened the family of a Chinese student in Brisbane after he attended a protest against the oppression of the Uighurs.  One doesn’t need a PhD in political science to see what Beijing is attempting:  the methodical and systematic erasure of an entire culture, the flushing of an entire people down the totalitarian memory hole.  And given that the West abandoned its pretentions of being the “Free World” (in anything but name) a generation ago, I honestly can’t see any way to stop this quiet genocide.

Some days are grumpier than others.

Puritanical language is an intrinsic part of any story about cops raiding massage parlors:
